RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR USE BY
SPECIAL REVIEW #1615 - ERO-GUARD WEST, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated August 8, 2007, the Board approved the application of
Horton Farms II, LLC, 885 South Colorado Boulevard, Denver, Colorado 80246-8006, c/o
Stephen Parry, 5336 Flatrock Court, Morrison, Colorado 80465, for a Use Permitted as a Use by
Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts
(manufacturing of landscape blankets) in the A (Agricultural) Zone District on the following
described real estate, to wit:
Part of the SW1/4 of Section 28, Township 2 North,
Range 64 West of the 6th P.M., Weld County,
Colorado, and
WHEREAS, on May 19, 2008, the Board of County Commissioners of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements (Private Road Maintenance), between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, and Ero-Guard West, Inc.,
with terms and conditions being as stated in said agreement, and accepted check #1908 from
Ero-Guard Inc., in the amount of $2,850.00, and
WHEREAS, staff from the Weld County Departments of Public Works and Planning
Services have conducted a visual inspection and, along with Weld County Attorney, recommend
release of said collateral.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that check #1908, drawn on Ero-Guard Inc., in the amount of $2,850.00 be,
and hereby is, canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

Staff from the Department of Public Works determined that the property was in compliance with
all transportation elements as stated in their referral dated December 11, 2009. Planning
Services inspected the site on May 5, 2009 and determined that all non -transportation related
items had been completed and were acceptable.
The Weld County Attorney, the Department of Public Works and the Department of Planning
Services, have determined that cash deposit for Horton Farms II, LLC, [Ero-Guard West, Inc. c/o
Stephen Parry] , be released in full.
