RESOLUTION RE: GRANT MOBILE HOME PERMIT, ZPMH #2561 - MILLER -TAYLOR FARM, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 4th day of May, 2009, considered the request of Miller -Taylor Farm, LLC, do Becky Weinkauf, 400 East Royal Lane, Suite N56, Irving, Texas 75039, for a mobile home to be used as a Temporary Accessory to the Farm, and WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Part of the NE1/4 of Section 26, Township 3 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard all of the testimony, finds that said request should be granted subject to the following conditions: 1. The applicant shall obtain an Amended Flood Hazard Development Permit (FHDP) for the mobile home, since it was placed after September 22, 1982. 2. The applicant shall submit, to the Weld County Department of Planning Services, evidence that any existing septic system meets all requirements of the Weld County Department of Public Health and Environment. The Weld County Department of Public Health and Environment was unable to locate a septic permit for the septic system, as the application was not signed by the Department and does not contain a permit number. Any existing septic system, which is currently not permitted through the Weld County Department of Public Health and Environment, will require an Individual Sewage Disposal System (I.S.D.S.) evaluation prior to the issuance of the required septic permits. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. Regulations. 3. The installation of any septic system within the 100 -year floodplain shall comply with the Weld County I.S.D.S. Floodplain Policy. In accordance with the Colorado I.S.D.S. Regulations, no septic system shall be installed within the floodway. 4. The mobile home shall not be occupied by any persons other than those permitted through the Accessory to the Farm. Failure to comply will result in revocation of the permit. 5. The applicant shall submit an Exit Plan, acknowledging that the permit shall cease to exist at any such time as the mobile home is used for other than the permitted use. Such statement shall include a detailed plan for removal of the mobile home upon expiration of the permit, or, at such time the permit is not renewed by either the (or' ; 4 .9rpoe_, /f�P 2009-1050 PL2017 Os/2,7/v9 ZPMH #2561 - MILLER -TAYLOR FARM, LLC PAGE 2 - Department of Planning Services or Board of County Commissioners, the applicant will have 30 days to enact the Exit Plan. 6. The mobile home will be occupied by persons principally employed at, or principally engaged in, the operation of the use where the mobile home is located. Accessory farm use of the mobile home shall be established and revalidated on an annual basis, as follows: The applicant/owner shall submit evidence, on the anniversary of the permit's issuance for review and acceptance by the Department of Planning Services, verifying that the mobile home occupant is principally employed, at or engaged in, the farming operation on the subject property. The evidence shall consist of tax records (W-2 forms), employment agreements, or other documentation as determined suitable by the Department of Planning Services. Failure to submit the required documentation may result in cessation of the allowance of the mobile home for Temporary Accessory to the Farm Use. 7. The mobile home will not be used as an income source by the applicant for rental to persons who are not principally employed upon the lot. 8. The applicant shall submit documentation to the Department of Planning Services, by May 1st of each year, describing the status of the Accessory to the Farm. This permit is temporary and shall terminate once the use ceases to exist, at which time the applicant shall have thirty (30) days to remove the mobile home from the property. 9. All temporary permits for mobile homes shall not be transferable by the applicant and/or owner to any successor; the zoning permit shall terminate automatically upon conveyance or lease of the property. The mobile home shall be removed from the property, or a new zoning permit shall be applied for and approved. 10. At such time the temporary status is changed to a permanent status, a new Zoning Permit shall be applied for, and approved by the Department of Planning Services, along with payment of any required fees. 11. The property is in violation of Chapter 23 of the Weld County Code (Violation #ZCV08-00104). The applicant shall schedule a final inspection with the Weld County Zoning Compliance Officer to ensure compliance of the property. 12. All proposed or existing structures will meet the minimum setback and offset requirements for the Zone District in which the property is located. Pursuant to the definition of setback in the Weld County Code, the required setback is measured from the future right-of-way line. No building or structure, as defined and limited to those occupancies listed as Groups A, B, E, F, H, I, M, and R in Section 302.1 of the 2006 International Building Code, shall be constructed within a 200 -foot radius of any tank battery or within a 150 -foot radius of any wellhead. Any construction within a 200 -foot radius of any tank battery, or 150 -foot radius of any wellhead, shall require a variance from the terms of Section 23-3-10 of the Weld County Code. 2009-1050 PL2017 ZPMH #2561 - MILLER -TAYLOR FARM, LLC PAGE 3- 13. Any future structures or uses on the site must obtain the appropriate zoning and building permits. 14. Effective January 1, 2003, building permits issued on the proposed lots will be required to adhere to the fee structure of the County -Wide Road Impact Fee Program. 15. Effective August 1, 2005, building permits issued on the proposed lots may be required to adhere to the fee structure of the Capital Expansion Fee and Stormwater/Drainage Impact Fee Programs. 16. When demolishing or removing an existing structure, specifically a mobile/modular home, the applicant shall contact the Weld County Treasurer's Office, at 970-353-3845, to ensure that the taxes have been paid and that this structure is removed from the tax roll. 17. The Colorado Department of Transportation (CDOT) has jurisdiction over the access for this property. Any future accesses shall require approval from CDOT. 18. Should noxious weeds exist on the property, or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Section 15-1-40 of the Weld County Code. 19. The applicant shall maintain compliance with Section 23-4-170 of the Weld County Code at all times. The application materials as well as a site inspection list the only production on site is approximately 60 acres of hay, with no other productive farming. It is also indicated the occupant of the mobile home utilizes the mobile home on a part time basis. There is currently a principle home on the parcel which also is utilized on a part time basis by family members. The applicant is eligible for a four lot Recorded Exemption that would make all the structures on site legal. 2009-1050 PL, oiq Should the Board approve this request, the following conditions shall apply: 1. According to the application the existing mobile home is served by an individual sewage disposal system however after researching our records there is not a septic permit on file. The statement of existing that was submitted with the application is not signed by this department and does not contain a permit number. The applicant will need to submit and pay for the statement of existing and also pay for a site evaluation of the septic system by this department. The eastern portion of the property is located in the floodplain. Water is provided by an individual well (permit 279354). Environmental Health Services has reviewed this proposal; the following condition is recommended to be part of any approval: 1. All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment. The Environmental Health Division of the Weld County Department of Public Health & Environment was unable to locate a septic permit for the septic system located at 10614 Highway 66. Any existing septic system which is not currently permitted through the Weld County Department of Public Health & Environment will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. Additionally, please note the following: 1. This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. ‘t( 2.
