I have lived on County Road 51 for eight years six months. All during this time, the land
North of Mr. Land's hangers has always been an agricultural field. There was an empty pond
close to the road and just down from the house located North of the entrance to his hangers.
Over the last few months, I've watched some of that field area (North of his hangers) be
torn up. A lot of dirt has been moved around, some of the large trees were pulled up, and the
empty pond was filled in. Then, I proceeded to witness the building of what appears to be an
East/West runway. There was no runway in that location previously, dirt or otherwise. I watched
the form for the runway be built and the surfacing material put in.
I am willing to testify in court for Weld County regarding this matter.

When I learned Mr. Land told the Weld County authorities that there were balls on the
power lines designating an east/west runway was already present on his land, I took photos of the
power lines on June 20 and June 21, 2008 to show where the balls are in relation to the new
runway. I followed the power lines North from where the balls are in front of the trees to the new
runway. You can see there are buildings and equipment behind the trees and not a runway.
Then, when I came home on July 18, 2008, I saw the balls had been moved from their
location in front of the trees to in front of the new east/west runway. 1 took photos again of the
trees and power lines on July 19, 2008. lam providing hard copies of some the pictures, and am
providing all the pictures on a disk in jpg format that can be viewed as a slide show. I've
captioned the date the photo was taken and a description of what the photo is of on the disk.
To insure the balls were moved and installed properly, I call United Power on Monday,
July 21, 2008 and spoke with Randy Reese of their Operations Division. He told me they did
move the balls on the power lines "per Lloyd Land's request, because he has a new runway."
Also on July 21, 2008 at 9:26 a.m., I call Scott Brownlee, an Estate Aviation Planner, to
inquire if there are any FAA regulations regarding private parties who have an airfield on their
property. Mr. Brownlee told me there is an FAA form that needs to be completed by people who
are going to construct an airfield on their property or modify an existing airfield before they start
the construction. He told me to call Marsha Hofer, who handles this area, to see if Mr. Land
completed this form.
So at 9:36 a.m., I called Marsha Hofer. I received her voice mail saying she was on
vacation until July 28, 2008. I selected to speak to another representative. I reached Linda, who
confirmed that Mr. Land would need to complete an FAA form prior to new construction, which
allows the FAA to do such things as an air space impact study. She said if he had not done that
they would ask him to complete the form. Linda could not confirm if Mr. Land completed this
form, due to her not having access to Ms. Hofer's files. Thus, Linda took my name and number to
have Ms. Hofer call me upon her return.
I also asked Linda if the FAA had any regulations parties must meet regarding a crop
dusting business. She said they just insure the pilots and aircraft are certified. Other than that, she
said it was up to local jurisdiction as to what is required of the responsible parties for the crop
dusting business. She said they do have regulations for parties who use their airfield for
commercial flight operations, i.e., carrying passengers. Other than that, they do not tell people
what they can do with their property. She said once that preliminary form is completed and the

FAA performs their analysis, they can make recommendations to the property owners, such as the
direction for take -off and landings, etc.. However, they are only recommendations.
Off the record, she said the State of Colorado's EPA may have requirements concerning
such a business, due to the chemicals involved. For my own peace of mind, I am going to contact
the Colorado EPA office so I'll know what the requirements are of such a business to ensure that
if this property is developed into a crop dusting business, they adhere to state and local laws that
apply to it.
I am submitting the photos and information to the Weld County authorities for their use,
and am willing to testify on behalf of Weld County, if the need arises.

Thank you for sending notice of Lloyd Land's proposed project of his airport and land.
When I spoke at the September 9th, 2008 hearing in regard to the Lloyd Land issue (ZC
#0800132), I was nervous and did not say everything I wanted to say. I also thought Bethany
Salzman would present the information I had provided. The point is, I think it is important for you
to have that information now, especially since Mr. Land is seeking a Use by Special Review
Permit. I will attempt to be concise and put everything in chronological order.
I first spoke with Bethany Salzman, at the Planning Department, on June 3', 2008 to ask
what was going on with Mr. Land's property. She couldn't find anything new, but said he did have
a Non -Conforming Use Permit. I told her there were major changes occurring North of the hanger
area. The changes included all the large trees being pulled up, the empty ponds being filled with
dirt, and what appeared to be a new East/West runway being built. Ms. Salzman said she'd check
things out and would get back with me. I started taking pictures of the changes.
As time went on, I observed a larger hanger being built to the East of the existing hanger he
had expanded a few years ago.
On June 20th, 2008, Ms. Salzman called to let me know Mr. Land did have a permit to
build a storage building. This storage building definitely resembles a hanger. She said only
agricultural equipment could be placed in the new building. She also said Mr. Land spoke with
her on Tuesday saying he just paved an existing dirt runway that he had not put in a new runway.
He also told her there were red balls on the power lines signifying its placement. I told her that
was a lie. The red balls on the power lines did not line up where the East/West runway had been
built, and that there had not been an East/West runway on that section of land in the eight years
I've lived here. I told her I was taking pictures of everything, including where the red balls are in
relation to the new paved East/West runway. She asked me if I'd put what I was telling her in
writing and would I testify to it in court. I told her, "Of course." Ms. Salzman instructed me to get
my statement notarized, which I did.

I've included copies of the statements I submitted to Ms. Salzman for your review. The
first statement is dated June 24, 2008. The second one is dated July 22, 2008, which I hand
delivered, on July 22', along with a disk containing the photos I took of Mr. Land's property.
Please note the statements were notarized. My copies were not. I trust my notarized statements and
the photo disk are still on file in the Planning office.
I would appreciate you reading both statements, paying special attention to the July 22n'
statement. It goes into detail about the removal and reinstallation of the red balls, as well as what I
found out about private runways from the FAA. I am including a fax, dated July 28, 2008, that I
sent to Ms. Salzman in regard to my conversation with Marsha Hofer of the FAA. I still do not
know if Mr. Land completed the required Form 7460-1. Ms. Hofer said the county would get a
copy of the form if Mr. Land completed it. Do you have a Form 7460-1 on file for his new paved
East/West runway?
Also, please take note of the fax, dated August 21, 2008. This was my last fax to Ms.
Salzman before the September hearing. Mr. Land commented on it during the hearing. He
implicated my "complaint" about the lights was the reason for the violation hearing. This is not
true.
Even though the Commissioners did not find Mr. Land in violation at the September
hearing, and just because he took their suggestion that he "apply for a Use by Special Review
Permit, so neighbors who are watching the property will not be a problem," Mr. Land cannot be
trusted. He lied to Ms. Salzman. He lied to the Weld County Planning Department. He lied to his
neighbors. And as I stated earlier, I do not know if he is in compliance with the FAA in regard to
the completion of Form 7460-1. So, he may have lied to the FAA. A lying person cannot be trusted
to think what is best for the whole and do the right thing.
As far as I'm concerned, since he's lied so far to get what he wants, we need to watch very
carefully how Mr. Land extends, expands, and/or develops this property. If granting him a Use by
Special Review Permit allows him more freedom to do what he wants to the airport and the land
around it, without consideration to the County or the neighbors, I'm afraid of what the future holds
and what I may be living next to and having to deal with. He's already proven he only takes into
consideration those things that benefit him, and that he'll lie to get them.
Please do not grant Mr. Land this permit. Based on what I've read about Case # USR-1705
on your website, the proposal is too vague. It leaves too much room open for the possibility of
unwanted development. Even though it states "There are currently no plans for expanding the
existing level of airport activity," the possibility is present, and I'm afraid granting this permit will
prove to be in Mr. Land favor more than the residents who live here.

I have known Lloyd Land for six years and have always know trirn to be conscientious and considerate
in his dealings with others.
We have helped each other with seasonal des such as snow removal and ti igation activities.
We share some land with each other for parking g equipment and farm implements.
We have common securly interests regarding adtac:ent property.
Lloyd has meticulously kept equipment, property and bullrings neat, tidy and in good maintenance.
We try to be good neighbors wlh each other and al the other hand owners in the area.
There have been no fights over areas that have restrictions and noise has not been an issue.
