Subject: USR-1684 Referral
Upon review of my case files and computer, an active Zoning Violation (ZCV07-01039) was noted. This
violation was initiated due to the operation and storage of a concrete business and several pieces of
equipment without first obtaining the necessary Weld County Zoning Permits. This case was presented to
the Board of County Commissioners through the Violation Hearing process on September 11, 2007 at
which time the Board referred this case to the County Attorney's Office for immediate legal action. Since
the application was not submitted until recently, an investigation fee was required with this application.
This application if approved by the Board of County Commissioners will correct the violation. If this
application is denied, this case will proceed accordingly through the Weld County Attorney's Office.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to
county planning directors, this office will only perform a cursory review of the referral information and
provide comments. The comments do not address the adequacy of the water supply plan for this
project or the ability of the water supply plan to satisfy any County regulations or requirements. In
addition, no water related matters were presented in the referenced material.

The Weld County Public Works Department has reviewed this proposal. This project falls under the primarily
under the purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division
4, Section 23. Our comments and requirements are as follows:
COMMENTS:
Weld County Road Classification Plan (FHU): (June 2002) Grace Avenue and Frederick Street are both
local paved roads within the Town of Wattenburg. These roads are maintained by Weld County. Pursuant to
the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the
future right-of-way line.
REQUIREMENTS:
.ccess: The proposed access is existing from Grace Avenue. Utilize this existing access point.
Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or
become established as a result of the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds.
Off-street parking spaces including the access drive shall be surfaced with gravel or the equivalent and shall
be graded to prevent drainage problems.
A traffic study is not required.
Storm Water Drainage:
Flood Hazard Development Standards: This area IS in a Special Flood Hazard Area (SFHA) as determined
by the Federal Emergency Management Agency (FEMA). Please contact Clay Kimmi in our Drainage Division
to verify site location and any additional follow-up requirements.
Off -Street Parking: There shall not be any staging or parking either on Frederick Street or Grace Avenue
adjacent to the facility. Utilize on -site parking for company equipment, vehicles, and employee parking.

Environmental Health Services has reviewed this proposal for parking of vehicles and
storage of equipment for a concrete company. Water is provided by Wattenberg
Improvement Association, however no documentation was provided from the
Association indicating the availability of water for the business. An individual sewage
disposal system (permit — G19780397) is located on the parcel and according to
department records was sized for 13 people. As there are 14 people that will be
utilizing the facility, an engineer evaluation will be required to ensure the septic system
can accommodate the additional load.
The application did not indicate if maintenance of equipment or vehicles is performed on
site. It appears there is a floor drain in the building which discharges to a quarry. This
is not allowed and the drain must be cemented in. Any discharges must be contained
and hauled to a waste handling facility.
The application states the building is utilized for storage of equipment but does not
detail the type of equipment. If any chemicals or fuel are stored on the facility the
manufactures recommendations shall be adhered too. Secondary containment is
required for storage of large amounts of fuel or oil.
We have no objections to the proposal, however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The app iicant shall submit a dust abatement plan for review and approval, to the
Environmental Health Services, Weld County Department of Public Health &
Environment.
2. The applicant shall submit a waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum. the following:

1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
3. In the event washing of vehicles will occur on site the applicant shall ensure that
any vehicle washing areas shall capture all effluent and prevent discharges from
the washing of vehicles in accordance with the Rules and Regulations of the
Water Quality Control Commission, and the Environmental Protection Agency.
Vehicle washing areas should be designated on the plat.
4. Evidence shall be provided to Environmental Health Services, Weld County
Department of Public Health & Environment, that the existing floor drain has
been disconnected and will not be utilized.
5. In the event the applicant intends to utilize the existing septic system, for 14
people, the septic system shall be reviewed by a Colorado Registered
Professional Engineer. The review shall consist of observation of the system and
a technical review describing the systems ability to handle the proposed
hydraulic load. The review shall be submitted to the Environmental Health
Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed the system shall be brought into compliance with current
Regulations.
6. Documentation shall be provided to Environmental Health Services, Weld County
Department of Public Health & Environment from Wattenberg Improvement
Association which indicates water service is available for the business.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.

3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. Any vehicle washing area shall capture all effluent and prevent discharges in
accordance with the Rules and Regulations of the Water Quality Control
Commission, and the Environmental Protection Agency.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S., as amended.
8. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times.
9. Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.

10.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes.
11.All pesticides, fertilizer, and other potentially hazardous chemicals must be
stored and handled in a safe manner in accordance with product labeling and in
a manner that minimizes the release of hazardous air pollutants (HAP's) and
volatile organic compounds (VOC's).
12. If applicable, the applicant shall obtain a stormwater discharge permit from the
Colorado Department of Public Health & Environment, Water Quality Control
Division.
13.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.
