HomeMy WebLinkAbout20093014.tiff797 RESOLUTION RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR PLANNED UNIT DEVELOPMENT FINAL PLAN, S #562, FOR MEADOW VALE FARM, THIRD FILING - LENNAR COMPANY, SUCCESSOR TO THE GENESSE COMPANY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution dated November 1, 2000, the Board approved the application of Floyd and Katharine Oliver, c/o Glen Droegemueller, P.C., 822 7th Street, Suite 350, Greeley, Colorado 80631, for Meadow Vale Farm, Third Filing, on the following described real estate, to wit: Part of the SW1/4 of Section 4, Township 2 North, Range 68 West of the 6th P.M., Weld County, Colorado, and WHEREAS, on November 15, 2000, and at the request of Katharine H. Oliver, the Board of County Commissioners of Weld County, Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for Improvements (Public Road Maintenance), and an Improvements Agreement According to Policy Regarding Collateral for Improvements (Private Road Maintenance) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and Floyd and Katharine Oliver, with terms and conditions being as stated in said agreements, and accepted Irrevocable Standby Letter of Credit#0500000101, drawn on Centennial Bank of the West, 3561 Stagecoach Road, Longmont, Colorado 80504, in the amount of $505,000.00, as surety for said Improvements Agreements, and WHEREAS, on December 27, 2000, the Board released Irrevocable Standby Letter of Credit #0500000101 from Centennial Bank of the West and approved the Assignment and Assumption of Improvements Agreements presented by The Genesee Company, 603 Park Point Drive, Suite 201, Golden, Colorado 80401, who submitted substitute collateral in a like amount, via Surety Bond #064SB103475327BCM from Travelers Casualty and Surety Company of America, and WHEREAS, staff from the Weld County Departments of Public Works and Planning Services, with assistance from the Weld County Attorney's Office, determined that the single family residential parcels were conveyed to the Lennar Company, and that all open space components including the water body and open space landscaping had been transferred to the Homeowners' Association in 2002, and recommend release of said collateral. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Surety Bond #064SB103475327BCM, drawn on Travelers Casualty and Surety Company of America, in the amount of $505,000.00 be, and hereby is, canceled and released.
