HomeMy WebLinkAbout20093070.tiff161 RESOLUTION RE: APPROVE PARTIAL CANCELLATION AND RELEASE OF COLLATERAL FOR SITE PLAN REVIEW, SPR #425 - RUBY HAMMOND WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on November 26, 2008, the Department of Planning Services staff approved the application of Ruby Hammond, 2407 Corey Street, Longmont, Colorado 80501, for a tractor trailer staging yard, existing caretaker office, and proposed office trailer on the following described real estate, to wit: Part of the SE1/4 of Section 30, Township 1 North, Range 66 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on February 9, 2009, the Board of County Commissioners of Weld County, Colorado, approved two (2) Improvements Agreements According to Policy Regarding Collateral for Improvements (Public Road Maintenance and Private Road Maintenance) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Ruby Hammond, with terms and conditions being as stated in said agreements, and accepted Check #722, from Ruby Hammond, in the amount of $12,741.00, and WHEREAS, staff from the Weld County Departments of Planning Services and Public Works have conducted a visual inspection and recommend release of collateral for the private (on -site) improvements, in the amount of $8,818.00, and the Department of Public Works recommends a partial release of the public (off -site) improvements, in the amount of $3,334.55, and accepted replacement collateral in the form of check #1082, in the amount of $588.45, retaining fifteen (15) percent, for a one-year warranty period, and NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that check #722, in the amount of $12,741.00 be, and hereby is, canceled and released. Long 2009-3070 PL2006 Oft hiDe COLORADO MEMORANDUM TO: Board of County Commissioners DATE: November 16, 2009 FROM: Kim Ogle, Planning Service SUBJECT: Ruby Hammond and the Jessup Transportation Facility Site Plan Review, SPR-425 Cash Deposit, Personal Check #1082 Staff from the Department of Public Works conducted a field inspection in October 20, 2009 and determined that the property was in compliance with all transportation elements as stated in their referral dated October 23, 2009. Planning Services inspected the site and determined that all non -transportation related items had been completed and were acceptable. The Department of Public Works finds that the private (on -site) improvements are acceptable, and therefore recommends to release the collateral in the amount of five thousand fifty-eight ($ 5058.00) and no/100s dollars. The Department of Planning Services finds that all non -transportation improvements are acceptable and recommends the release of collateral held in the amount of three thousand seven hundred sixty ($3760.00) and no/100s. Public Works finds the (public) off -site improvements acceptable and recommends to release eight -five (85) percent of the public improvements collateral in the amount of three thousand three hundred forty-four ($3,334.55) and 55/100s dollars. The Department of Public Works requests that fifteen (15) percent or five hundred eighty-eight ($588.45) and 45/100s dollars be held for the warranty period as stated in the public improvements agreement for the paved access onto County Road 4. The Weld County Attorney finds the Agreement is in the appropriate form; the Department of Public Works and the Department of Planning Services, have determined that the cash amount will be sufficient to complete the warranty work required for Ruby Hammond and the Jessup Transportation Facility, and the Departments of Planning Services and Public Works recommend acceptance of this cash deposit. A site inspection was conducted on October 20, 2009. Photos from the site visit are attached. During the site visit, the construction drawings were compared to the actual improvements constructed on site. Comments Public Works finds that the improvements have been constructed according to the approved construction drawings. The applicant has submitted a set of as -built construction drawings. Public Works finds that the private (onsite) improvements are acceptable. Public Works does not object to the release of its portion of the private improvements collateral in the amount of $5,058.00. Public Works finds that the public (offsite) improvements are acceptable. Public Works does not object to the release of 85% of the public improvements collateral in the amount of $3,3,4.55. Public Works requests that 15% ($588.45) of the public improvements collateral be held for the warranty period as stated in the public improvements agreement for the paved access onto WCR 4.
