WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner for expansion of an existing hog farm operation on the above described premises, and WHEREAS, the said requested expansion of an existing hog farm operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3) (c) of the Zoning Resolution of Weld County, said hog farm operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Weld County Planning Commission, by Resolution, has recommended that expansion of this hog farm operation be approved, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Walter Danielson, Route 2, Box 1, Eaton, Colorado, for expansion of an existing hog farm operation on the pre- mises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to construct ex- pansion of said hog farm operation and shall have up to one year from date hereof to begin construction of same; otherwise, the Board may, for good G 760441 . cause shown, on its own motion, revoke the permit herein granted. 3. That petitioner shall obtain building permits prior to any con- struction. 4. That when expansion of said hog farm operation is completed, same shall be limited in pen size as indicated on plans as submitted. 5. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolution of Weld County, Colorado. The conducting of any livestock operations, or expanded operations creates a greater market for feed crops raised in neighborhood, with resulting economic advantage. 2. Successful livestock operations on neighboring farms increases the value of entire neighborhood 3. Petitioner Danielson has a present hog facility near where special use permit facility is to be constructed. The only irrigation lateral serving 146 Co. farm runs just east of and at a lower elevation from Petitioners present hog facility. If not otherwise controlled or impeded any run-off or clean-out water from the hog facility operation would run into the 146 Co lateral ditch and by natural gravity be intermixed with irrigation water and run onto the 146 Co farm. h. The 116 Co, its operator, aid his employees state of record they are not applicants for the CACAETUM PCRCE AWARD. Following setting of tubes, recipients ofi that award have been known to be excluded entrance to their homes by their wives. 5. The nearest 146 Co dwelling to the hog facility is approximately 1700 feet and downwind. On earlier occasions it was learned the hog facilities are within whiffing distance. 6. No objtiction would be raised to the proposed hog facility if protection can be given 116 Co. as follows;: The enlargement or change of present facilities is constructed so it is not closer to 146 Co. dwellings. b. Control mechanisms are established to assure no run-off or clean-out water from the hog facilities can get into th4 1)46 Co lateral - such could be accomplished by various means, including tiling of that portion of the 116 Co lateral ditch where it is down-grade from the hog facilities, thereby assuring the quality of the irrigation water. c. Conditions are enforeed and imposed to assure disposal of dead animals or honey wagon contents do not reach Beadle Reservoir owned by 1146 Co, and lying just to Northwest of the hog facilities, nor do sane reach the shore or general reservoir areas. Unless otherwise requested by the Petitioner or the Planning Commission, 116 Co. gill confine its remarks to this Statement of Position, and will not appear at the public hearing on the Petition.
