WHEREAS , it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public meeting
held on the 28th day of February, 1977 , in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that
a certain parcel of land, being the property of Donald K. Adams,
Betty Birleffi and Robert C. Adams , Weld County, Colorado, more
particularly described as follows :
The East Half (E' ) of the Northwest Quarter (NWa) of Section
20, Taanship 6 North, Range 65 West of the 6th P.M. , Weld
County, Colorado, being more particularly described as follaas:
Beginning at the Northwest Corner (NW Cor) of said Section 20,
and considering the North Line of said Section as bearing South
79°47'55" East, with all other bearings contained herein relative
thereto:
Thence along said North line 1313.69 feet to the True Point
of Beginning; Thence continuing along said North line 1313.69
feet; Thence South 00°04'07" West, 2535.53 feet;
Thence North 81°57'38" West, 1303.94 feet;

Said parcel of land contains 75.873 Acres, more or less, including

WHEREAS , the Board of County Commissioners of Weld County,
Colorado, desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,
as amended, and Section 2-lA (3) of the Weld County Subdivision
Regulations;
NOW, TIEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Donald K. Adams, Betty Birleffi and
Robert C. Adams, be exempt from the definition of the terms ,

RE: Recorded Exemption #250
Dear Commissioners:
The attached application, plat and related items are in
reference to a request by Donald K. Adams, Betty Birleffi,
and Robert C. Adams for a recorded exemption. The parcel
of land is described as the Ez of the NW* of Section 20,
T6N, R65W of the 6th P.M. , Weld County, Colorado. Said
parcel is located j mile east of Lucerne. The subject
property contains 75. 873 acres of Class I irrigated soils.
The request is to split the property into parcels of 52. 758
acres and 23. 115 acres. As explained by Mr. Robert C. Adams
in a letter addressed to the Board of County Commissioners
the reason for this request is to settle an estate. Each
of the two resulting parcels would contain and existing set
of improvements. Based upon the information submitted and
the adopted policies in the County, the Planning Commission
staff recommends the request be approved for the following
reasons:
1. The City of Greeley Planning Commission has indicated
the request does not conflict with the Greeley Compre-
hensive Plan and the City has no objections to the
approval of this request.
2. The proposed split conforms with the intent clause of
the recorded exemption procedure (Section 9-2 of the
Weld County Subdivision Regulations) , the intent clause
of the agricultural district (Section 3. 3 A of the Weld
Board of County Commissioners

County Zoning Resolution) , and the Weld County Com-
prehensive Plan in that each resulting parcel would
contain an existing set of improvements and the use
would be compatible with the surrounding agricultural
uses.
3. The request complies with the provisions of Section
9-4 (A) of the Weld County Subdivision Regulations.

We have farmed this farm since 1954 . Over the years the farm
income and my wife ' s off the farm income have been used to keep the
farm going and in operation. In 1970 and main in 1972 we tried to
purchase the entire farm from my mother at the prevailing; market price .
Since my mother' s death the value of farm land in this area has --one
out of sight . The interest alone on the 2/3 interest of the farm
is prohibitive .
The manner in which my mother' s will was drawn prevented
parcelling of the farm while in the estate . The farm will pass from
the estate in undivided 1/3 interests for my sister, my brother and
myself. The reason for this appeal for a recorded exemption is
to create a specific 1/3 interest in my name so that I may make
improvements on my property. The farm will still be operated as a
farm unit.
Lot A contains 23.115 acres and includes cur home , most of the
corals and old farm building's . S°ie consider this a fair l/:3 interest
of the 7state .
Lot B contains 52.758 acres and includes a residerce an to-ether
with a residence in rreeley is considered a fair 2/3 interest of the
estate .

Dear Gary:
At its February 22, 1977 meeting, the Planning Commission of the City of
Greeley reviewed and recommended approval of the recorded exemption re-
quested by Bob Adams for the split of property located on Highway 392
east of Lucerne.
The Planning Commission did, however, express concerns related to the
150-foot wide strip created by the split. If the two parcels are not
farmed as a single unit, this strip could cause inefficiencies in future
