RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST RODGER AND FRANCIS STEINKE FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Rodger and Francis Steinke, VI #0400318, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of May, 2009, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Rodger Steinke, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until July 12, 2009, to allow adequate time for the property owners to remove the
business and all the equipment and supplies from the site, to bring the subject property into
compliance and for an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0400318 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Rodger and Francis Steinke to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until July 12, 2009, to allow adequate time for the
property owners to remove the commercial business to bring the subject property into compliance.

REMEDY
To bring the property into compliance all items and operations related to the business shall be removed from

RECOMMENDATION
The Department of Planning Services recommends this case be referred to the County Attorney but delay
action for 60 days to allow Mr. Steinke time to complete his new commercial building, remove all business
related items from the building, and submit a building permit application for change of use.

June 26, 2007 Jacqueline Hatch, Planner, spoke with the City of Longmont; the annexation is still in
progress.
October 30, 2008 10 -day letter to submit appropriate permits for the change of use of an agricultural
exempt building.
November 4, 2008 Mr. Steinke met with Kim Ogle, Bethany Salzman, and Peggy Gregory. He has
bought property at 14293 Longs Peak Court in Mead and is moving his business
there.

Mr. Steinke was in the office today and brought a letter from the Town of Mead
verifying he has applied for a building permit and the building should be completed
by May 15, 2009. He also submitted a letter from himself stating he is building a new
office to the new location in May, 2009.
Phone call to Mr. Steinke, his new building is not done.
Certified letter indicating the violation case is scheduled before the Board of County
Commissioners.
Mr. Steinke was in the office today. He is going to change the existing commercial
building to a personal shop and inquired about the permit process. He will submit a
permit application for the change of use. He intends to have all business removed
from the existing site by May 8, 2009, the only things remaining will be electrical
supplies that need to be stored until the new building is done. He stated 60 days
should be plenty of time.

RE: Letter Dated Oct 301h, 2008 Required Inspections for Building.

Originally in 1998 Dave Sprague said I did not need a building permit for the building, then about
a year later the electrical inspector (T. Potter) informed me that I needed to take a out a permit on the metal
building in order for him to pass the electrical work done on the service that also fed the house. I then took
out a permit to have the electrical, heat and gas inspected. That permit # is BC -9901142 dated 12/29/99 and
was finalized on 1/14/00.
It was not until 2005 that we started using the building for NLine Electric and we were allowed to
continue its use as stated in the resolution dated 1-6-05 as the violation was referred back to the Department
of Planning.
We are in the process of building a new office at 14293 Longs Peak Court, Mead, CO, We are
working towards being ready to move into by May 2009 at that time NLine will no longer do business out
of the building at 12922 WCR 1.
So if you would bear with me for that amount of time I would appreciate it.

N -Line Electric has applied for a building permit for a new 6,100 square foot building
within the Town of Mead designed to house their operations. The building permit has
been reviewed by the Town's building inspection service and is available to be picked up
at Town Hall. It is anticipated that the building will be completed and ready for
occupancy by May 15, 2009.

It has come to the attention of the Department of Building Inspection that N Line Electric is operating a
commercial business in the "agricultural exempt building" on your property. On December 1, 1999, you were
issued permit number COC-990149 and the Certificate of Compliance form you signed states:
"AGRICULTURAL EXEMPT BUILDINGS are those buildings or structures on agricultural -zoned property used
for the sole purpose of providing shelter for agricultural implements, farm products, livestock, or poultry.
SHOULD THE BUILDING STATUS CHANGE FROM AN AGRICULTURAL EXEMPT STATUS, THE
PROPERTY OWNER WILL BE RESPONSIBLE FOR THE COST ASSOCIATED WITH SECURING THE
APPROPRIATE BUILDING PERMITS AND INSPECTIONS REQUIRED FOR THE EXISTING
STRUCTURE."
The current use of the building is in violation of Section 29-3-320 of the Weld County Code. Failure to submit
the appropriate building permit and all applicable documentation within 10 days from the date of this letter will
result in a violation notice and is subject to go before the Board of County Commissioners with written notice.

RE: Notice of Inquiry for Rodger and Francis Steinke
Dear Jacqueline:
The City of Longmont has received a Notice of Inquiry form for the Rodger and Francis Steinke
property at 12922 WCR1, This 2 acret parcel is on the east side of WCR1 at the intersection
with 17th Avenue. The Steinke's intend to submit an application to Weld County for a Use by
Special Review permit for a home -based electrical business with 8 employees. A conversation
with Mr. Steinke revealed that he does not intend to either expand any existing buildings or
parking areas. According to Nix, Steinke, the only improvements planned are interior
remodeling.
Weld County's Notice of Inquiry form asks whether the City of Longmont wants this site to
develop within the City. Dale Bruns has indicated that the Steinke property will be part of an
upcoming annexation referral request to the Longmont City Council (also including the Adrian,
Bogott, and Willis properties).
The Steinke's intent to operate a home -based electrical business with 8 employees will not
trigger a City of Longmont request for annexation at this time. Consequently, the City
respectfully requests that Weld County process the application for a Use by Special Review
permit, and that when the City receives that particular referral, we will comment on its substance
at that time. Also, since our understanding is that the Steinke property will be part of a larger
request for annexation that includes several properties on the east side of Weld County Road 1,
the City will consider the annexation of this property as part of that larger annexation request.

The potential noncompliance of the Weld County Code is an electrical contracting business operating in a
building originally permitted under permit number COC-990149 as an agricultural exempt building. You may
speak to one of our On -Call Planners to determine if you are eligible for a Use by Special Review. They are
available at the Southwest Weld Office on Tuesdays and Thursdays from 8:00 a.m. to 12:30 p.m. and 1:30
p.m. to 4:00 p.m. At the Greeley office, a Planner is available on Mondays and Wednesdays from 8:00 a.m. to
4:00 p.m. and Fridays from 12:30 p.m. to 4:00 p.m. You do not need to call for an appointment as individuals
are seen n a sign -in basis. To better serve you, please bring this letter with you.
It is the intention of this office to assist and cooperate with you without imposing undue hardships; however,
we have no discretion in this matter if you fail to correct this violation. You have 30 (thirty) days from October
28, 2004, to correct this building violation. Failure to do so will result in this office scheduling the violation
before the Board of County Commissioners to consider whether to refer the violation to the County Attorney's
Office for legal action.
