WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 28th day of March, 1979, the Board of County Commissioners of Weld County, Colorado heard the application of Al Phillips for approval of the Site Plan, Lot 1, Althen-Boyer Subdivision, and for the amended development standards for the same, and WHEREAS, the Weld County Planning Commission has recommended approval of said Site Plan for Al Phillips, Lot 1, Althen-Boyer Subdivision subject to the eleven (11) amended development stan- dards which are attached hereto and incorporated herein by reference, and also subject to the following conditions: 1. The development standards being recommended and approved for the Site Plan. 2. An amended Site Plan plat being submitted and recorded by the applicant which includes the Development Standards as now proposed and the change in building location on the site. 3. No building or electrical permits being issued on the Site Plan area until the Development Standards for the Site Plan have been placed on the Site Plan plat and said plat has been delivered to the office of the Department of Planning Services. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commis- sioners of Weld County, Colorado that the amended Development Standards for the Site Plan of Al Phillips, Lot 1, Althen-Boyer Subdivision be, and hereby are, approved. BE IT FURTHER RESOLVED by the Board that the Site Plan of Al Phillips, Lot 1, Althen-Boyer Subdivision be, and hereby is, approved subject to the amended Development Standards and also 790939 subject to the three conditions mentioned above which were recommended by the Weld County Planning Commission and adopted by the Board of County Commissioners. I have reviewed the Development Standards listed for Lot #1 of the Althen-Boyer CUD as outlined on sheet #1, Job 76-177, Freeze Engineering, and find no conflict with my plans to make use of the property and items number 2,3,4,5,6,7, & 8 listed there. Concerning items number #9 and number #10 and also some additional with regard to "planned use", please see the information below, Development Standard #9 and request for extension of time. Your records will show that Lot #1 of the Althen-Boyer CUD was approved by the Weld Planning Commission and the Weld County Board of County Commissioners in November of 1977. The one year period granted at that time to commence development, as outlined in Standard #9, expired on or about November 21st, 1978 - approximately three months ago. Please consider this a request that the Planning Commission recommend to the Board of County Commissioners that an extension of time be granted for development of Lot #1 to begin. I am requesting that an extension of one year be granted - beginning from November 21st, 1978 to the same date in 1979. This would effectively be an extension of approximately eight months - dating from mid March of this year. This would be considerably more convenient than would beginning a new request to your office concerning the development of the property. Too, an extension would also take advantage of the considerable time and effort made by your people concerning this matter. I am sure there will be no problem following the requirements here; however, I would like to have a copy of the Fox and Associates Report if one is available. Too, I will request information from the Weld County Health Department concerning Sewage Systems requirements as outlined in Item #8. Planned Use. The building, 50' x 120', proposed for Lot #1 would, in addition to having an office, provide facilities for the housing and conduct of our business activities. The activities will consist principally of the assembly and sale of belt conveyors and related items which are used by city, town and county governments and privately owned businesses engaged in the production/processing of crushed rock, sand and gravel, concrete ready mix coal and similar activities. Depending on the design and intended use of a conveyor it could contain as many as thirty separate items combined into its assembly, all of which are purchased from outside suppliers. Some of the items, by way of example, ar electric motors, switches and controls, bearings, sprockets, idlers, belting, belt drums, belt idlers, hangers, gear drives, shafting, sheaves, pulleys, hydraulic cylinders, pumps, valves, regulators, hose, wheels, tires, axle assembles and miscellaneous additional items. Many of the items included are "bolt on" items. However, some of the items are weldments and we will necessarily be doing some metal fabrication work including cutting and welding processes, drilling and machining. We have been assembling belt conveyors such as the one illustrated on the letterhead for the past three years. The need for them is increasing and consequently our business is growing. We need larger more adequate facilities than are available to us at our present location. .The building we propose to erect should adequately house this activity during all seasons of the year. We expect to have five or six emplbyees. We will, in addition to the assembly work described above, be handling on a resale basis as other merchants do, related items from other suppliers which are used by conveyor purchasers in their normal activities. For example, hoppers, bins, feeders, screens, vibrators, weighing and batching devices and so forth,all of which are used in conjunction with conveyors and conveying equipment,. Our business in the past has dealt principally with heavy machinery sold to city and county governments and private contractors. This heavy machinery activity has been phased out during the past three years and we do not plan to continue with it. Enclosed with this letter is the drawing by Freeze Engineering - Job #76-177 which you gave to me when I was at your office on the 7th. You will note that we are requesting the building site be moved 60 feet in an easterly direction and 20 feet in a northerly direction from that originally proposed. This proposed change is noted on the drawing in red ink - and was done by Mr. Freeze of Freeze Engineering at my request. Our Environmental Health Services Division, Weld County Health Department can supply the necessary forms. An engineer-designed septic system will be required if the public has access to restrooms.
