The Weld County Public Works Department has reviewed this proposal. Our comments and
requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002)
WCR 37 is a local paved road and requires a 60 -foot right-of-way at full build out. There is
presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured
from the future right-of-way line.
REQUIREMENTS:
The applicant shall utilize the existing access to this parcel.
Please provide water quality feature description, location on site plan, and calculations for the
feature.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on
the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds.

Environmental Health Services has reviewed this proposal for the expansion of a flow
metering facility. Potable water will be provided by an individual well (permit 251664);
however a copy of the permit was not included in the application. There are currently 4
septic systems located on the property which can serve up to a combined total of 49
people. The locations of the systems are identified as "drain field" on the plat submitted
with the application.
A dust abatement plan is required for the areas on the facility that will not be paved,
such as the outdoor storage area. A waste handling plan is required for typical office
waste as well as for any materials used in the business operation such as chemicals
and solvents.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, for on site dust, for review and
approval, to Environmental Health Services, Weld County Department of Public
Health & Environment.
2. Provide a copy of well permit 251664 to Environmental Health Services, Weld
County Department of Public Health & Environment.
3. The applicant shall submit evidence of a Colorado Discharge Permit System
(CDPS) from the Water Quality Control Division of the Colorado Department of
Health and Environment for any proposed discharge into State Waterways, if
applicable.

4. In the event the facility's water system serves more 25 persons on a daily basis
the water system shall comply with the Colorado Primary Drinking Water
Regulations (5 CCR 1003-1). Evidence shall be provided to Environmental
Health Services, Weld County Department of Public Health and Environment
from the Colorado Department of Health and Environment that the system
complies with the Regulations.
5. In the event the septic system requires a design capacity of over 2,000 gallons of
sewage per day the applicants shall provide evidence that all requirements of the
Water Quality Control Division (WQCD) of the Colorado Department of Public
Health and Environment (specifically Policies WQSA-6 and WQSA-8) have been
satisfied. Evidence of compliance shall be provided to the Weld County
Department of Public Health and Environment. Alternately, the applicant can
provide evidence from the WQCD that they are not subject to these
requirements.
6. Provide a legend on the plat which identifies the septic permit number that is
associated with each "drain field".
7. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.

3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan".
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The applicant shall operate in accordance with the approved "dust abatement
plan".
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Adequate handwashing and toilet facilities shall be provided for employees and
patrons of the facility, at all times.
8. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to Individual Sewage Disposal Systems.
9. A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. (Well permit
10.All potentially hazardous chemicals must be stored and handled in a safe manner
in accordance with product labeling and in a manner that minimizes the release
of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's).
11. The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
12. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
13. This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public Health
and Environment. We strongly encourage the applicant to test their drinking
water prior to consumption and periodically test it over time.
14. The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

1 A building permit application must be completed and two complete sets of plans including
engineered foundation plans bearing the wet stamp of a Colorado registered architect or
engineer must be submitted for review. A geotechnical engineering report preformed by a
registered State of Colorado engineer shall be required.
2 A plan review shall be approved and a permit must be issued prior to the start of construction.

Dear Mr. Ogle:
We have reviewed the above referenced proposal for a Site Specific Development Plan and
Amended Use by Special Review for the Colorado Engineering Experiment Station. The submitted material
does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a) C.R.S. Therefore,
pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will
only perform a cursory review of the referral information and provide comments. The comments will not
address the adequacy of the water supply plan for this development or the ability of the water supply plan to
•tisfy any County regulations or requirements:
The applicant has not submitted a Water Supply Information Summary Sheet. However, information
that was submitted indicates that the Colorado Engineering Experiment Station has two existing wells. One
well is listed as having permit no. 251664, and the claimed uses are for drinking water, sanitation, fire
protection and irrigation of less than 'IA acre. The other well is stated to be an auxiliary well that is not
currently being used; no permit number was provided for this well. Well permit no. 251664 is permitted for
commercial drinking and sanitary use and up to one acre-foot of pumping per year.
The State Engineer's Office does not object to the proposed commercial use of well permit number
251664 for the Colorado Engineering Experiment Station provided the well is operated in accordance with
the permit's conditions of approval. Well permit 251664 cannot be used for any outside use; therefore, the
weii may not be used for landscape irrigation as indicated in the submitted materials. Additionally, the
second unpermitted well cannot be used for any outside use unless a permit is obtained that allows for such
use. In order to clarify the allowed use of the second well, we recommend the Applicant obtain a well permit
for the second well.
