HomeMy WebLinkAbout20092571.tiffRESOLUTION RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR AMENDED SITE PLAN REVIEW, AMSPR #290 - REALTY INCOME CORPORATION, K AND C RV CENTERS, DBA CAMPING WORLD RV SUPERCENTER, AND CWI, DBA CAMPING WORLD, INC., C/O BRENT MOODY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated September 13, 2007, the Department of Planning Services approved the application for Realty Income Corporation, do Brent Moody, 250 Parkway Drive, Suite 270, Lincolnshire, Illinois 60069, for a 5,000 -square -foot retail sales area in addition to an R.V. Maintenance and Service Center (Camping World) on the following described real estate, to wit: Lot 14, Block 1 of Amended Rademacher Business Park PUD; being part of the NW1/4 of Section 23, Township 3 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on February 4, 2009, the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Realty Income Corporation, K and C RV Centers, LLC, dba Camping World RV Supercenter, and CWI, dba Camping World, Inc., with terms and conditions being as stated in said agreement, and accepted check #731297 from National Supply Company, dba Camping World, in the amount of $3,378.00, and WHEREAS, staff from the Weld County Departments of Planning Services and Public Works have conducted a visual inspection and recommend release of said collateral. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that check #731297 from National Supply Company, dba Camping World, in the amount of $3,378.00 be, and hereby is, canceled and released. Weld County presently is holding the following amount of monies associated with the Amended Site Plan Review. Realty Income Corporation, K & C RV Centers, dba Camping World RV Supercenter and CWI, dba Camping World, Inc. (2009-0295 PL0295) AmSPR #290 Imps Agrmt. Check received from National Supply Co. dba Camping World #731297, Deposited 02/04/09 $3,378.00 Representatives for the Department of Public Works and Planning Services performed a site investigation to determine if all improvements had been installed, maintained and were without material defect for Amended Site Plan Review 290. Per the site visit on September 15, 2009, for Amended Site Plan Review No. 290, it appears all transportation related items are acceptable to Public Works, and all of the non -transportation related items are acceptable to Planning Services. Leonard and Rice Engineers sent a stamped, signed and dated as -built survey received by Public Works on July 29, 2009 of the regraded pond and it appears to have more volume capacity than the required 57,208 ft^3 volume. Continued maintenance of the inlet protection will be required until the seed germinates and the vegetation is established.
