RE: ACTION OF THE BOARD OF COMMISSIONERS REGARDING VIOLATION
ZCV #0900138 AGAINST VARRA COMPANIES, INC., FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Varra Companies, Inc., ZCV #0900138, is allegedly in violation of the Weld
County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of July, 2009, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Chris and Garrett Varra, property owners, and Brad Janes, representative,
were present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to dismiss said
violation against Varra Companies, Inc., with the understanding that the property owners continue
to work with the Department of Planning Services on submitting a Use by Special Review Permit
application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0900138 against Varra Companies, Inc., be, and hereby is,
dismissed.

REMEDY
Jacqueline has advised me that a Recorded Exemption (RE) application was again submitted; however,
she has advised me that the deeds still have not been corrected. Also, just to clarify this office is
anticipating the RE application and the Use by Special Review (USR) application to be submitted at the
same time. These applications will be processed concurrently. After further research I did discover that a
Pre -Application meeting was held on February 25, 2008 (PA08-017). An initial 7 Day Completeness review
was completed by staff. Their review of the application determined multiple pieces of information were
lacking the necessary detail as required by the Use by Special Review application. Therefore, another 7
Day Completeness Review is required as delineated in a letter from Jacqueline Hatch dated December 3,
2008. For questions, please contact one of our On -Call Planners.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's Office
for immediate legal action.

Upon a visual inspection of the property, the following items
were noted: there are still several semi trailers, pieces of
commercial equipment. No pictures were taken during this
inspection.
Tom Ripp (Attorney) called regarding Varra. He said he
was in charge of getting all the properties under the same
ownership name. I told him I understood, but how are they
coming on the USR application. He said he wasn"t sure,
but he would check into it. I told him that I expected them
to have the USR application put together and then as soon
as the title were corrected they could submit the USR
application. He said he would check into it and be in touch.
06/22/2009 Property Inspected Upon a visual inspection of the property, the following items
were noted: there are still multiple pieces of commercial
eqiupment, semi trailers, etc on the property. The shop is
still being used. No pictures were taken during this
inspection.

The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, this review is not an application.

Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. Pre -Application reviews are held Thursday and Friday of any given week in the Greeley office.
