HomeMy WebLinkAbout20090680.tiffRESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING FOR JOINT FUNDING FROM BUREAU OF JUSTICE ASSISTANCE AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Memorandum of Understanding for Joint Funding from the Bureau of Justice Assistance between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff's Office, and the City of Greeley, commencing upon full execution, with further terms and conditions being as stated in said memorandum of understanding, and WHEREAS, a hearing before the Board was held on the 23rd day of March, 2009, at which time the Board deemed it advisable to continue said matter to March 25, 2009, at 9:00 a.m., to allow adequate time to research how the funds will be utilized. WHEREAS, after review, the Board deems it advisable to approve said memorandum of understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding for Joint Funding from the Bureau of Justice Assistance between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Weld County Sheriff's Office, and the City of Greeley be, and hereby is, approved. Conway 2 2009-0680 SO0030 MEMORANDUM OF UNDERSTANDING Application # 2009-F1810-CO-SU THIS MEMORANDUM OF UNDERSTANDING is made this &sat day of iiak , 2009, by and between THE CITY OF GREELEY, COLORADO and THE WELD COUNTY BOARD OF COUNTY COMMISSIONERS, COUNTY OF WELD, COLORADO. WHEREAS, the Bureau of Justice Assistance has provided joint funding that is available to both the Greeley Police Department and the Weld County Sheriffs Office; and WHEREAS, the funding that is being provided by the Bureau of Justice Assistance is in the total amount of $434,211; and WHEREAS, the Greeley Police Department (Fiscal Agent) will initially receive the total grant award of $434,211; will remit the amount of $107,876 to the Weld County Sheriffs Department as the Sheriffs Department portion of the grant award; and, will retain the amount of $326,335 as the Police Department's portion of the award. WHEREAS, as with previous funding, both agencies have determined that they have different needs and uses for the funds being made available; and WI-IEREAS, this Memorandum of Understanding provides for the division of funds being made available; and WHEREAS, the parties wish to reduce their understanding to writing. THE PARTIES HEREBY AGREE AS FOLLOWS: 1) Upon receipt of the total funding amount of $434,211, the Greeley Police Department (Fiscal Agent) will pay the sum of $107,876 to the Weld County Sheriffs Office as and for the Weld County's portion of the Recovery Act: Edward Byrne Memorial Justice Assistance Grant (JAG) formula program. 2) The remaining sum in the amount of $326,335 will be retained by the Greeley Police Department as and for the Greeley Police Department's portion Recovery Act: Edward Byrne Memorial Justice Assistance Grant (JAG) formula program. 3) The financial reporting to the Bureau of Justice Assistance will be maintained by the Greeley Police Department (Fiscal Agent) with each party maintaining a financial and &/,/-,% - (Pc operational record of their respective portions of the program and in compliance with the Federal Financial Guide, the parameters of the grant and any special conditions as noted in the SOGA award. The Weld County Sheriff's Office shall transmit said records to the Greeley Police Department upon request by the Department. Sheriff Cooke had not determined the specific items he will buy. Allowable items include: weapons, vehicles, radios, ammo, body armor, etc. No buildings or related building expenses are allowed. Last year the MOU, for the JAG Grant, was for less money. That one was signed by the Board of County Commissioners' Chair and Sheriff Cooke. The question I have is if it's required that the Commissioners approve the grant. There is no cash match required and the Sheriff is the person who will be accountable for the funds. Since the Sheriff is an elected official can he just sign it? If the MOU requires the Commissioners' approval I need to have the MOU placed on the agenda. I'm sure Sheriff Cooke will decide who he want to be there to answer any questions I need 3 copies with original signatures. I'll appreciate having them by March 26. Thanks Juan O. The fed's want us to add the words "fiscal agent" behind the title for Greeley Police Department on the MOU. Per instructions from Stacey, we do not need to resubmit to council, just circulate the revised MOU for signatures. Can you please get signatures on all three copies for me and return to me. Juan or I will get the signatures from the County and when complete, send an original back to the city and county for keeping and one for our grant records. Give me a call if you have questions. Attached PDF file: The attached file contains the MOU approved by the Weld County Board of Commissioners on March 2, 2009 and by the City of Greeley Council on April 7, 2009 (Resolution 36, 2009 — pages 1- 3). Pages 3 and 4 is another version of the MOU with additional wording the Federal Grant Authority wants added, page 4 — paragraph 3. The added words are "(Fiscal Agent)." Since the additional wording does not materially alter the MOU or responsibilities do we need another formal presentation to the Council and Commissioners to resign the MOU or will the original authorization and resolution allow for just signing the new MOU? In the body of the grant it states that the Greeley Police Department is the fiscal agent. We have some time to resolve this; however, I would like to get it done as soon as possible.
