RESOLUTION
RE: GRANT OF CHANGE OF ZONE FROM A-AGRICULTURAL DISTRICT TO
E-ESTATE DISTRICT FOR THOMAS COWAN.
,' WHEREAS, the Board of County Commissioners of Weld County,
cy Colorado, pursuant to Colorado statute and the Weld County Home

`-i Rule Charter, is vested with the authority of administering the
r affairs of Weld County, Colorado, and

WHEREAS, a public hearing was held on December 7 , 1977, in
the Chambers of the Board of County Commissioners of Weld County,
Colorado, at 2 : 00 p.m. , for the purpose of hearing the petition
of Thomas Cowan, 625 3rd Street, Greeley, Colorado 80631, re-
questing a change of zone from A-Agricultural District to E-
cz
Estate District, for the following described parcel of land, to-
wit:
The East Half (F ) of the Southeast Quarter (SEa) of the South-
east Quarter (SEa) of Section 26, Tvomship 6 North, Range 66
West of the 6th P.M. , Weld County, Colorado, lying South of
County Road No. 64, being more particularly described as fol-
lows:
Beginning at the Southeast Corner (SE Cor) of said Section
26, and considering the South line of the Southeast Quarter
(SEa) of said Section 26 as bearing North 89°23'50" West, with
all other bearings contained herein relative thereto,
Thence North 89°23'50" West, along the South line of the South-
east Quarter (SEa) of said Section 26, 671.66 feet;
Thence North 00°04'31" Fast, 1037.00 feet to a point on the
South Right-of-Way line of County Road No. 64;
Thence South 71°11'57" East, along the South Right-of-Way
line of County Road No. 64, 709.20 feet to a point on the
Fact line of the Southeast Quarter (SEa) of said Section 26;
Thence South 00°04'38" West, along the East line of the South-
east Quarter (SEa) of said Section 26, 815.51 feet to the
Southeast Corner (SE Cor) of said Section 26;
Said described parcel of land contains 14.282 acres.
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of the
petitioners for a change of zone upon the aforementioned tract
of land, and
WHEREAS, Section 8. 2 and 8 . 3 of the Weld County Zoning
Resolution authorizes the Board of County Commissioners to grant
a change of zone upon the showing by the petitioner of certain
facts , and

WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, has studied the re-
quest of the petitioners and the recommendations of the Weld
County Planning Commission, 'and having been fully informed and
satisfied that the request for rezoning complies with the Weld
County Comprehensive Plan and the conditions set out in Section
8. 2 and 8. 3 of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the petition of
Thomas Cowan for a change of zone from A-Agricultural District
to E-Estate District on the above-described tract of land, be,
and hereby is, granted.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated October 18 , 1977, be, and hereby are, incorporated as
the findings of fact of the Board of County Commissioners in
this matter.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 7th day of
December, A.D. , 1977.

December 7 , 1977
I hereby certify that pursuant to a notice dated November 2 ,
1977 , duly published November 2, 1977 and November 23 , 1977
in the Greeley Journal, a public hearing was held on the
request of Thomas Cowan for a Change of Zone from A-Agricultural
to E-Estate District and for approval of a preliminary
subdivision plan. Mr. Cowan was present and was represented
by Gerald McRae, Engineer. There was no one in the audience
in opposition to the granting of the two requests. After
discussion, Commissioner Carlson made a motion to grant the
change of zone from agricultural to estate district. Commissioner
Dunbar seconded the motion and it carried unanimously.
Commissioner Jacobucci then made a motion to approve the
preliminary subdivision plan. Commissioner Dunbar seconded
the motion and it carried unanimously. All five Commissioners
were in attendance at the hearing.

Moved by Jerry Kiefer that the following resolution be introduced
for passage by the Weld County Planning Commission:
Be it Resolved by the Weld County Planning Commission that the appli-
cation for rezoning from A ( Agri aul turn 1 District) to
E ( Estate District) covering the,following described
property in Weld Clunty, Colorado, to-wit:
See attached
be recommend (favorably) ( Ktjy) to the Board of County Commissioners
for the following reasons:
1. It is the opinion of the Planning Commission that the applicant
has complied with Section 8. 3 of the Weld County Zoning Resolution
which states : "Request for rezoning of tracts within Weld County
should be supported by detailed and substantial evidence that such
rezoning is necessary. Recent findings and oral statements by
petitioners should show very clearly that either the original
zoning was faulty or that changing conditions in the area now
justify a new classification, Without the presentation of such
supporting documentation, the County Planning Commission should
not recommend a change of zoning. "
It is the opinion of the Planning Commission that the applicant has
demonstrated that the original zoning was faulty for this particular
tract of land.

STATEMENT
The 14.28 Acre tract of land is bounded on the East by County Road No. 35 (35th
Avenue) and on the North by County Road No. 64. On the South and West borders,
the Cache La Poudre River has lowered the river plain 10 to 12 feet below the
subject property. These borders and the existing ownership lines have somewhat
isolated and limited this property from being an ideal piece of farm ground.
Converting this tract of land tolEstate Zoning would provide a low density resi-
dential area and concentrate 9 rural lots into this location rather than in
separate parcels and locations scattered throughout the farmland surrounding
Greeley. Recent widening and improvements on 35th Avenue provide good access
to Greeley. Due to the very low density and only 9 lots, it is felt that the
addition of this subdivision will have a limited impact on the surrounding areas
which are currently large irrigated farms.
The owner proposes to make available to the property owners irrigation water from
water rights existing on the property. Also open space, pasture and other recre-
ational facilities could be made available by private agreement with the owner
on a mine acre tract lying south of the subdividion and adjacent to the Cache La
Poudre River.
A Preliminary Soils and Geological Investigation has been prepared by Empire Lab-
oratories, Inc. of Ft. Collins. The report indicates that any gravel deposits
underlying the property are not economic due to the poor quality and depth of
overburden. It also states that there are no geological hazards and that the
percolation rates and the soils conditions are suitable for construction of
standard septic systems.
A review of the Flood Plain Information, Cache La Poudre River, Colorado, Volume
II, Greeley, Weld County prepared by the Corps of Engineers in March 1974 indi-
cates that the property lies above both the Indermediate Regional Flood and the
Standard Project Flood. Recent improvements in the 35th Avenue bridge should
eliminate the back-up at this reference point and lower the maximum flood water
elevation of 4671 .2 feet. (See attached)

RE: River View Subdivision
Dear Mr. Smith,
Mr. Tom Cowan has submitted a preliminary map on River View Subdivision to the
County for review. We are writing this letter in order to outline our thoughts
on the cul-de-sac street (35th Avenue Court) which will serve the nine lots.
Presently, we have shown this road to be private. Tom David has indicated this
is an acceptable procedure.
There are two reasons for considering this as a private road: (1 ) Mr. Cowan
wishes to install a 25' concrete roadway (see attached P.C.A. data) , (2) This
roadway width could easily be placed in a 50' Right-of-Way leaving 12 1/2 feet
on each side for utilities. Also, an extended cul-de-sac with a landscaped
median and a 50 feet end radius has been proposed. This would result in a
flowline radius at the end of approximately 37 feet.
As these lots are large, we are proposing to increase the minumum front set-back
and not allow parking along the street. With these conditions and the limited
use of the street, we fool that the street proposed is adequate to servo the area.
The County planning staff has expressed concern and plans on recommending the
street be dedicated. Mr. Cowan has no real objections to dedicating the street,
but would like to use the standards outlined above.
After your review of the plans and proposal, we would like to discuss this further
and get your recommendations in order that we can proceed with the final platting.

1 This report presents the results.of a Preliminary Soils and Geologic
t Investigation .prepared for the proposed development located along County
.a .
Road 35 northwest of Greeley, Colorado. This investigation was carried
out by means of test borings and laboratory testing of samples obtained from
,{ these borings.
The objectives of this investigation were to (1) determine the suitability
of the site for construction purposes, (2) determine the suitability of the site
for construction of septic systems, and (3) determine the geologic characteristics
i of the site.

# SITE' INVESTIGATION
IThe field Investigation, carried out on July 6, 1977, consisted of drilling,
logging and sampling five (5) test borings and running five (5) percolation
tests. The locations of the test borings arc shown on the Test Boring Location

fPlan and Geologic Map included on page 6 of this report. Boring logs prepared
. from the field logs are shown on pages B and 9 . These logs show soils
Iencountered, location of sampling, and groundwater at the time of the investigation.
jA summary of the test results is included on pages 10 and 11 .
iS All borings were advanced with a four-inch diameter, continuous-
Itype, power-flight auger drill. During the drilling operations, a field engineer
' from Empire Laboratories, Inc. , was present and made a continuous visual
I inspection of the soils encountered.
i SITE LOCATION AND DESCRIPTION
The proposed site is located at the southwest corner of County Roads
35 and 64, Weld County, Colorado. More particularly, the site is described
as a tract of land situate in the southeast 1/4 of the southeast 1/4 of Section
26, Township 6 North, Range 66 West of the Sixth P.M. , Weld County, Colorado.

The site consists of irrigated farm land. The area Is relatively flat
and has positive drainage to both the southwest and southeast. Existing
irrigation ditches are located along the north and east property lines. The
area south of the property has been excavated forming a low bank along
the south edge of the site.
SOIL AND GROUNDWATER CONDITIONS
The sell profile at the site consists of strata of materials arranged
In different combinations. in order of Increasing depths, they are as follows:
(1) Silty Topsoil: The site is overlain by a one (1) foot layer of
silty topsoil . The upper six (6) Inches of the topsoil have been
• penetrated by plant roots and organic matter and should not
be used as a bearing soil or as a backlit' material.
(2) Sandy Silt: This stratum underlies the topsoil and extends
to depths of ten and one-half (10}) to greater than fifteen (15)
feet below the surface. The sandy silt contains traces of clay,
is slightly plastic and exhibits moderate bearing characteristics
' In Its dry to moist, natural state .
(3) Silty Sand and/or Silty Sand and Gravel: The granular layer
was encountered In Borings 1, 3 and 4 at depths of ten and one-
half '(10}) to fourteen and one-half (14}) feet below the surface
and extends to greater depths. The sand and/or fine gravel
contains varying amounts of silt, minor amounts of clay, Is
well graded and exhibits moderate bearing characteristics in
Its loose to medium dense, natural state.
(4) Groundw.iter: At the time of the Investigation, no free groundwater
was encountered to depths of fifteen (15) feet below the surface.
Water levels in this area are subject to change due to seasonal
variations and Irrigation demands on and adjacent to the site.
However, moisture contents Indicate that water levels should
not rise to within seven (7) feet of the surface.

RECOMMENDATIONS AND DISCUSSION
Foundation
In view of the type of construction proposed and the soil conditions
encountered at the site, it Is our opinion that the area Is suitable for the
proposed construction. It is recommended that the structures be supported
by conventional-type spread footings. Based on preliminary data , footings
founded at the above level may be designed for a maximum allowable bearing
capacity of one thousand five hundred (1500#) to three thousand pounds
(3000#) per square foot (dead load plus maximum live load) .
Basements and Slabs on Grade
Since no free groundwater was encountered to depths of fifteen (15)
feet below the surface, it is our opinion that basement construction is feasible
at the'site. All finished basement floor slabs should be placed a minimum
of two (2) feet above maximum seasonal groundwater elevations.
The existing soils encountered near the surface at the site are adequate
for supporting normal floor loads. All slabs on grade should be underlain
by a minimum of four (4) inches of gravel or crushed rock devoid of fines.
Septic Systems
In view of the percolation rates and the soil conditions encountered
at the site, it is our opinion that the site is suitable for construction of standard
septic systems.
Geology
The area of the proposed subdivision Iles within the Colorado Piedmont
Section of the Great Plains Physlographic Province. The Piedmont Section
in this area is characterized by relatively flat uplands. The area Iles within

the Cache la Poudre River drainage basin with the major drainage being
• to the south and east. Structurally, the area lies within the western portion
of the Denver Basin. During Late Mesozoic and Early Cenozoic Time, intense
folding occurred causing downwarping of sediments in the Denver Basin
and uplift of the Front Range to the west. The Laramie Formation Upper
Cretaceous in age underlies the site. Aeolian and/or alluvial soils of Pleistocene
• and Recent Time overlie the bedrock In the area.
The Laramie Formation, consisting of siltstones and sandstones, underlie
the site at approximate depths of thirty (30) to fifty (S0) feet below the surface.
The regional dip of the bedrock in this area Is slight and to the east. The
property has gentle slopes of a few percent and no geologic hazards due
to movement caused by gravity are anticipated. With proper site grading
around structures and adequate drainage for the proposed streets, no erosional
problems are predicted. It is recommended that structures not be placed
within fifty (50) feet of the two (2) irrigation ditches encountered at the
site. All streets should be designed to prevent ponding of water. The development
lies less than one thousand (1000) feet north of the Cache la Poudre River;
however, the site does nut appear to Ile within the floodplain of the river.
It is recommended that the limits of the floodplain in the area of the site be
verified by a hydrologic study performed by a qualified engineer.
Quarry rock and limestone were not encountered at the site and it
Is not anticipated that quarry rock or limestone will be encountered at economic
depths in this area. The Laramie Formation is known to contain coal bearing
beds but there is no known mining acitivity In the site area. The major
coal deposits in the Laramie Formation are encountered In the Boulder-Weld
coal field which is located approximately twentyfive (25) miles southwest
of the site. Subbituminous coal is known to exist in northern Weld County
Just north and east of the site and it appears that these deposits do not exist
below the subject property. Minor amounts of sand and/or sand and gravel
Were encountered at do pth over portions of the site. This material contains
silt and clay and is of poor quality. In view of the depth of overburden and poor
quality of the gravel motr rial, it is our opinion that the material encountered
Is not an economic sand and gravel deposit.

GENERAL COMMENTS
It should be noted that this was a preliminary investigation and the
bearing capacities recommended in this report are based on preliminary
tests. Due to variations In soil conditions encountered at the site, it Is recommend-
ed that additional test borings be made prior to.;construction. Samples obtained
from these test borings should be subjected to testing and inspection In the
laboratory to provide a sound.basis for. determining the physical properties
and bearing capacities of the soils encountered .

STATEMENT
The 14.28 Acre tract of land is bounded on the East by County Road No. 35 (35th
Avenue) and on the North by County Road No. 64. On the South and West borders,
the Cache La Poudre River has lowered the river plain 10 to_ 12 feet below the
subject property. These borders and the existing ownership lines have somewhat
isolated and limited this property from being an ideal piece of farm ground.
Converting this tract of land to Estate Zoning would provide a low density resi-
dential area and concentrate 9 rural lots into this location rather than in
separate parcels and locations scattered throughout the farmland surrounding
Greeley. Recent widening and improvements on 35th Avenue provide good access
to Greeley. Due to the very low density and only 9 lots, it is felt that the
addition of this subdivision will have a limited impact on the surrounding areas
which are currently large irrigated farms.
The owner proposes to make available to the property owners irrigation water from
water rights existing on the property. Also open space, pasture and other recre-
ational facilities could be made available by private agreement with the owner
on a n-dne acre tract lying south of the subdividion and adjacent to the Cache La
Poudre River.
A Preliminary Soils and Geological Investigation has been prepared by Empire Lab-
oratories, Inc. of Ft. Collins. The report indicates that any gravel deposits
underlying the property are not economic due to the poor quality and depth of
overburden. It also states that there are no geological hazards and that the
percolation rates and the soils conditions are suitable for construction of
standard septic systems.
A review of the Flood Plain Information, Cache La Poudre River, Colorado, Volume
II, Greeley, Weld County prepared by the Corps of Engineers in March 1974 indi-
cates that the property lies above both the Indermediate Regional Flood and the
Standard Project Flood. Recent improvements in the 35th Avenue bridge should
eliminate the back-up at this reference point and lower the maximum flood water
elevation of 4671 .2 feet. (See attached)

REZONING STATEMENT I
I respectfully request that the 14.28 Acres described in the attached application
be rezoned from "AN Agricultural to "E" Estate. This tract of land is bounded on
the East by County Road 35, and on the North by County Road 64. The land falls
rapidly 8 to 10 feet to the river plain on the South and West.
Farming on this tract has always been marginal due to its size and separation from
the adjoining farms and the poorer soils conditions. The sale of this tract from
the farming 'interest is also an indication that it was marginal for agricultural
uses. For the above reasons it is felt that the original zoning was general in
nature and faulty for this particular tract of land.

The following are continents on review of the rezoning application and preliminary
plan for River View subdivision in the Ei of the SE-'4 of Section 26, Twp. 60,
Range 66W.
Soil Suitability:
There are two (2) soil types present at the proposed subdivision site. They are
Kim loam, 1 to 3% slopes (90%) and Otero sandy loam, 5 to 9% slopes (10K). Both
soils exhibit suitable characteristics for proposed land use of residential hous-
ing. However, the Kim loam does exhibit low strength characteristics for dwellings
with and without basements. The recommendation for foundations made in Preliminary
Soils and Geological Investigation by Empire Laboratories inc. should he followed.
Percolation rates for both soils are within range for satisfactory septic tank
absorption fields.
Flooding potential resulting from planned land use:
The proposed site is for the most part above the 100 year flood plain of the Cache
La Poudre River. The proposed land use should not create any flooding hazard that
will effect adjacent areas.
Adequacy of planned drainage system:
There was no surface drainage plan submitted with the preliminary plan to evaluate.
However, it is our concern that some surface drainage system he designed to carry
storm runoff across lots 4 and 5 to safely discharge into the river to prevent
excessive soil erosion on these lots due to steep slopes.
Adequacy of engineering practices:
No engineering design was submitted with preliminary plan, therefore it can only
_ be assumed that the only surface modification is to be for the installation of
35th Avenue Court. If surface modification is to be done, it is our recommenda-
tion that slopes he made 4:1 or flatter to facilitate revegetation of the dis-
turbed area.

There were no vegetative protection and restoration plan nor an erosion
control plan submitted for evaluation. It is our recommendation that the
y•4'h developer prepare these plans to provide protection to the area from
potential wind and water erosion. Due to large lot size it is suggested
that the non-used areas of each lot be revegetated with native species
VO to provide surface soil protection (introduced species may be used if

The City of Greeley Planning Commission has reviewed the above
referral from Weld County, and , at its September 27 meeting ,
the Commission voted to recommend no objection to the rezoning .
However , the Planning Commission chose to take no action on the
preliminary plan.
While it is located beyond the 2010 Growth Ring and north of
the Poudre River , the proposed rezoning received favorable ;
action because of its proximity to estate zoning around Sealey
Lake . This area was specifically exempted from the 2010 growth
policies of the Comprehensive Plan.
The Commission expressed objections to the private road shown in
the preliminary plat . While considering suggestions that the
road either be dedicated to the public or maintained under a
unit development zoning plan, the Planning Commission voted to
take no action on the preliminary plan.

LOCATION: 35th Avenue and County Road 64 (North of the
Poudre River)

Mr. McRae presented a schematic of a 10- lot subdivision with
typical lot size of one acre proposed for property located at
the southwest corner of County Road 64 and 35th Avenue .
Access to the subdivision is off of County Road 64 ; 35th
• Avenue would have a total of 50 feet half street dedication .
The area is zoned Agriculture and would have to be rezoned to
Estate . The developer proposes. to build a wall or berm around
the subdivision in a manner similar to . Rangeview Estates .,
Irrigation water for the lawns would be stored in a park and
recreational area to be constructed between the subdivision
and the Poudre- River or -to be re- constructed from the existing
gravel pits . Domestic water is from North Weld . Sewage would
be septic tanks . The topography of the area is such that the
residential development would be built upon a ridge 32 feet
above the flood plain and the recreational area would be down
in the flood plain.
Mr. Cowan noted there are no commercially mineable gravel
deposits and the subdivision is proposed for an area with
an 18- foot overberm.
Mr. Cowan , describing an overall scheme for the area , felt
the gravel deposits in the area would not be a conflict with
the residences. Specifically he feels (louse Bill 1065 which
controls noise , dust , landscaping and layout of gravel pits
provides adequate control . In addition , he feels the lakes
that will develop out of the gravel pits will have a long
range potential for water.
•Mr. Sasaki had questions about the typical lot size . Mr .
McRae said the typical lot is I50 feet by 240- 300 feet .
• Mr. Sasaki noted that buildings should leave enough setback
for- 35th Avenue noise control and suggested a minimum house
setback of 100 feet .

conflict with overall City-wide development concepts in that
the Comprehensive Plan denotes this area for agriculture use
and that the area is not contiguous to the City. While the
Poudre River has served as a good boundary for the northern
extension of the urban area, it was noted that 35th Avenue
is a road out to Seeley Lake and more intensive development
might be anticipated.
Leon Kuhn asked about the -compatibility with the State Bike
Trail System. Tom Cowan said he would be agreeable to
{ participating in such a program. However , he noted the need
for fencing to separate gravel pit operation from residential
uses . •
