RE: APPROVAL OF RECORDED EXEMPTION NO. 409 - CALKINS LAKE II
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held
on the 15th day of August, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 409 , being the property of Calkins Lake II, described
as Part of the Southeast Quarter of Section 30 , Township 3 North,
Range 68 West of the 6th P .M. , Weld County, Colorado, being more
particularly described as follows :

does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the
definitions of "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended,
and Section 2-1A(3) of the Weld County Subdivision Regulations .

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Calkins Lake II be, and hereby is , exempt
from the definition of the terms "subdivision" and "subdivided
land" pursuant to its authority under Section 30-28-101 (10) (d) ,
CRS 1973, as amended, subject to the applicant submitting an
amended Recorded Exemption plat which shall accurately identify
through a survey and title search, the ownership of the property
lying between the existing County Road 28 and the property under
consideration.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 15th day of
August, A.D. , 1979 .

Dear Commissioners :
The attached application, plat and related materials are in reference
to a request from Calkins Lake II , a limited partnership , for a
recorded exemption. The parcel of land on which this request has
been made is described as Pt . SE* Section 30, T3N, R68W of the 6th
P.M. , Weld County, Colorado . This property is located approximately
3 miles southwest of Mead on the north side of Union Reservoir. The
property contains 46. 69 acres which is zoned Estate. The request is
to split the property into parcels of 19.69 acres and 27. 00 acres in
size.
The applicants wish to sell the 27. 00 acre parcel to honor a contract
made by the previous owner of the property. The 19. 69 acre parcel is
proposed for residential development when Longs Peak water taps become
available.
Based upon the information submitted and the adopted policies in the
County, the Department of Planning Services Staff recommends the
request be approved for the following reasons :
1 . The request conforms with the recorded exemption procedure and
the Weld County Comprehensive Plan. The request will be compati-
ble with surrounding land uses. The property is located in the
St . Vrain Valley Planning Area. The request does not appear to
have any adverse impacts on the agricultural interests of the
County.

2. The Longmont Planning Department has set forth no objections to
the request . It has recommended that a well with adequate
treatment be utilized on the property until such time that Longs
Peak water taps become available for the property.
3. The request complies with the provisions of Section 9-4 A. of
the Weld County Subdivision Regulation.
The Department of Planning Services Staff recommendation for approval
is subject to the applicant submitting an amended Recorded Exemption
plat which shall accurately identify through a survey and title
search, the ownership of the property lying between the existing
County Road 28 and the property under consideration. In addition,
the applicant should be aware of the Weld County Health Department ' s
comments as contained in its letter dated August 7, 1979, regarding
septic systems and potable water sources.

Re: Recorded Exemption Request
Calkins Lake II
Dear Mr. Cunliffe:
As per our conversation of yesterday's date, I would like
to explain the anticipated domestic water requirements immediately
following the proposed recorded exemption.
The proposed buyers of the 27 acre parcel, Mr. and Mrs. Bill
Allen, wish to construct a personal residence on the northeast
corner of said parcel. The recent well tests performed by the
Boulder County Health Department indicate that samples from the
existing 50' and 450' wells contain excess amounts of choloform
bacteria. The county stated the water can be treated by way of
chlorination and disinfection to be made suitable for human
consumption. However, with the availability of Longs Peak Water
taps projected within 18 months, the Aliens would prefer to utilize
a water sisternfor the interim period. Therefore, while domestic
water is available via the existing well, the Allen's prefer to use
a domestic sistern and obtain a Longs Peak tap when available.
Application for such tap has been submitted to the Longs Peak
Water Company.
The sellers of the 27 acre parcel, Calkins Lake II, will
retain the remaining 19.69 acres. Projected land use is for
residential development when Longs Peak taps become available.
No development or construction is planned prior to this water source
being available for domestic use.

As you stated earlier the process of a recorded exemption
does require domestic water availability for both parcels created.
While this domestic water is available immediately by way of well
treatment, it is the intention of both parties to obtain Longs Peak
water when the current moratorium on taps is lifted by the water
district.

Dear Sir,
During the period of time the captioned land was owned by
James W. Bishop, a contract was entered into between Bishop and Billy
and Virginia Allen for the sale of the north 27 acres of this property.
The Aliens entered into this contract in good faith and it is our wish
to complete the sale to the Allens.
The representation was made to the Aliens, by Bishop that the
parcel was part of a subdivision and the legal description in the sales
contract described said parcel as Outlot 1A, Calkins Lake Subdivision.

Regarding the proposed recorded exemption which falls within the St.
Vrain Valley Planning Area, we have the following comments:
1 ) There is no guarantee that the Longs Peak Water taps
will be available in the stated 18 month period nor
that the applicant's request for a tap will be
approved. We recommend that a well with adequate
treatment be utilized in the "interim" period.

Our division's comments regarding this Recorded Exemption are
as follows:
1. High groundwater in the area may cause any future septic
system to be engineer—designed as a permit requirement.
2. Our regulations do not address private drinking waters.
However, we recommend that a consistently potable source of
water be found and that any waters placed in a cistern also
be from that potable source. The Weld County Building
Inspection Division, through their enforcement of the Plumbing
Code, has some powers in the enforcement of potable drinking
and bathing waters.
