HomeMy WebLinkAbout790851.tiff RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 363 - RALPH SOUTHER WHEREAS , the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS , it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public hearing held on the 8th day of January, 1979 in the Chambers of the Board of County Commissioners of Weld County, Colorado , that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption No. 363, being the property of Ralph Souther , described as part of the West Half Northwest Quarter of Section 8 , Township 1 North, Range 66 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows : That part of the West one-half of the Northwest one- quarter of Section 8, Township 1 North, Range 66 West of the 6th Principal Meridian, Weld County, Colorado, described as: Beginning at a point on the West line of said Section 8, 1131.1 feet North of the Southwest corner of the Northwest one-quarter of Section 8; thence North, 200.3 feet; thence East 435.0 feet; thence South, 200.3 feet; thence West 435 foot to the point of beginning, the West 30.0 feet is subject to County Road R.O.W. as established by Order of tte Board of County Commissioners for Weld County, recorded October 14, 1889 in Book 86 at Page 273. The parcel of land on which this request has been made is described as Pt . WZNW* Section 8, T1N, R66W of the 6th P. M. , Weld County, Colorado. This property is located at 804 South Denver (old U. S. Highway 85) less than 1 mile south of Ft . Lupton. The property contains 1 . 862 acres of Estate Zoned property. The request is to split the property into parcels of 1.326 and . 536 acres. The Southers desire to build a residence in the future on the . 536 acre parcel . The remaining 1 . 326 acre parcel has an existing resi- dential use and improvements located on it . Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends the re- quest be approved for the following reasons : 1. The proposed split conforms with the Recorded Exemption intent clause and the Weld County Comprehensive Plan. The Future Land Use Map from the Town of Ft . Lupton ' s General Plan identifies the property in question as low density residential use. The proposed use on the property would be compatible with surrounding land uses . 2 . The 1 . 862 acre parcel is located in a strip of residential lots along old U. S. Highway 85 which has low utility for agricultural use due to the size of the existing parcels and the intent for residential development which the County Estate Zone allows. The request complies with the provisions of Section 9-4 A. of the Weld County Subdivision Regulations. It should be noted that the Weld County Health Department , in a letter dated December 29, 1978, has recommended that the absorption field for the septic system should be located a minimum of 100 feet from any well . The Department of Planning Services Staff recommends the applicants contact the Weld County Health Department for further information. However, due to the small size of Lot B, adequate area for the sewage system may not be available. The area requirement is based on the results of a percolation test. Also, the absorption field must be located a minimum of 100 feet from any well . These conditions must be met to comply with Weld County Health Department septic system regulations.
