RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR USE BY
SPECIAL REVIEW PERMIT #1604 - MARCUM MIDSTREAM 1995-2 BUSINESS
TRUST, C/O CONQUEST OIL COMPANY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated June 6, 2007, the Board approved the application of
Marcum Midstream 1995-2 Business Trust, 303 East 17th Avenue, Suite 660, Denver, Colorado
80203, for an Oil and Gas Support Facility (Class II oilfield waste disposal facility), in the
A (Agricultural) Zone District on the following described real estate, to wit:
S1/2 SE1/4 of Section 30, Township 3 North,
Range 65 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, on April 30, 2008, the Board of County Commissioners of Weld County,
Colorado, approved a Long -Term Road Maintenance and Improvements Agreement (County
Road 39), between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, and Marcum Midstream 1995-2 Business Trust, c/o Conquest
Oil Company, with terms and conditions being as stated in said agreement, and accepted
License or Permit Bond #RLB0011463, drawn on the RLI Insurance Company, 8 Greenway
Plaza, Suite 400, Houston, Texas 77046, in the amount of $10,985.00, and
WHEREAS, staff from the Weld County Departments of Public Works and Planning
Services have conducted a visual inspection and, along with the Weld County Attorney,
recommend release of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the License or Permit Bond #RLB0011463, drawn on the RLI Insurance
Company, in the amount of $10,985.00 be, and hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

Staff from the Department of Public Works conducted a field inspection in October 2009 and
determined that the property was in compliance with all transportation elements as stated in their
referral dated November 4, 2009. Planning Services inspected the site on May 5, 2009 and
determined that all non -transportation related items had been completed and were acceptable.
The Weld County Attorney, the Department of Public Works and the Department of Planning
Services, have determined that Permit Bond #RLB011463 from RLI Insurance Company, for
Marcum Midstream 1995-2 Business Trust, c/o Conquest Oil, be released in full.

as Surety, are held and firmly bound unto Weld County Board of Commissioners, P.O. Box 758, Greeley, Colorado 80632 , as
Obligee, in the sum of Ten Thousand Nine Hundred Eighty Five and No/100 Dollars
($ 10,985.00

WHEREAS, the Principal has been or is about to enter into a Long -Term Road Maintenance and Improvements Agreement with the
Obligee.

applicable local ordinances, and conduct business in conformity therewith, then this obligation to be void; otherwise to remain in full

2. Any claim must bp presented in writing to RLI Insurance Company to the attention of Greg E. Chilson, 8 Greenway Plaza,

3. Surety shall have no obligation to the Principal, the Obligee or any other person or entity for any loss suffered by the Principal,
the Obligee or any other person or entity by reason of acts or omissions which are or could be covered by the Obligee's or the
Principal's general liability insurance, products liability insurance, completed operations insurance or any other insurance.
4. No right or action shall accrue under this Bond to or for the use or benefit of anyone other than the named Obligee.
5. The Obligee will issue a release of this Bond within a reasonable period, but in no instance longer than thirty (30) days after
termination of the Permit.
