Comments Drainage Report: A Drainage Report was received from Tetra Tech dated September 23, 2008 and stamped, dated and signed by Cameron Fowlkes, a licensed Engineer within the State of Colorado, stamp number 39318. Please stamp, date and sign all maps included with the report. Please verify the Hydrologic Soil Group (A, B, C, or D) for the soils within the site and areas that contribute to off -site flows. Show the time of concentration flow paths on the Drainage Plan. Please include the calculations for the swales routing all the off -site flows around the site. Will the O Street roadside ditch on either side carrying storm water be blocked by the proposed 12' wide x 10' high conveyor culvert installed under O Street? Please correct all the redline comments within the Drainage Report and on the Drainage Plans. This project falls primarily under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4; Section 23. Our comments and requirements made during this phase of the process may be all-inclusive, as other concerns or issues may arise during the remaining application portion. ROAD STATUS: Weld County Strategic Roadway: (December 2002) Weld County Strategic Roadway WCR 27 (83rd Avenue, Two Rivers Parkway) is classified by the County is a Strategic Roadway, which requires a 140 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. (WCR's 7, 9.5, 11, 13, 22, 24, 27, 37, 49 and 74). erial Corridor Study (October 2008) WCR 64 at this location is a major arterial road, which requires a 0 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Weld County Road Classification Plan (FHU): (June 2002) WCR 29 (71St. AVE.) is a major arterial road, which requires a 140 -foot right-of-way at full build out. There is presently a 60 -foot right-of—way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. All rights -of -way for WCR 27, WCR 64 and WCR 29 shall be noted and placed on the plat drawing as future dedicated right-of-way. The "O" Street Arterial Corridor Study: (October 2008) identifies alternate C as the approved alignment, which extends "O" Street directly west through the intersection. It should be shown on the plat drawing and identified as approved alignment. Work closely with Wayne Howard, Public Works, or follow-up on the status on this alignment. Conveyor Crossing: The conveyor crossing being approximately 12 feet wide by 10 feet tall with 5' of cover under "O" Street extending beyond the future right-of-way/alignment limits. The two-week notice prior to obtaining a Right -of -Way Permit and Construction of the crossing for notice of road closure shall be required. Contact Amy Burry, Public Works, to obtain the appropriate permit and to schedule road closures. A message board shall be placed at the appropriate two locations advising motorist utilizing this roadway to expect closure and to seek alternate routes. • Existing Access: All traffic utilizing the existing processing area will continue to use the existing main access •lnt off of 83rd Avenue (WCR 27) with the primary haul routes being on 83rd Avenue South to U. S. Highway Business and North/West to WCR 27, East to WCR 31 (Haul Route). New temporary access point: There will be limited access to the alternate area north of "O" Street (WCR 64) for equipment and employees. Both sides of the access point will have a tracking pad installed, may also be used intermittently for short-term hauling of overburden to portions of the mining area on the south side of the street and used for reclaiming. The second temporary access will be located along 71st Avenue, (WCR 29) for internal mining set up as well as access for equipment and employee excavation activities. Both temporary access points shall have tracking pads, coordinated with Amy Burry and a Right -of -Way permit assigned to both locations with appropriate signing and notification, if needed. Maintenance and Improvements agreement: With the reclassification of the roadway and the new alignment study, we recommend redraft the original agreement dated March 15, 1999, to bring it to a more current status. Public Works will provide you with a new draft copy. Noxious Weeds: Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. Traffic: The applicant has indicated that there will be no change in the traffic patterns or the number of employees, which remains the same at 35. A new light was installed a U. S. Highway 34 Business and 83rd Avenue as a part of the U. S. Highway 34 widening project. This light should accommodate and relieve traffic back-up and turning radius problems at this intersection. Follow-up with Janet Carter,Traffic Engineer, Public Works Department 970-304-6496 ext. 3726 for additional requirements or comments on this item. •ainage: The amended drainage report and flood hazard development (FHDP) has been submitted and is under review by the Public Works Department. The land owners affected are Goetzel and Aggregate Industries. There is currently 50' of ROW along 71st Ave now. All of the ROW is east of the 1/16th section line. All of the additional ROW will be off of the west side of the 1/16th section line. The 1/16th line is Goetzel and Agg Industries east property line and is currently located along the west shoulder of the existing roadway. I've attached two exhibit maps showing the new ROW. I know you are reviewing a mining application and I believe this information is something you can use. Let me know if you have any questions. (GRAVEL MINE) DATE: 12/12/2008 Environmental Health Services has reviewed this proposal for an amendment to an existing Mineral Resource Development facility including open pit gravel mining and materials processing including concrete and asphalt recycling, and a concrete and asphalt batch plant facility. The application indicates there will not be a change in the number or types of equipment that are currently in use on the site. Portable toilets and bottled water will be utilized at the working face of the mine. A letter from Sharks Tooth Pipeline Company indicates they currently provide water to the site. An individual sewage disposal system (ISDS) is located on the current mining site (SP - 0100206). The ISDS is permitted for a house and for a maximum of 4 people. The system must be evaluated by an engineer for the increased load of 35 employees. It appears that the ISDS was not evaluated as required by the previous amendment. Noise will be restricted to the level allowed in the industrial zone district. The dust abatement plan and waste handling plan that were submitted with the application are acceptable. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application, or an amended application, from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. 2. The existing septic system (SP -0100206) shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the systems ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental • • • Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 3. The applicant shall submit evidence of a Colorado Discharge Permit System (CDPS) from the Water Quality Control Division of the Colorado Department of Health and Environment for any proposed discharge into State Waterways, if applicable. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. A permanent, adequate water supply shall be provided for drinking and sanitary purposes for the office and plant site area. (Sharks Tooth Pipeline Company) 8. Adequate handwashing and toilet facilities shall be provided for employees and service people, at all times. 9. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 2 • • 10. Portable toilets may be utilized on sites that are temporary locations of the working face and portable processing equipment, etc. for up to six months at each location. 11. Bottled water shall be provided to employees at the temporary locations of the working face at all times. 12. The applicant shall comply with all provisions of the Underground and Above Ground Storage Tank Regulations (7 CCR 1101-14). 13. Any vehicle washing area(s) shall capture all effluent and prevent discharges from drum washing and the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 14.The applicant shall remove, handle, and stockpile overburden, soil, sand and gravel from the facility area in a manner that will prevent nuisance conditions. 15.All pesticides, fertilizer, and other potentially hazardous chemicals must be stored and handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). 16. The applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division, as applicable. 17. The operation shall comply with all applicable rules and regulations of the Colorado Division of Minerals and Geology. 18.The operation shall comply with the Mine Safety and Health Act (MSHA). 19. The reclamation plan shall be redesigned in order that the wildlife habitat restoration and re -vegetation efforts be planned and monitored by a qualified wildlife biologist/ecologist. 4. The Special Review Permit shall take into consideration the Poudre Trail Project. 5. Clarification on who will be responsible for meeting the augmentation requirement for the site. 6. After producing a referral response to Weld County the City of Greeley met with a representative of Aggregate Industries. While many of the City's concerns were addressed with this meeting a few remain. Of principal concern to the City of Greeley are the improvements proposed to be constructed within the City Limits and on the City owned Poudre River Ranch Natural Area, those improvements being a conveyor, and a roadway to access and maintain the conveyor. In regards to those improvements the City has three principle concerns that remain to be addressed: • • Access There is an existing easement on the property for access to the proposed conveyor crossing easement. The City would prefer that access be co -located with the existing access for the Oil and Gas operations on the property. Reclamation If the Oil and Gas access is not utilized the access road would need to be restored to its existing condition as close as practically feasible. Sewer Line There is an existing sanitary sewer line that runs along 71s1 Avenue and is located within the Permit Boundary. Easement documents and a comment to show the sewer lines on the plans were included with the referral response comments sent on December 12th 2008. Any extraction should be done in such a manner that it does not threaten the integrity of the sewer line and complies with relevant policies in regards to setbacks from underground utilities.
