Box 758 Greeley, CO 80632 Board Members, The attached petitions are presented to you on the general basis of June 30, 2008 value being decreased due to the devastating tornado that hit Windsor on May 22, 2008. The petition for appeal is based on: 1. The annotation to CRS 39-1-104 provides that "...Assessor is not prevented from taking into account any unusual conditions..." and these unusual conditions provision can be applied to individual properties and not to total neighborhoods. So I believe the assessor has the right to make adjustments due to tornado damage. 2. The assessors office claims they had no statutory authority to do so and the damaged property plus insurance money equals value. Insurance money or contract is not "real estate" for tax purposes. 3. The June 30, 2008 value of all of the attached were severely damaged. We lost tenants due to the tornado (Chefs Basket) and our golf course revenue was devastatingly impacted.
