WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 21, 1979 , the Board of County Commis- sioners of Weld County, Colorado approved the Sundown Planned Unit Development, and WHEREAS, the Department of Planning Services of Weld County, Colorado has informed the Board of County Commissioners of the proposed amendment to the Site Plan which changes said plan from a shopping center to an athletic club, and WHEREAS, after careful review and consideration of the facts presented, the Board of County Commissioners of Weld County, Colorado has determined that the amendment to the Planned Unit Development should be approved. SW-1/4 SW-1/4 Section 3, T5N, R66W Affiant, upon oath, states as follows: My name is R. L. Blaes and I am Manager, Land Department of Colorado Interstate Gas Company (CIG) , headquartered in Colorado Springs, Colorado. CIG has a direct interest in the matter before you concerning the Amendment to the Sundown Planned Unit Development. While CIG takes no position with respect to approval of this proposal, there are matters concerning the public health, safety, and welfare of which this Planning Commission should be aware prior to approving this Amendment. CIG owns a 50-foot wide natural gas pipeline right-of-way running generally in a north to south direction through the Planned Unit Development. Within the right-of-way, CIG operates two high-pressure natural gas pipelines: one 24 inches in diameter, the other 22 inches in diameter. The provisions of the right-of-way are a matter of public record, the document having been recorded on February 2, 1978, in Book 821, No. 1743363. Natural gas, itself, is a clear, flammable, toxic, vaporous substance having little or no smell. These qualities, in addition to the fact that the gas is transported at approximately 850 p.s.i. , cause CIG to conduct its pipeline operations in a highly efficient and safe manner. Pipelines are constructed to exacting specifications and carefully maintained with the public safety in mind. Under these conditions, properly constructed and operated natural gas pipelines, such as the ones crossing this Planned Unit Development, offers little risk to the public health, safety, and welfare. Nevertheless, in order for Colorado Interstate Gas Company to effectively maintain, operate and repair its two natural gas pipelines, we ask this Planning Commision not to approve the construction of buildings, roadways other than perpendicular to the pipelines, or paved parking areas on top of these pipelines. CIG believes that all issues affecting the public health, safety, and welfare should be made a matter of record and that it would be in the public interest for this Planning Commission to make note of such concerns. THE NUMBER OF EMPLOYEES PROPOSED WILL BE A MAXIMUM OF 12; HOWEVER, 9 EMPLOYEES WILL BE AT THE FACILITY AT THE SAME TIME, TYPICALLY. CIRCULATION OF VEHICLES IS VERY DIRECT AND IS AS SHOWN ON THE SUBMITTED SITE PLAN. OPEN SPACE AND LANDSCAPING REQUIREMENTS WILL BE SATISFIED AND WILL COMPLY WITH THE PREVIOUSLY APPROVED P.U.D. The double access as shown creates a traffic hazard and additional maintenance problems along 59th Avenue. Numerous deficiencies exist in the drainage concept. The required detention volume for the site cannot be arbritarily split between two ponds without consideration of individual sub-basins . Also, consideration was not given to the release flow from the south pond which enters the north pond. A single dentention area should be incorporated which better serves the site as a whole and reduces maintenance requirements. Details should be shown for all drainage structures. Facility sizes , profiles , cross-sections , and any other data necessary to insure proper review and construction should be included. Proper design of the drainage channel and rip-rap should be completed at this time. The design should be based on a minimum 25 year frequency. Note number 7 states that additional right-of-way "shall be" reserved. The additional right-of-way should be formally dedicated with the final plat. The note also states 75 feet of right-of-way along West 10th Street which contradicts the 77.5 feet shown on the plan. This discrepancy should be resolved. X7/71 Rodne H.
