RE: APPROVAL OF RECORDED EXEMPTION #4924 - GREG AND PATTY REEVES
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the
Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as
Recorded Exemption #4924, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land," and
WHEREAS, the request for Recorded Exemption #4924 was submitted by Greg and Patty
Reeves, 1727 41st Street NE, Anamoose, North Dakota 58710, c/o Nunn Telephone Company,
Attn: Greg Grablander, P.O. Box 249, Nunn, Colorado 80628, for property which is located in part on
the following described real estate, to -wit:
Lot C of Recorded Exemption #2211; located in part
of the W1/2W1/2 of Section 17, Township 9 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
being more particularly described in the plat which shall be provided by the applicant and known as
Exhibit "A," said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
133.67 acres and 0.134 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from the
definition of the terms, "subdivision" and "subdivided land."
BE IT FURTHER RESOLVED by the Board that the application of Greg and Patty Reeves,
c/o Greg Grablander, for Recorded Exemption #4924 be, and hereby is, approved subject to the
following conditions:
1. A Weld County septic permit is required for any proposed home. The septic system
shall be installed according to the Weld County Individual Sewage Disposal System
(I.S.D.S.) Regulations.
2. The applicant has proposed a well as the source of adequate water for Lot B.
Property owners are advised that the quantity of water available for usage may be
limited to specific uses, i.e., "Domestic Use Only," etcetera. Because each situation
is unique, the Department of Planning Services encourages property owners to
contact the Office of the State Engineer, Division of Water Resources, (1313
Sherman Street, Room 818, Denver, Colorado 80203, Phone 303-866-3581), to
discuss each individual situation.

3. The West Greeley Soil Conservation District has provided information regarding the
soils on the site. The applicant shall review the information and use it to positively
manage on -site soils.
4. Prior to recording the plat:
A. The plat shall be titled: Recorded Exemption No. 0453-17-3 RE -4924.
B. Lot A shall be granted one access, as no additional accesses shall be
granted.
Lot B shall be granted one access (onto County Road 104 or County Road
15), as no additional accesses shall be granted. In the event a shared
access off of County Road 104 is proposed, a 30 -foot -wide joint access and
utility easement, extending across Lot A from County Road 104, for the
benefit of Lot B, shall be clearly shown on the plat. The joint easement shall
be dedicated for the use as shown using the language set forth in the Weld
County Code, Appendix 24-F.2. The easement shall be graded and drained
to provide all-weather access.
D. All approved accesses shall be clearly shown on the plat. The applicant shall
contact the Weld County Department of Public Works to determine if a
culvert is necessary at any approved road access. If a drainage culvert is
required, a 15 -inch Corrugated Metal Pipe (CMP) is Weld County's minimum
size. If the applicant chooses to place a larger culvert, they shall contact the
Weld County Department of Public Works to adequately size the culvert.
E. County Road 104 is designated on the Weld County Road Classification
Plan as a local gravel road, which requires 60 feet of right-of-way at full
buildout. The applicant shall verify the existing right-of-way and the
documents creating the right-of-way. All setbacks shall be measured from
the edge of future right-of-way. If the right-of-way cannot be verified, it shall
be dedicated. This road is maintained by Weld County.
F. County Road 15 is designated on the Weld County Road Classification Plan
as a Section line road, which requires 60 feet of right-of-way at full buildout.
All setbacks shall be measured from the edge of future right-of-way. The
applicant shall verify the existing right-of-way and the documents creating the
right-of-way. If the right-of-way cannot be verified, it shall be dedicated. This
road is not maintained by Weld County.
County Road 106 is designated on the Weld County Road Classification
Plan as a Section line road, which requires 60 feet of right-of-way at fill
buildout. The applicant shall verify the existing right-of-way and documents
creating the right-of-way. If the right-of-way cannot be verified, it shall be
dedicated. This road is not maintained by Weld County.

H. The applicant shall address the requirements of the Weld County
Department of Public Works, as stated in the referral response dated
May 18, 2009. Evidence of such shall be submitted, in writing, to the Weld
County Department of Planning Services.
The applicant shall provide the Weld County Department of Planning
Services with a Statement of Taxes from the Weld County Treasurer
showing no delinquent taxes exist for the original parcel.
J. The following notes shall be placed on the plat:
1) All proposed or existing structures will meet the minimum setback
and offset requirements for the Zone District in which the property is
located. Pursuant to the definition of setback in the Weld County
Code, the required setback is measured from the future right-of-way
line. No building or structure, as defined and limited to those
occupancies listed as Groups A, B, E, F,H, I, M, and R in Section
302.1 of the 2006 International Building Code, shall be constructed
within a 200 -foot radius of any tank battery, or within a 150 -foot
radius of any wellhead. Any construction within a 200 -foot radius of
any tank battery, or 150 -foot radius of any wellhead, shall require a
variance from the terms of Section 23-3-10 of the Weld County Code.
2) Any future structures or uses on the site must obtain the appropriate
zoning and building permits.
3) Lot A is not eligible for a future land exemption, in accordance with
Section 24-8-20.C.1 of the Weld County Code.
4) Lot A is to be utilized as an unmanned equipment building site, and
shall not be a buildable lot for residential purposes.
5) Prior to the release of building permits, the applicant shall submit a
recorded Deed describing the lot upon which the building permit is
requested with the building permit applications. The legal description
on such Deed shall include the lot designation and Recorded
Exemption number.
6) Prior to the release of building permits, the applicant shall submit
evidence to the Department of Planning Services that Lot B has an
adequate water supply of sufficient quality, quantity, and
dependability.
7) If Lot B becomes a home site (or other non-agricultural use), and
access is proposed off of County Road 15, a Non-exclusive License
Agreement for the Upgrade and Maintenance of Weld County Right-
of-way shall be required.

8) Prior to the release of building permit, the applicant shall submit
evidence of approval from the Nunn Fire Protection District to the
Weld County Department of Building Inspection.
9) Potential purchasers shall be made aware that groundwater may not
meet all drinking water standards, as defined by the Colorado
Department of Public Health and Environment. The Weld County
Department of Public Health and Environment strongly encourages
well users to test the drinking water prior to consumption, and
periodically thereafter.
10) Potential purchasers shall be made aware that approval of this
Recorded Exemption does not guarantee that well permits will be
issued for the lots. Any lot may be deemed non -buildable if the lot
owner is unable to obtain a well permit. The Colorado Division of
Water Resources issues all well permits.
11) Should noxious weeds exist on the property, or become established
as a result of the proposed development, the applicant/landowner
shall be responsible for controlling the noxious weeds, pursuant to
Section 15-1-40 of the Weld County Code.
12) Recorded Exemptions on adjacent properties may raise the issue of
compliance with the intent of the Recorded Exemption process.
Approval of this Recorded Exemption does not guarantee approval of
future applications on adjacent properties.
13) Building permits shall be obtained prior to the construction of any
building. Buildings that meet the definition of an Agricultural Exempt
Building, per the requirements of Sections 29-1-20 and 29-3-20.B.13
of the Weld County Code, do not need building permits; however, a
Certificate of Compliance must be filed with the Department of
Planning Services and an electrical and/or plumbing permit is
required for any electrical service to the building or water for watering
or washing of livestock or poultry.
14) Effective January 1, 2003, building permits issued on the proposed
lots will be required to adhere to the fee structure of the County -Wide
Road Impact Fee Program.
15) Effective August 1, 2005, building permits issued on the subject site
will be required to adhere to the fee structure of the Capital
Expansion Impact Fee and the Stormwater/Drainage Impact Fee
Programs.
16) The Weld County Right to Farm Statement, as it appears in Section
22-2-20.J.2 of the Weld County Code, shall be placed on the plat.

5. The applicant shall submit three (3) paper copies of the plat for preliminary approval
to the Weld County Department of Planning Services. Upon approval of the paper
copies, the applicant shall submit a Mylar plat, along with all other documentation
required as Conditions of Approval. The Mylar plat shall be recorded in the office of
the Weld County Clerk and Recorder by the Department of Planning Services. The
plat shall be prepared in accordance with the requirements of Section 24-8-60 of the
Weld County Code. The Mylar plat and additional requirements shall be submitted
within sixty (60) days from the date of the Board of County Commissioners
Resolution. The applicant shall be responsible for paying the recording fee.
6. In accordance with Weld County Code Ordinance #2005-7, approved June 1, 2005,
should the plat not be recorded within the required sixty (60) days from the date of
the Board of County Commissioners Resolution approving this Recorded Exemption,
a $50.00 recording continuance charge may be added for each additional three (3)
month period.
7. The Department of Planning Services respectfully requests the surveyor provide a
digital copy of this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf,
and .dgn (Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo
Coverages and Arclnfo Export files format type is .e00. The preferred format for
Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be sent to
mapsco.weld.co.us.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by

The Department of Planning Services has forwarded application RE -4924 to the Board of
County Commissioners. The applicant is requesting that Lot A of RE -4924 be approved at less
than 2.5 net acres (for a lot with well and individual septic system) as required per Section 24-8-
40.L of the Weld County Code.

Weld County Code Requirement: Section 24-8-40.L of the Weld County Code states: "The
minimum size of any lot proposed with a public water supply is not less than one (1) acre net.
The minimum size of any lot proposed with a well as the water supply is not less than two and
one-half (2%) acres net. Minimum lot sizes do not apply in zone districts which allow smaller lots
or where exempted by the Board of County Commissioners. The minimum lot size does not
apply to subdivision exemption lots created for the temporary use of a parcel for public utility
facilities."
Applicant Request: The applicant is requesting that the above requirement be waived for
Recorded Exemption 4924. The minimum lot size is 2 1/2 acres (for lots on individual wells)
because public water is not available in this area. The applicant is requesting that the 21/2 net
acre requirement be waived because they are proposing to place an unmanned equipment
building on Lot A for Nunn Telephone. The applicant is proposing that Lot A be approximately
.13 acres in size. No well or septic is proposed for this use.
Department of Planning Services Recommendation: Given the unique circumstances of this
case, staff is in support of this request. The applicant is creating a lot to be used solely for an
unmanned equipment building. No well and/or septic would be required which eliminates the
necessity of having Lot A. meet the 2 % acre requirement as outlined in Section 24-8-40.L of the
Weld County Code.
The Department of Planning Services has proposed a development standard (note #4)
addressing the use of Lot A site. Note #4 states:
"Lot A is to be utilized as an unmanned equipment building site. Lot A shall not be a
buildable lot for residential purposes."

approved with the following conditions in accordance with information submitted in the application and the

to adhere to the fee structure of the Capital Expansion Impact Fee and the

16) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, typically ranking in the top ten counties in
the country in total market value of agricultural products sold. The rural areas of
Weld County may be open and spacious, but they are intensively used for
agriculture. Persons moving into a rural area must recognize and accept there are
drawbacks, including conflicts with long-standing agricultural practices and a lower
level of services than in town. Along with the drawbacks come the incentives which
attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife,
lack of city noise and congestion, and the rural atmosphere and way of life. Without
neighboring farms, those features which attract urban dwellers to rural Weld County
would quickly be gone forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well -run agricultural activities will generate off -site impacts, including noise from
tractors and equipment; slow -moving farm vehicles on rural roads; dust from animal
pens, field work, harvest and gravel roads; odor from animal confinement, silage and
manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping
activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides
and fertilizers in the fields, including the use of aerial spraying. It is common practice
for agricultural producers to utilize an accumulation of agricultural machinery and
supplies to assist in their agricultural operations. A concentration of miscellaneous
agricultural materials often produces a visual disparity between rural and urban areas
of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation
shall not be found to be a public or private nuisance if the agricultural operation
alleged to be a nuisance employs methods or practices that are commonly or
reasonably associated with agricultural production.
Water has been, and continues to be, the lifeline for the agricultural community. It is
unrealistic to assume that ditches and reservoirs may simply be moved "out of the
way" of residential development. When moving to the County, property owners and
residents must realize they cannot take water from irrigation ditches, lakes, or other
structures, unless they have an adjudicated right to the water.
Weld County covers a land area of approximately four thousand (4,000) square miles
in size (twice the size of the State of Delaware) with more than three thousand seven
hundred (3,700) miles of state and County roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement
is based on responses to complaints more than on patrols of the County, and the
distances which must be traveled may delay all emergency responses, including law
enforcement, ambulance, and fire. Fire protection is usually provided by volunteers
who must leave their jobs and families to respond to emergencies. County gravel
roads, no matter how often they are bladed, will not provide the same kind of surface
expected from a paved road. Snow removal priorities mean that roads from
subdivisions to arterials may not be cleared for several days after a major snowstorm.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
People are exposed to different hazards in the County than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches,
electrical power for pumps and center pivot operations, high speed traffic, sand burs,
puncture vines, territorial farm dogs and livestock, and open burning present real
threats. Controlling children's activities is important, not only for their safety, but also
for the protection of the farmer's livelihood.
5. The applicant shall submit three (3) paper copies of the plat for preliminary approval to the Weld

6. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat
not be recorded within the required sixty (60) days from the date the Board of County
Commissioner's resolution approving this recorded exemption was signed a $50.00 recording
continuance charge may be added for each additional 3 month period.
7. The Department of Planning Services respectfully requests the surveyor provide a digital copy of
this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation);
acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format

Dear Patty,
Here is my response to your questions you sent me yesterday,
Groups A, B, E, F, H, I, M and R are building code classifications for buildings. These
setbacks refer to oil field tank batteries and wellheads.
6. No. This note specifically applies to Lot B (since it is a buildable lot for
residential purposes). Lot A will be an unmanned facility and is too small to be a
residential lot.
7. An all-weather surface roadway would be required if you propose to access off of County
Road 15. However, this would not be required if the Lot B access is off of County Road 104
(see condition 4.C).
Here is some information re: the non-exclusive license agreement:
The applicant shall complete a Nonexclusive License Agreement for the upgrade and
maintenance of County Road 15 right-of-way. There is a $150 fee for the fabrication and
installation of blue and white cross road signs identifying the section line road
intersection for the use of addressing and emergency response. The blue and white signs
identify a non -maintained County right-of-way. Distance and location from the nearest
county road may require additional information signs. The fee for the sign designating
the access as a non -maintained county right-of-way shall be paid to the Department of
Public Works and the sign shall be installed prior to recording the plat. If existing
signs are in place, the fee and installation may be waived by the Department of Public
Works. Evidence of such shall be submitted to the Department of Planning Services.
The non-exclusive license agreement is application process is under the Weld County
Department of Works. If you have any further questions on specifics of the application and
process I would recommend that you contact Don Carroll at the Department of Public Works
(the office # is (970)304-6496.) or dcarroll@co.weld.co.us.
8. This applies to any buildings/structures that require a building permit in Weld County.
I would contact Robert Powell (our building plans examiner) at (970)353-6100 ext. 3575 or
rpowell@co.weld.co.us if you have any specific questions about this.
12. This note is simply a notification, it applies to situations where an applicant owns
contiguous property adjacent to the recorded exemption that is being applied for. It is
meant to address situations where a property owner applies for multiple recorded
exemptions on properties directly contiguous/adjacent to each other. Some of these
instances (relatively few) have raised concerns re: # of access points/impacts to county
roads based on the # of access points being created onto county roads and staff has
recommended denial of these recorded exemptions because staff made the determination that
the subdivision or Planned Unit Development process was more a more appropriate process to
address potential impacts. However, the ultimate decision to approve or deny a recorded
exemption in these instances would be up to the Board of County Commissioners. Please keep
in mind that this note only states future recorded exemptions "may" raise the issue of
compliance, not "will".
Easement dedication - this language applies if Lot B is to share an access with Lot A onto
County Road 104. An access easement would be shown on the plat for Both Lot A and Lot B of
this recorded exemption (see item 4.C).
As to your last question/comment in regards to the recorded exemption block: I looked at

the paper copy of the plat tat I have, it shows the site be: d adjacent to County Road 15
and located in Section 17. Unless I am missing something or there was a change when the
mylar was prepared.
I apologize if there was any miscommunication re: the hearing date for your recorded
exemption. I was coordinating with Nunn Telephone re: the date and time of the hearing.

I have reviewed the mylar prepared for RE -4942. As neither Greg nor I was informed of the
date and time of the meeting, this is the first time I have been able to review the final
notes.
Please help me to understand some items that are unclear to me. Under the notes:
*) What are Groups A B E F H I M R and what does Section 302.1 refer to? Does this note
refer to Oil field tank batteries and well heads? The note is not clear what kind of tank
batteries or well heads this refers to.
6. Does Lot A have to provide evidence of water supply on Lot B prior to release of
building permits for Lot A (which is what this seems to say).
7. Does this mean that we will have to build a road? What is this road agreement.
8. What kind of approval from Nunn Fire Department is needed? Approval for what?
12. What does this mean?
Why, under the "Property Owners' Certificate" does it say we dedicate "easements"?
In the 'Recorded Exemption' block it describes the RE -4924 as located on the corner of
WCR 17, while it is really located on WCR 15. In addition, the RE is located in Section
17, Township 9 North, Range 67 West; not as indicated on the plat.
Ron Bycroft was supposed to notify Greg of the date of the hearing, so he could attend and
be aware of the standards imposed by the Commissioners. Mr. Bycroft failed to notify and
keep Greg informed, to enable our attendance and input on this matter.

The Weld County Public Works Department has reviewed this proposal. Staff comments made during this
phase of the process may not be all-inclusive, as other concerns or issues may arise during the remaining
application process. Issues of concern must be resolved with the Public Works Department. Our comments
and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002) WCR 104 is a local gravel road and requires a
60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by
Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required
setback is measured from the future right-of-way line.
Section Line Access: (right-of-way) If Lot B becomes a home site and not agricultural, a Non-exclusive
License Agreement for the Upgrade and Maintenance of Weld County right-of-way shall be required.
Utilize the existing agricultural, oil and gas, and ditch roads that are necessary for your agricultural operation.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property of
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds. All other vegetation, other than grasses, need to be maintained at a maximum
height of 12 inches until the area is completely developed.
The applicant shall complete a Weld County Road Access Information Sheet.
Show both the existing and proposed access points for Lot A and Lot B on WCR 104 or section line, road 15.
Please find attached is an Access Information Sheet.
Flood Hazard Development Standards: This area is not in a Special Flood Hazard Area (SFHA) as
determined by the Federal Emergency Management Agency (FEMA).
The communication building should be located outside the right-of-way on both WCR 104 and Section Line
Road 15. The required setback is measured from the right-of-way. Both WCR 104 and section line, road 15,
have a 60 -foot right-of-way.

Environmental Health Services has reviewed this proposal to exempt 0.134 acres from
a 133.709 acre site. Proposed lot A will consist of 0.134 acres in size and proposed lot
B will consist of 133.675 acres in size. Proposed lot A will be created for the Nunn
Telephone Company. The Nunn Telephone Company is proposing a switching station
for their Fiber Optics Network. As no employees will be located at the site, permanent
water and sewer will not be required for proposed lot A. Proposed lot B is vacant and
an individual well and individual sewage disposal system will be installed when a
residence is constructed.
The following conditions are recommended to be part of any approval:
1. A Weld County Septic Permit is required for the proposed home septic system(s)
and shall be installed according to the Weld County Individual Sewage Disposal
Regulations. Please note, the lot owners shall verify with the nearest Town/City
or Sanitation District to determine the location of the nearest sewer line. In
accordance with the Weld County Code, if a sewer line exists within 400 feet of
the property and the sewer provider is willing to serve the proposed structure, a
septic permit cannot be granted by the Weld County Department of Public Health
and Environment.
Additionally, please note the following:
1. This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. domestic use only, etc.
Also, the applicant should be made aware that groundwater may not meet all
drinking water standards as defined by the Colorado Department of Public
Health and Environment. We strongly encourage the applicant to test their
drinking water prior to consumption and periodically test it over time.

We have reviewed the above referenced proposal for a two -lot recorded exemption. This proposal is to create
Lot A being 0.134 acres and Lot B being 133.67 acres. Lot A is to be used by the Nunn Telephone Company as a
switching station for their fiber optics network. Lot B is currently vacant with no structures and is to be made available
for possible future dry land agriculture or future subdivision. The submitted material does not appear to qualify as a
"subdivision" as defined in Section 30-28-101(10)(a) C.R.S. Therefore, pursuant to the State Engineer's March 4,
2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information
and provide comments. The comments will not address the adequacy of the water supply plan for this development or
the ability of the water supply plan to satisfy any County regulations or requirements.
The applicant has not submitted a Water Supply Information Summary Sheet. However, the information
provided indicates that Lot A will not have any water requirements and that Lot B will utilize a well. A cursory review by
this office does not indicate that any well permits have been issued on this parcel.
The State Engineer's Office does not object to approval of a two -lot recorded exemption. If approved as a
recorded exemption by the County, the State Engineer's Office may issue one exempt well permit for Lot A and one
exempt well permit for each 35 acre area in Lot B. Since Lot A is less than 35 acres, this lot may qualify for one
exempt well permit for the inside uses of one single-family dwelling with no outside uses allowed, or drinking and
sanitary purposes inside a commercial business . Since Lot B is greater than 35 acres, this lot may be entitled to
exempt well permits for each 35 acre area for fire protection, ordinary household purposes inside not more than three
single family dwellings, the irrigation of not more than one acre of home gardens and lawns, and the watering of
domestic animals/livestock. Note that we cannot guarantee that well permits will be issued until an application is
submitted and we have completed our evaluation of the application.

We have reviewed the above referenced proposal for a two -lot recorded exemption. This proposal is to create
Lot A being 0.129 acres and Lot B being 80.099 acres. Lot A is to be used by the Nunn Telephone Company as a
switching station for their fiber optics network. Lot B is a dry land farm with existing main residence, a detached
garage, a pole barn, and a barn. The submitted material does not appear to qualify as a "subdivision" as defined in
Section 30-28-101(10)(a) C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county
planning directors, this office will only perform a cursory review of the referral information and provide comments. The
comments will not address the adequacy of the water supply plan for this development or the ability of the water supply
plan to satisfy any County regulations or requirements.
The applicant has not submitted a Water Supply Information Summary Sheet. However, the information
provided indicates that Lot A will not have any water requirements and that Lot B will utilize two domestic wells. A
cursory review by this office indicates that permit no. 241561 was issued for a 40 -acre area on the proposed Lot B.
However, the permit file is not complete as a pump installation report was received timely, but the well construction log
was never received by this office.
The State Engineer's Office does not object to approval of a two -lot recorded exemption. If approved as a
recorded exemption by the County, the State Engineer's Office may issue one exempt well permit for Lot A and up to
two exempt well permits in Lot B. Since Lot A is less than 35 acres, this lot may qualify for one exempt well permit for
the inside uses of one single-family dwelling with no outside uses allowed, or drinking and sanitary purposes inside a
commercial business. Since Lot B is greater than 35 acres, this lot may be entitled to exempt well permits for each 35
acre area for fire protection, ordinary household purposes inside not more than three single family dwellings, the
irrigation of not more than one acre of home gardens and lawns, and the watering of domestic animals/livestock.
Permit no. 241561 was issued as the only well on 40 acres described as the NE %4 of the NW '/ of Section 28. Any
additional permits on Lot B must be located on lands not encumbered by permit no. 241561. Note that we cannot
guarantee that well permits.will be issued until an application is submitted and we have completed our evaluation of
the application. Also, the owner of permit no. 241561 should submit the well construction log for permit no. 241561 to
complete the well permit file.
