RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST JESUS AND ELVIRA GONZALES FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Jesus and Elvira Gonzales, ZCV #0900108, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of September, 2009, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Elvira Gonzales, property owner, and Julian Vasquez, were present at said
hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until November 8, 2009, to allow adequate time for the property owners to restore,
remove or screen the noncommercial junkyard from all adjacent properties and public
rights -of -way, and to submit a Use by Special Review Permit application or remove the commercial
vehicles numbering more than the one (1) allowed, to bring the subject property into compliance
and for an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0900108 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Jesus and Elvira Gonzales to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until November 8, 2009, to allow adequate time
for the property owners to restore, remove or screen the noncommercial junkyard from all adjacent
properties and public rights -of -way, and to submit a Use by Special Review Permit application or
remove the commercial vehicles numbering more than the one (1) allowed, to bring the subject
property into compliance.

last or currently registered under the property owner and/or tenant's name. This definition
does not include COMMERCIAL VEHICLES. If the Zone district allows, the
NONCOMMERCIAL JUNKYARD shall be totally ENCLOSED within a BUILDING or
STRUCTURE or visually SCREENED from all ADJACENT properties and public
rights -of -way.

is partially or totally dismantled; has all or portions of its body work missing or is
substantially damaged; does not have valid registration with the State, as required by
Section 42-3-103, 42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is
not permanently attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is
lacking proper equipment to the extent that it would be unsafe or illegal to USE on public
road rights -of -way or otherwise not equipped with lamps and other equipment, as required
in Sections 42-4-202 to 42-2-227, C.R.S. This definition shall not include implements of
husbandry, farm tractors or vehicles customarily operated in a FARMING operation.
JUNK: Scrap brass, iron, lead, tin, zinc; all other scrap metals and alloys; bones; rags;

A PRE -APPLICATION MEETING WAS HELD ON JUNE 11, 2009. IT WAS DISCUSSED THEN THAT
A USE BY SPECIAL REVIEW APPLICATION SHALL BE COMPLETED AND SUBMITTED FOR THE

SCREENING REQUIREMENTS AND YES, ONE

AND SCREENING ADDITIONAL COMMERCIAL
VEHICLES WAS NOT AN OPTION. I TOLD HER TO
KEEP ME POSTED PRIOR TO THE HEARINGS WHAT

I did go out there about a week ago and gave to the brother of the owner of the land several open burning
brochures and verbally told him about open burning regulations. He contacted his sister while I was visiting
with him.
I talked with his sister who owns the property (on the cell phone). She told me she is a county employee who
works in the building just to the south of the health department. She is Elvira Gonzalez @ Ext. 3378. I got the
impression that she was saying to me that since she is a county employee that I should "ease" up a bit!
Nonetheless, I let her know the "rules" of open burning.
I contacted the complainant (Clifford Clift) and asked that if other burning is conducted that he call "911" and
have the fire extinguished. I also said that I will want to know about future open burns, as there will likely be
no open burning permits issued for the items that are intended to be burned.
If I can receive an invitation to a Planning Commission hearing dealing with the noncommercial junkyard and
the trucking business without a USR I would be pleased. I will attend!

On Thursday, June 11, 2009 an informal discussion took place at the Greeley Administrative
Offices Conference Room regarding a proposed USR to park commercial vehicles. (The legal
description is Lot B RE -3123; Part of the NW4SE4 of Section 11, Township 5 North, Range 65
West of the 6th P.M.; Situs Address is 1707 Holly Ave)
Background Information:
Staff received a complaint that commercial vehicles were being parked on site. Upon
inspection, staff visited with the applicant and noted that there were commercial vehicles parking
on site and is a violation according to Weld County Code.
There are 10 commercial vehicles parked on site. There is no office. The applicants indicated
that family members use this site to park their vehicles when not on the road.
The site is zoned agricultural and encumbers approximately 18 acres.
Public Works
No Traffic Study is required. The applicants mentioned that many times the drivers are dropped
off by their wives or friends; however there are some passenger vehicles in the parking area by
family members and outside staff.
Staff requested that the applicant give a description of the drainage of the property. The
applicant may visit with Clay Kimmi of Public Works (970-304-6496 ext. 3741) for further
direction.
The site is located in a FEMA regulated floodplain. Please contact Clay Kimmi for a Flood
Hazard Development Permit.
Planning Department
The applicants change the oil in the trucks and store the oil in drums until it can be recycled by
NAPA or Auto Zone. Staff asked the applicants to supply the contact information of who
recycles the oil.
The applicants indicated that in addition to the commercial vehicles there are several old cars.
Staff informed the applicant that both the commercial vehicles as well as the old cars will need to
stored within an opaque fenced area.
Staff urged the applicant to contact staff for any questions:
Planner On Call (Greeley office) Monday through Thursday 7:30 to 11:30 a.m.
Planner On Call (Longmont office) Tuesday and Thursday 12:30 to 4:30 p.m.
Staff explained the USR process. The applicant shall submit 4 packets for a 7 day
completeness review. After the 7 day completeness review the applicant will be informed of
what items are still required to make the application complete. Staff requested that the applicant
submit the remaining material in electronic form. Upon submittal of a completed application it
will be sent out for referral for 28 days. The applicant will then meet with their Planner to discuss
the referrals and address as many of the referrals as possible. At that meeting the Planning
Commission hearing will be scheduled. The Board of County Commissioners hearing typically
follows approximately 3 weeks after the Planning Commission hearing.

DERELICT VEHICLE: A vehicle that is inoperable (unable to move under its own power); is
partially or totally dismantled; has all or portions of its body work missing or is substantially
damaged; does not have valid registration with the State, as required by Section 42-3-103,
42-3-138 or 42-12-102, C.R.S., and/or the number plate assigned to it is not permanently
attached to the vehicle, as required by Section 42-3-123, C.R.S.; or is lacking proper
equipment to the extent that it would be unsafe or illegal to USE on public road rights -of -way
or otherwise not equipped with lamps and other equipment, as required in Sections 42-4-202
to 42-2-227, C.R.S. This definition shall not include implements of husbandry, farm tractors or
vehicles customarily operated in a FARMING operation.
