RE: ACTION OF BOARD CONCERNING USE BY SPECIAL REVIEW PERMIT#1683 FOR AN
EXPANSION OF A NON -CONFORMING USE (SKI CLUB) IN THE A (AGRICULTURAL)
ZONE DISTRICT - THE HIGHLAND DITCH COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 19th day of
August, 2009, at the hour of 10:00 a.m., in the Chambers of the Board for the purpose of hearing the
application of The Highland Ditch Company, c/o Todd Hodges Design, LLC, 1269 North Cleveland
Avenue, Loveland, Colorado 80537, for a Site Specific Development Plan and Use by Special
Review Permit #1683 for an Expansion of a Non -Conforming Use (ski club) in the A (Agricultural)
Zone District, on the following described real estate, to -wit:
Highland Reservoir #1; being part of Section 22,
Township 3 North, Range 68 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, at said hearing, Planning staff advised the Board that the applicant requested,
and was granted, an indefinite continuance of the matter, in order to resolve legal matters, at the
Planning Commission hearing on August 4, 2009, and
WHEREAS, the Board heard all of the testimony and statements of those present and
reviewed the request of the applicant and, having been fully informed, finds that it is appropriate for
the matter to be referred back to staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, referred back to staff.

Michelle,
I would note that actually the motion will be to refer the matter back to staff, since we
don't do indefinite continuances. Once it's ready to go forward, staff can send the file
back over and we'll do a new notice for publication and mailing to the SPO's.

Just a heads up that the applicants for the hearings scheduled for 8/19 will need to be
advised that only three Commissioners will be present; Commissioners Rademacher and Conway
will be excused. Please contact us for available continuance dates if you want to coordinate
with the applicants ahead of time to help speed up the process on the 19th.
