HomeMy WebLinkAbout20091097.tiffRESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST J. F. DEVEREUX FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, J. F. Devereux, ZCV #0900044, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 12th day of May, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, J. F. Devereux, property owner, was present at said hearing, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until July 12, 2009, to allow adequate time for the property owner to relocate the remaining vehicles behind the screening or to remove them from the site within seven (7) days of this hearing, and to reduce the number of vehicles or submit a Use by Special Review Permit to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV #0900044 be, and hereby is, referred to the Weld County Attorney's Office for legal action against J. F. Devereux to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until July 12, 2009, to allow adequate time for the property owner to relocate the remaining vehicles behind the screening or to remove them from the site within seven (7) days of this hearing, and to reduce the number of vehicles or submit a Use by Special Review Permit to bring the subject property into compliance. REMEDY 2009-1097 Violation Summary Report As we have previously discussed (ZCV08-00101) while the presence of a NONCOMMERCIAL JUNKYARD consisting of DERELICT VEHICLES is an allowed use within the Agriculture Zone District, it must be completely SCREENED from all adjacent properties and public rights -of -ways; otherwise, any Derelict Vehicles shall be operational at all times and evidence of current registrations shall be submitted to this office. The materials utilized to screen the property shall be opaque and in good condition. If you are proposing any type of screening other than a standard wooden privacy fence like you would see in town, a plan shall be submitted to this office outlining the type of material you are proposing along with a picture to determine if the material is acceptable. RECOMMENDATION The Department of Planning Services recommends this case be forwarded to the County Attorney's Office for immediate legal action. No pictures were taken during this inspection. JF Devereux (303-587-9190) called. He indicated that he is wanting to attach a nice opaque wooden screening to the chain link fence. He asked if that would work. I explained that I would have to re -visit the property. I told him that I would re -inspect it mid week of the following week. He asked me to call him with my inspection results. Upon a visual inspection of the property, the following items were noted: several derelict vehicles. I also noted the chain link fence. See drawing on outside of violation file. No pictures were taken during this inspection. I called JF Devereux (303-587-9190). I explained that I had re -inspected the site and noted the chain link fence he was referring too. I advised him that the installation of the material would not entirely screen all of the derelict vehicles. He indicated that they would be relocated behind the new proposed fence. He indicated that he is hoping to get rid of like 20 of them this summer. He asked how much time he would have to instal a fence of that size. Going from the garage on the Eastern side South to the Chain link, then going along Hwy 52 following the chain link, then going North along the chain link. I advised him that his current letter grants until 03/24/09. I told him that the longest I could go would be to schedule him for the May 12th Violation Hearing. That would in essance grant an additional extension after March 24th. He said that would be more than enough time. He said this time he would hire help to help him install the fence. He said he would touch base with me towards the 24th of March. JF Devereux (303-587-9190) called. He said he would like to request an extension. He said he already has some of the fencing material, but is running into issues obtaining the rest. I read our previous discussion notes and advised him that I would be scheduling his case for the May 12th Violation Hearings. If not he would need to attend the hearings on the 12th. I advised him if it is done sooner, to just give me a call. He said he would. 03/23/2009 Property Inspected Upon a visual inspection of the property, the following items were noted: no progress was visible. Several derelict vehicles are still visible.
