SUBJECT: USR-1715, Carlos Cisneros
The Weld County Public Works Department reviewed the submitted application for critical items,
including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical
Soils Report, and Flood Hazard Development Permit. Comments made during this stage of the
review process will not be all inclusive, as revised materials are submitted other concerns or
issues may arise. All issues of concern and critical issues during further review must be
resolved with the Public Works Department.

Weld County Road Classification Plan (FHU): (June 2002) WCR 37 is a collector road and
requires an 80 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. This
road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County
Zoning (23-1-90), the required setback is measured from the future right-of-way line. The
applicant shall reserve or dedicate an additional 10 -foot of right-of-way parallel to the WCR 37
right-of-way for future build -out.
The average daily count: Our most current ADT count for WCR 37 between WCR 12 and State
Highway 52 taken 7/14/2009 reflect 890 vehicles, which 11% are trucks and the 85% percentile
speed limit reflects 56 mph at this location.
Section Line Access: (right-of-way) WCR 12
If the applicant chooses to access the section line access, a Non-exclusive License Agreement
for the Upgrade and maintenance of WCR 12 right-of-way will be required. Additional fees are
associated with the Non-exclusive License Agreement.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the
property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other
than grasses, needs to be maintained at a maximum height of 12 inches until the area is
completely developed.
Off-street parking spaces including the access drive shall be surfaced with gravel, recycled
gravel or the equivalent and shall be graded to prevent drainage problems.
Storm Water Drainage: The applicant needs to provide a short description of the historic storm
water flow across the property and how their application will affect those flows. The description
shall include but not be limited to: where the water originates if it flows onto the property from an
off -site source, where it flows to as it leaves the property, the direction of flow across the

property, and if there have been previous drainage problems with the property. The applicant
also needs to provide flow arrows on the map showing where the storm water starts, how it
flows across the property, and where it leaves the property. If a drainage report is not required
by Public Works, the applicant will still be responsible for providing a water quality feature that
conforms to the methodology outlined in Volume 3, Section 4.4.2 of the Urban Storm Drainage
Criteria Manual. Please contact Clay Kimmi if there are questions regarding the design of the
water quality feature.
This area is not in a Special Flood Hazard Area (SFHA) as determined by the Federal
Emergency Management Agency (FEMA).

SUBJECT: USR-1715 Cisneros

Environmental Health Services has reviewed this proposal for truck parking. There are
no employees associated with this request.
The residence is served by an individual sewage disposal system (Permit #G19721136)
and, according to Department records, was sized for a 3 bedroom home which is
equivalent to 6 people. As there are no employees, the septic system does not require
review by a Colorado Registered Professional Engineer.
The site is served by an individual well (Permit # 50954) and is limited to domestic use.
Use of the domestic well for any other purpose, such as employees, commercial truck
and equipment washing or dust control is prohibited.
The applicant performs minor maintenance on the vehicles such as replacing light bulbs
and tires. The trucks are taken to the truck stop for major repairs and other fluid
changes such as oil and anti -freeze.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit a dust abatement plan, detailing on site dust control
measures, for review and approval, to the Environmental Health Services, Weld
County Department of Public Health & Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:

1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Commercial vehicle and/or equipment washing is prohibited in accordance with
the restrictions of well permit number 50954.
8. The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Subject: USR-1715 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV08-00384) was noted. This
violation was initiated due to the storage of multiple Commercial Vehicles without first obtaining the
necessary Weld County Zoning Permits. This case was presented to the Board of County Commissioners
through the Violation Hearing process on June 16, 2009. The Board referred this case to the County
Attorney's Office, but delayed legal action for 60 days (August 16, 2009).
This application if approved by the Board of County Commissioners would correct the violation. If this
application is denied, the number of Commercial Vehicles shall be reduced to not exceed 1 (one) at any
given time. If not reduced within 30 (thirty) days of denial, legal proceedings would commence.

Dear Mr. Gathman:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-101(10)(a),
C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning
directors, this office will only perform a cursory review of the referral information and provide comments.
The comments do not address the adequacy of the water supply plan for this project or the ability of the
water supply plan to satisfy any County regulations or requirements. In addition, the comments provided
herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a
well permit, or the physical availability of water.
According to the referral information the operation will be served by an existing domestic well,
permit no. 50954.
Well permit no. 50954 was issued on February 2, 1972 for domestic purposes. Note that the use
of the ground water for wells constructed and put to beneficial use prior to May 8, 1972 is limited to the
uses that can reasonably be shown to have existed as of May 8, 1972 or the uses that can reasonably be
shown to have been intended as of May 8, 1972 (provided such uses do not exceed the statutory use
limits for a residential well as specified by CRS 37-92-602(1), which allows for up to three single-family
dwellings, the watering of domestic animals and livestock, and the irrigation of not more than one acre of
home lawn and garden).
Based on the information provided, the proposed parking of two semi -trucks and 3 trailers plan
will not employ any people at this site and there will be no customers using the site. As long as the
proposed development will be operated solely by the property owner, this office has no objection to use
well permit no. 50954 to supply the property for the permitted uses. However, if the proposed parking of
two semi -trucks and 3 trailers will employ people or there will be customers using the site, we will view this
as a commercial business and well permit no. 50954 cannot be used to supply water to a commercial
business on the property. If the well will be used to supply a commercial business, the Applicant will need
to obtain a well permit for commercial use. The ability for this lot to obtain a commercial well permit would
be evaluated at the time that a well permit application is submitted.
