Explain, in detail, the proposed use of the property. The main purpose for this property is a single family household. The small business, Skyline Training, use for this property is to educate people how to train their dogs for obedience and/or agility. All dogs are welcome whether mixed breed or purebred. The owners of the dogs bring them to either a class lesson which is 1 1/2 hours and would include up to 14 other dogs at one time with their owners or to a private lesson which is 1 hour and is just themselves, their dogs and the trainer. The purpose would range from instructing the owner in how to teach basic manners and obedience commands including walking on a leash (heeling), sit, stay, come, down and so much more plus teaching the dogs to focus on their owners or to do agility which is instructing the owners in how to run obstacles with their dogs on a course. The beginning and intermediate class has 40 min. of each, obedience and agility. The advanced class is all agility and is designed for those wishing to compete in agility trials. All dogs are owner trained with myself or one of the other trainers as the instructor. They come for their hour or hour and a half then leave. No dogs stay on the property. There are three levels of training whether for obedience or agility. The skill sets for each level is an advancement from the previous level with each level getting progres- sively more difficult. There is Beginners, Intermediate and Advanced. 5e Type and number of animals, if any, to be on this site. The type of animals on this site are dogs with their owners attending owner trained dog training with a maximum of 15 dogs per day, including my own dogs, broken up into 1 hour or 1 1/2 hour training sessions, during the week days and 35 dogs per day including my own dogs, broken up into 1 —1 1/2 hours training sessions on the weekends. Dogs are here for 1-1 1/2 hours for each lesson and then leave with their owners. I have 4 of my own dogs and 1 of my daughters which I watch often while the family is away. 1 feral cat. 5 f. The property owner has spoken to Robert in the Building Dept. and was told that a Certificate of Compliance would need to be issued for the use of the 13 year old 2400 sq. ft. Ag. building for it to be used for the training of dogs in the win- ter. That this process would happen once the USR has passed. • • Attachment 2 • • • Comprehensive Plan guiding principles - Chapter 22 The Weld County Comprehensive plan is designed to protect private property rights as well as respect the agricultural traditions of Weld County Colorado. 7746 WCR 19 is 8.75 acres and is located amongst agricultural land to the north and east, a dairy farm to the south and rural residential homes to the west. When the County allowed this piece of property to be subdivided 75 into its own parcel lot "A" of 8.75 acres at that time the county realistically understood that this piece of property would never allow a land owner to make a living off agricultural activities, it is just too small. The current property owners would like to keep this property in tune with the agricultural and rural activities as is consistent with the Weld County Comprehensive plan but would like to utilize their private property rights and operate a small business. The property owners would like to operate a small business, Skyline Training of owner trained dogs. This small business does not change the natural and rural characteristics of the property, nor does it impact the existing property uses of its neighbors. With the information provided and for the reasons stated above this small business venture is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive plan. Attachment 3 • • • Comprehensive Plan guiding principles - Chapter 23 Zoning As stated in the Comprehensive plan Chapter 23's purpose is to provide a unified regulatory system of land use in the County. This Chapter is designed to promote the health, safety, convenience, morals, order and welfare of the present and future inhabitants of the County. 1. Lessening congestion in the streets or roads or reducing the waste caused be excessive amounts of roads. This small business generates 60 trips a day on WCR 19 which mostly occur on the weekends. The number of trips and when the trips occur is a minimal impact to WCR 19. 2. Securing safety from fire, flood waters and other damages. This small business access is 24 feet wide which is adequate for emergency vehicles. The property is FEMA Zone C which is a minimal risk of flooding and erosion control devices are naturally occurring and will remain in place. 3. Providing light and air. Activities for this small business take place mainly outside during the day therefore plenty of light and air are available. 4. Classification of land uses and distribution of land development and utilization. This property is zoned agricultural. 7746 WCR 19 is 8.75 acres and is located amongst agricultural land to the north and east (dry land farming), a dairy farm to the south and rural residential homes to the west. When the County allowed this piece of property to be subdivided into its own parcel lot "A" of 8.75 acres at that time the county realistically understood that this piece of property would never allow a land owner to make a living off agricultural activities, it is just too small. The 4+ acres at the back of the property is being left in it's natural state at this time. Home Business: This small business is consistent with the rules and regulations noted in chapter 23 of the Comprehensive Plan except for the number of persons that gather as noted below. • The small business is incidental to the use of the principal use of the property, which is a home residence and does not change the character of the property see response in Attachment 2 • The use is conducted within an accessory structure and is primarily carried on by the owner of the property. • There is no advertising for the business, exterior storage, display or sales of materials, foods, supplies or equipment related to the operation of the small business, nor any highly explosive or combustible materials outside of normal home needs (propane for heating). • There is no commercial vehicle. • This small business does have, on occasion, more than 6 persons together for instruction on a regular basis. The gathering of six or more people takes place on occasion and none stay overnight. 5. Protecting the tax base of the County. This small business adds to the Weld County tax base. 6. Securing economy in governmental expenditures. There will be no costs to Weld County as associated to this Use by Special Review other than expenditures related to reviewing and processing it. • • Attachment 3 page 2 • • 7. Please see response in Attachment 2 9. Conserving the value of the property. The proposed small business for this property does not detract from the value of this property. 10. Encouraging the most appropriate use of the land. Please see response in Attachment 2 Chapter 23 is also intended to protect the public health, safety and welfare by: 1. Regulating activities and development in hazardous areas. This property is not located in a hazardous area. 2. Protecting lands from activities which would cause immediate or foreseeable material danger to significant wildlife habitat and would endanger a wildlife species. To the owners knowledge there is no significant wildlife habitat. Some clients of this small business are members of Birds of Prey and as a result this person will often release back into the wild threatened and endangered birds (re -habilitated hawks, owls, etc.) 3. Preserving areas of historical and archaeological importance. To the owners knowledge there are no historical or archaeological sites on the property. 4. Regulating with respect to the establishment of roads on public lands administered by the federal government. This is not applicable for this property. 5. Regulation the location of activities and developments which may result in significant changes in population density.
