HomeMy WebLinkAbout20091624.tiffRESOLUTION RE: APPROVE NON -FINANCIAL AGREEMENT FOR REFUGEE HEALTH SERVICES COORDINATOR AND AUTHORIZE CHAIR TO SIGN - LUTHERAN FAMILY SERVICES OF COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Non -Financial Agreement for Refugee Health Services Coordinator between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Department of Public Health and Environment, and the Lutheran Family Services of Colorado, commencing upon full execution, with further terms and conditions being as stated in said agreement, and WHEREAS, a hearing before the Board was held on the 15th day of July, 2009, at which time the Board deemed it advisable to continue said matter to allow adequate time for a work session to be conducted, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Non -Financial Agreement for Refugee Health Services Coordinator between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Department of Public Health and Environment, and the Lutheran Family Services of Colorado be, and hereby is, approved. Wallace, MD, MPH, Director Department of Public Health and Environment IiVwik DATE: May 5, 2009 SUBJECT: Agreement between Lutheran Family Services (LFS) and WCDPHE for Health Services Coordinator Enclosed for Board review and approval is an agreement between Lutheran Family Services (LFS) and Weld County for supporting the grant —funded services of the Refugee Health Services Coordinator position. The agreement allows for WCDPHE to provide office space and equipment use for the LFS staff person here at the North Health Department site. The LFS staff person can refer refugees for public health services here and to other health care providers. WCDPHE staff will refer clients for refugee services to the LFS person. Funding for the Health Services Coordinator is covered through a LFS grant from the Refugee and Asylee Program of the US Citizenship and Immigration Services. I recommend your approval of this agreement. Enclosure 2009-1624 NON -FINANCIAL AGREEMENT THIS AGREEMENT, made this 24th day of March, 2009, by and between the Board of County Commissioners of Weld County, Colorado on behalf of the Weld County Department of Public Health and Environment, hereinafter referred to as "Public Health" and Lutheran Family Services of Colorado (LFS), hereinafter referred to as "Agency." WHEREAS, Public Health and the Agency serve refugee and asylee cleints seeking health services, and WHEREAS, the Agency encourages its clients to utilize the services offered by Public Health as a means of ensuring individual and community health and wellness, and WHEREAS, the Agency seeks verification on the health status of its clients, and WHEREAS, Public Health and the Agency desire to work together to meet both the needs of their clients in common, NOW, THEREFORE, in consideration of these goals, the parties agree to the following: A. The Agency agrees to: 1. make available a bilingual/bicultural (with focus on a refugee language/cultural groups) Health Services Coordinator to be based at Public Health to assist shared (refugee/asylee) clients and Public Health staff. 2. provide health referral information to Public Health on each client prior to client's referral to health services 3. follow established procedures and polices of Public Health in regard to temporary/short term jobs, part-time employment, full-time employment, Federal bonding, registration and referral and placement functions and requirements 4. additionally, the Agency Health Services Coordinator may be involved in any or all of the following Public Health activities: client reception area support, services intake assistance for clients as necessary, participation in selected Public Health -sponsored events and programs, translation/interpretation when available, outreach to refugee/asylee communities, and other activities as agreed upon by designated contact persons of the Agency and Public Health. 5. designate a contact person to whom all matters regarding this agreement may be channeled Di;PY.,9- /6:;/9 6. provide an endorsed release of information form from each client for whom the Agency seeks verification B. Public Health agrees to: 1. host a bilingual/bicultural (with focus on a refugee language/cultural groups) Health Services Coordinator at Public Health to assist shared (refugee/asylee) clients. 2. provide training and orientation to Agency Health Services Coordinator, concerning Public Health policies, procedures, service delivery protocols and available health resources. 3. provide verification of Public Health intake/referral of the Agency's client(s) 4. refer client(s) to appropriate health resources based on client needs 5. designate a contact person to whom all issues regarding this agreement may be channeled 6. contact Agency regarding public health issues affecting refugee/asylee communities. C. Denial of Services Public Health has sole authority to deny services to any client who fails to follow the established rules and policies of Public Health. D. Assurances: 1. The Agency agrees that it is an independent contractor and that its officers, employees and clients do not become employees of Weld County, and therefore arc not entitled to any employee benefits as Weld County employees, as a result of the execution of this Agreement. 2. Weld County, the Board of County Commissioners of Weld County, its officers and employees, shall not be held liable for injuries or damages caused by any negligent acts or omissions of the Agency, or its employees, volunteers, or agents while performing functions as described in this Agreement. The Agency shall indemnify, defend and hold harmless Weld County, the Board of County Commissioners of Weld County, its officers and employees for any loss occasioned as a result of the performance of this Agreement by its employees, volunteers, clients and agents. The Agency shall provide workers' compensation insurance for all employees of the Agency engaged in the performance of this Agreement, as required by the Colorado Workers' Compensation Act. 3. No officer, member or employee of Weld County, and no member of their governing bodies shall have any pecuniary interest, direct or indirect, in the approved Agreement or the proceeds thereof. 4. The Agency understands that monitoring and evaluation of the performance of this Agreement shall be conducted by the Weld County Department of Public Health and Environment and the results provided to the Board of County Commissioners of Weld County. 5. The Agency and Public Health assure compliance with Title VI of the Civil Rights Act of 1986, and that no person shall, on the grounds of race, creed, color, sex, or national origin be excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under the approved Agreement. E. Mutual Agreement: The Agency and Public Health mutually agree to abide by the terms and conditions herein specified. F. Termination: This Agreement may be terminated at any time by either party giving thirty (30) days written notice, and is subject to the availability of funding. Entire Agreement: This Agreement constitutes the entire understanding between the parties with respect to the subject matter hereof, and may not be changed or modified without prior agreement of both parties and their governing bodies. IN WITNESS WHEREOF, the parties hereto have duly executed the Agreement as of the day, month and year first above written.
