RE: APPROVE AMENDED BYLAWS FOR WELD COUNTY BOARD OF PUBLIC HEALTH
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on October 4, 1976, the Board adopted the Bylaws for the Weld County Board
of Public Health, and
WHEREAS, the Board has been presented with Amended Bylaws for the Weld County
Board of Public Health, and
WHEREAS, after review, the Board deems it advisable to amend said Bylaws, a copy of
which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Bylaws for the Weld County Board of Public Health be, and hereby are,
approved, as amended.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to
sign said Bylaws.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 7th day of December, A.D., 2009.

WELD COUNTY BOARD OF PUBLIC HEALTH
BYLAWS
I. Organization of Weld County Board of Public Health.
A. Membership. The Weld County Board of Public Health shall consist of nine (9)
persons appointed by the Board of County Commissioners. Six (6) members shall be from
geographic areas determined by the Board of County Commissioners, three (3) members shall be
appointed from the County at large. The geographic boundaries of the six areas may be adjusted
from time to time by the Board of County Commissioners.
B. Term of Office. The term of office of members of the Weld County Board of
Public Health shall be for three (3) years. Terms of members are to be staggered so that two (2)
members from geographic areas and one (1) member at large are appointed each year.
C. Selection of Officers. The Weld County Board of Public Health, at its first
meeting after the annual appointment of members by the Board of County Commissioners, shall
elect from among its members a chairman, vice-chairman and such other officers as it shall
determine.
D. Committees. The Weld County Board of Public Health may provide, from time
to time, for the appointment of such standing and special committees as are necessary to
discharge its responsibilities for the public health of Weld County. Such committees may be
established and their membership appointed from among the members of the Board of Public
Health by a vote of the majority of the members present and voting.
E. Meetings and Attendance Requirements. At its first meeting after the annual
appointments of members by the Board of County Commissioners, the Weld County Board of
Public Health shall adopt a schedule of meetings and attendance requirements for Board
members. In any case, the meetings shall be held at least once a month. A Board member who
misses three (3) consecutive regularly scheduled meetings without justifiable excuse, as
determined by the Board, shall be invited to show why the Board member should not be
removed. If the Board member fails to show cause to the Board why he should not be removed,
the Board of Public Health shall recommend his removal to the Board of County Commissioners.
If a Board member is removed, the vacancy shall be filled in the same manner as full term
appointments by the appointment of a qualified person by the Board of County Commissioners
for the unexpired term. 2009-3159

The Director of Public Health and the Chairman of the Board of Public Health may call
special meetings of the Board whenever Board action is necessary before a regularly scheduled
meeting can be held. A special meeting may be called by the Director of Public Health or by
the Chairman of the Board of Public Health in order to carry out any of the purposes and duties
of the Board listed in Section II of these By-laws.
F. Minutes. A record shall be kept of all Board of Public Health meetings. Such
records shall consist of minutes of all Board deliberations and decisions.
G. Quorum. A quorum shall consist of five (5) members of the Board of Public
Health.
H. Consent Agenda. The purpose of the Consent Agenda is to deal with those cases
for which no public hearing is necessary because the Board is willing to accept the staff
recommendation as its own, there is no relevant oral public testimony, and the applicant indicates
a willingness to accept the recommendations of staff. Staff will place those items on the consent
agenda that they believe will meet the above criteria for eligibility, but placement on the consent
agenda shall not lessen any notice or posting requirements of the Weld County Code.
Consideration of the consent agenda shall include a determination if any member of the public is
seeking to provide relevant testimony regarding the application. Any item may be removed
from the consent agenda and placed on the regular agenda upon the concurrence of at least 2
members of the Board present and eligible to vote on the matter.
I. Robert's Rules of Order. All matters not governed by these Bylaws shall be
governed by the current edition of Robert's Rules of Order Newly Revised.
J. Amendment of Bylaws. These Bylaws may be amended at any time by a vote of
two-thirds (2/3) of the members of the Board, and must be approved by the Board of County
Commissioner of Weld County prior to becoming effective.
II. Purposes and Duties of the Weld County Board of Public Health. The Weld County,
Board of Public Health shall:
A. Recommend general policies to be followed by the Director of Public Health in
administering and enforcing the Public Health laws of the State of Colorado, the orders, rules
and regulations of the Board of County Commissioners relating to health matters, and the orders,
rules, regulations and standards of the State Board of Health.

B. Act in an advisory capacity to the Director of Public Health on all matters
pertaining to public health in Weld County.
C. Recommend to the Board of County Commissioners the adoption of such rules
and regulations which the Board of Public Health may deem necessary for the proper exercise of
the powers and duties vested in, or imposed upon, the Department of Health Services by the
Weld County Home Rule Charter, the laws of the State of Colorado, and the orders, rules,
regulations and standards of the State Board of Health.
D. Study County Health programs and direct their implementation in cooperation
with the Director of Public Health and the Board of County Commissioners.
E. Carry out such other functions as directed by the laws of the State of Colorado,
not inconsistent with the provisions of the Weld County Home Rule Charter.
