RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST MICHAEL GRECKEL FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Michael Greckel, ZCV #0800408, is allegedly in violation of the Weld County
Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of July, 2009, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Michael Greckel, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until September 14, 2009, to allow adequate time for the property owner to sell the
property and all the vehicles, and to move from this site to bring the subject property into
compliance and for an inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0800408 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Michael Greckel to remedy the violation of the Weld County Code,
and any other persons occupying the properties, any persons claiming an interest in the properties,
and any persons acting in active concert with the identified parties, with an instruction for delay of
action upon such referral until September 14, 2009, to allow adequate time for the property owner
to sell the property and all the vehicles, and to move from this site to bring the subject property into
compliance.

As we had discussed over the phone, the following items need to be addressed:
1.) The presence of a camper/trailer that is apparently being utilized as a dwelling unit. This is not an
allowed use within Weld County unless parked at an approved camp ground.
2.) The presence of a potential NONCOMMERCIAL JUNKYARD. Since your property is zoned
Agricultural, the presence of DERELICT VEHICLES is an allowed use, provided they are completely
SCREENED from all adjacent properties and public rights -of -ways. This means all visible vehicles
(including but not limited to all passenger vehicles, camper/trailers-RV's, etc) must maintain a current
license plate and be operational at all times; otherwise, they shall be restored or competely Screened.
3.) Lastly I noted a box which appears to be utilized possibly as a storage unit. Based upon our
discussion, it is my understanding the unit is a box off of a delivery style box vehicle, it must again be
placed on wheels and remain mobile and currently licensed or removed from the proper. Lastly since your
property is in a subdivision, Enchanged Hills, a Zoning Permit for an Accessory Structure (ZPAS) is
required.
On a separate note, during my last inspection I also noted a sign which states "Cowboy Specialists Trailer
Repair" this type of commercial operation would as well require a Use by Special Review (USR) permit of
which the first step would be a Pre -Application Request meeting. If you have questions, please feel free to
call in and speak with one of our on -call planners at 970-353-6100, Ext 3540 and ask for the planner
On -Call.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's Office
for immediate legal action.

Upon a visual inspection of the property, the following items
were noted: I noted a 2 camper/trailers. 1 appears to be
occupied. I also noted 1 Derelict Vehicle and 1 apparent
box storage unit. No pictures take during this inspection.
Mike Greckel (303-833-4889 - home or 303-517-1942 - cell)
called. He stated that he does have someone staying in a
RV. He stated that the property really does need to be
cleaned up, but right now with the snow it would be just
really difficult to do. He was hoping to have some time. I
told him that the most time I could really grant would be a
60 day time frame. He then asked about applying for a
USR for the RV. I told him the first step would be the
Pre -Application meeting. I told him that I thought he would
really have a diffult time with it since a RV is meant to be a
temporary dwelling and not a principle dwelling, but he
could attend the Pre -Application Meeting and the vaious
departments would explain all the potential "road blocks"
they could see. He said that would be great.
Upon a visual inspection of the property, the following items
were noted: I noted a sign that states
"Countryboy-Specialists Trailer Repair". I also noted 2
commercial white looking vans. I noted 2 boxes off of a
delivery style box truck. There was wood, metal and

miscellaneous debris gathered up behind it. There was a
camper/trailer (did not appear occupied). There were at
least 2 other pull along trailers (1 flat bed and 1 box) and a
truck with a pull along camper/trailer on the back of it (it did
not appear occupied). There was another camper/trailer
that was extended and appeared occupied closer to the
house. There was also an apparent derelict blue van on
the side of the garage. See pictures dated 05/27/09.

06/04/2009 Phone Call Mike and Lineal called today to discuss the letter they
received from you regarding their violations on site.
1.) 18 wheeler trailers - will permit one under zpas
2.) RV lived in - person has moved out, will remove
mudroom from it, provide evidence that it is licensed and
operational
3.) other 2 RV's are his kids - they live in Arvada and aren't
allowed to store them will provide evidence that it is
licensed and operational
4.) junk -stuff- on site - will remove or fence off from
adjacent properties and ROW
5.) business - will remove sign and stop operating business
- gave option of USR for home business
6.) misc car trailer - will provide evidence that it is licensed
and operational.
06/09/2009 Office Visit Michael Greckel and another gentleman came to the
Greeley Office. We discussed his violation case. They
indicated that the sign is down. 1 camper remains to be
removed. There are currently 2 (two) semi trailer box trucks
parked on the property. I explained that they could apply
for 1 (one) to remain through the ZPAS application. They
then brought up that they intended to eventually add a
youth ministry on this property. They wanted to run it
partially out of the camper/trailer. They also indicated they
tore down a building and re -built it (approximately 40 x 10'
in size) without a building permit. I went and got Chris
Gathman and Frank Piacentino. After discussion, they
decided to wait to apply for a USR (for the Youth Ministry)
untill they have the finances. Frank advised them that they
would need to obtain a building permit for the structure. I
helped them put together a ZPAS application. I spoke to
Wendi and we agreed to hold off on requiring the
Registration until and if the ZPAS is approved. If approved
they would purchase a current registration for the semi
trailer. They were going to relocate the camper/trailer
(currently next to the re -placed building) over by the
existing derelict camper/trailer and move the derelict van by
them and put opaque (cedar style wooden privacy) fence
around them. They were also going to see about removing
the 2nd semi trailer box truck. I told them that I would
support them requesting a delay of legal action for 60 days
from the Board.

Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation including
the action necessary to correct the violation, and that you were given sufficient time to remedy

It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have until
04/03/2009, to correct this zoning violation. Failure to do so will result in this office scheduling the
violation before the Board of County Commissioners to consider whether to refer the violation to the
County Attorney's Office for legal action.

The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, _this review is not an application.
Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. Pre -Application reviews are held Thursday and Friday of any given week in the Greeley office.
To be on the pre -submittal agenda, the request and required checklist items must be received one week prior to

ZONING PERMIT ACCESSORY STRUCTURE (ZPAS) SUBMITTAL CHECKLIST
APPLICATION REQUIREMENTS:
One original application form plus four copies
One original drawing plus four copies. A scaled drawing of the property (1"=50') needs to show the
proposed location of the accessory structure. Include distances between the property lot lines and
proposed accessory structure and all other existing structures on the property; access to the property
(indicate whether it is existing or proposed) ; County, State, or Federal road rights -of -way; amount of road
frontages; location and measurements of any easements; and any proposed structures to be located on the
property.
One original Weld County Road Access Information Sheet plus one copy
One copy of deed or legal instrument identifying applicant's interest in the property. Copy of recorded
instruments may be obtained from Weld County Clerk and Recorder's Office or a title or abstract company.
One copy of affidavit and certified list of the names, addresses and the corresponding Parcel Identification
Number assigned by the Weld County Assessor of the owners' of property (the surface estate) within 500 feet of
property being considered. This list shall be compiled from the records of the Weld County Assessor,theWeld
County Website, www.co.weld.co.us. , or a person qualified to do the task, and shall be current as of a date no
more than thirty days prior to the date the application is submitted to the Department of Planning
Services.

$37.'50 investigation fee: An additional investigation e fi? shall be adde the cost of the permit application
-when specific land, uses, building, manufactured homes, mo o s, and structures that require a
permit by the Weld County Code are -located, moved, opera d, or constructed, prior to obtaining a permit.
The investigation fee shall be.fifty percent of the fee established by separate action by the Board of County
Commissioners for 'land -use applications. The payment of such investigation fee -shall not relieve any
persons from fully complying with the requi�rnents of the Weld'County Code, nor irom any other penalties.
One each of the application and scaled drawing shall be collated into four complete application packets and
bound with binder clips or paper clips only. The original copies shall be placed in one packet (includes
additional items below if applicable). Applications bound in any other fashion than binder or paper clip will
be returned to the applicant without review. Additional required information shall be kept separate to be
collated by Planning Staff. The Department of Planning Services may request additional information,
application packets and/or fees that will aid in the review of the Zoning Permit application.

It has come to the attention of the Department of Planning Services staff that the uses on your property may
not be in compliance with the Weld County Code, Chapter 23. The potential noncompliance(s) with the
Weld County Code are as follow:
During an inspection from the road right-of-way, I noted the following apparent violations:
1.) The presence of a camper/trailer that is apparently being utilized as a dwelling unit.
This is not an allowed use within Weld County unless parked at an approved camp ground.
2.) The presence of a potential NONCOMMERCIAL JUNKYARD. Since your property is
zoned Agricultural, the presence of DERELICT VEHICLES is an allowed use, provided they
are completely SCREENED from all adjacent properties and public rights -of -ways. This
means all visible vehicles (including but not limited to all passenger vehicles,
camper/trailers-RV's, etc) must maintain a current license plate and be operational at all
times; otherwise, they shall be restored or competely Screened.
3.) Lastly I noted a box which appears to be utilized possibly as a storage unit. I was
unable to determine positively what type of unit this is. If it is a cargo container, a building
permit is necessary. If it is a box off of a delivery style box vehicle, it must again be placed
on wheels and remain mobile and currently licensed or removed from the proper.
