Anita,
I looked at the file and what I'm planning is for the Planning Commission hearing to be on July 7, 2009 in Greeley
at 1:30 (918 10th Street). The Board of County Commissioners hearing should fall about 3 weeks after the
Planning Commission hearing but I will let you know for sure when the hearing date has been set. The Board of
County Commissioners has the final determination on the case.
At this point I still need sign off from Tim Bilobran with CDOT regarding the access.
Also at this time you will need to notify the mineral owners on site.
State Statue C.R.S.24-65.5-103 (adopted as part of H.B.01-1088) requires that the applicant provide legal
notification to the mineral owners and lessees on the property 30 days prior to the Planning Commission hearing.
By June 7, 2009 you will need to send letters either first class (will need receipt from post office stating the letters
were sent first class) or certified mail to the mineral owners and lessees outlining your application request. The
letter needs to include the address and legal description for the property, the size of the property, the proposed
use, your contact information (you can also include mine if you wish), the date of the Planning Commission
hearing (July 7, 2009) and the location of the hearing (Weld County Department of Planning Services 918 10th
Street Greeley CO 80631). Evidence will need to be submitted to me along with the attached form signed and
notarized that this was done by June 7, 2009.
I noticed that you have already done the research as to who the mineral owners are for your property. You stated
that it was Murray Herring. To find out who the mineral owners and lessees are on you property you will need to
contact the clerk and recording office 970-353-3840 to help you with the search (you will need the legal
description of your property). You can also look in the paper work you received when you purchased the property
there is sometimes something in there.

RE: NOTIFICATION OF MINERAL INTEREST OWNERS AND LESSEES
The undersigned Applicant certifies compliance with the provisions of C.R.S. § 24-65.5-
103(1), and in support thereof, states and certifies as follows:
1. That Applicant has provided notice, (a copy of which is attached hereto as
Exhibit "A"), containing the time and place of the initial public hearing on its application

description by section, township and range of the property which is the subject of the
