FOR VIOLATION OF THE WELD COUNTY CODE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, DJR Well Service, Inc., ZCV #0800305, is allegedly in violation of the Weld County Code, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 13th day of January, 2009, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, DJR Well Service, Inc. was not present or represented at said hearing, although all parties were notified of said hearing by Department of Planning Services staff, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until March 13, 2009, to allow adequate time for the property owner to submit an amended Site Plan Review application to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV #0800305 be, and hereby is, referred to the Weld County Attorney's Office for legal action against DJR Well Service, Inc. to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until March 13, 2009, to allow adequate time for the property owner to submit an amended Site Plan Review application to bring the subject property into compliance. REMEDY 2009-0077 Vir'ation Summary Report As we discussed over the phone, upon a review of your existing SPR-169, it is apparent that the site has substantially expanded beyond the approved use through SPR-169 through, but limited to the following actions: 1.) The addition of numerous tanks and storage on the Northern part of the property. 2.) The addition of multiple employees. The original SPR-169 called out 2 office staff and multiple employees. It stated that the number of vehicles entering and exiting the property daily would not exceed 6 1 -Ton Trucks, 7 Pick -Up Trucks and 2 cars (a total of 15 vehicles daily); however, upon an inspection of the property, substantially more vehicles were noted. 3.) It also appears that you are not in compliance with your existing Landscaping plan. Also as we discussed, the first step in correcting this violation is to complete and submit the Pre -Application Request application submitted in my initial letter. RECOMMENDATION The Department of Planning Services recommends this case be forwarded to the County Attorney's Office for immediate legal action. MEMORANDUM hiDe COLORADO TO: PA08-113; Case File, pre -application DATE: December 19, 2008 FROM: Kris Ranslem, Planning Technician SUBJECT: Pre -Application Meeting prior to submitting an amendment to SPR-169 Attendees: SuzAnn McCrumb, Applicant Gary ?, Applicant Clay Kimmi, Public Works Don Carroll, Public Works Jacqueline Hatch, Planning Michelle Martin, Planning Chris Gathman, Planning Bethany Salzman, Zoning Compliance Kris Ranslem, Planning On Friday, December 19, 2008 an informal discussion took place at the Greeley Administrative Offices Conference Room regarding a proposed amendment to SPR-169. (The legal description is part of the SW4 Section 19, Township 1 North, Range 66 West of the 6th P.M.; Situs Address is 12563 CR 6) Background Information: The applicants operate an oil and gas well servicing company. The property is used to park equipment when not working off -site. There is also equipment stacked on -site. The applicants currently have seven (7) storage containers located on the property. The site is currently in violation (ZCV08-00305). The majority of the site is located in a designated FEMA floodplain. The site encumbers approximately 10 acres. There is a double -wide trailer which is used as an office. There is a shed also located on site. The applicants have a commercial well and septic system. The applicants indicated that they currently have port -a -potties for the drivers located by the shed. The applicants indicated that there are approximately 35 employees. Public Works Due to the majority of the property being located in a floodplain, the applicants were directed to file a Flood Hazard Development Permit for the entire site. Staff directed applicants to obtain a Professional Engineer to do some modeling of the site so that there is no adverse impact created on the neighboring properties. The facility is surrounded by a chain link fence. Mr. Kimmi stated that he would evaluate the site and is available to answer any questions the applicant may have. No Drainage Report will be required; however the applicant must have a water quality feature for the site. No Traffic Study is required. The applicant estimated approximately 100 trips per day. No Geotechnical Report required. Access is from CR 6. County Road 6 is a paved collector road with an 80 foot right-of-way. Applicants indicated that they have no problem with the entrance to their site. Applicants expressed concern after hearing some rumors of improvements to CR 6. Staff stated that CDOT would make any improvements if they so determine. The Site Plan must identify all parking areas and outside storage areas. Planning Department Staff commented that according to code, the Health Department will require the removal of the port -a -potties and that the applicant's employees use the bathroom located in the office. The Health Department will need to evaluate if the septic system has the capacity for the number of employees. The applicants indicated that all the junk and storage which is included in the violation has been cleaned up and removed. The applicants indicated that the storage containers house equipment parts and some advertisement apparel/products. Staff informed the applicants that according to code in the agricultural zone district the applicants will not be allowed to have the storage containers. Staff suggested the applicant look into putting up a structure. Staff indicated that the violation will be put on hold upon submittal of the SPR application. Pre -application reviews are required prior to beginning the application process; however, this review is not an application. Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and and Environment. The second and fourth Friday of any given month pre -applicant reviews are held in the Southwest Service Center office at 10:30 a.m., 11:30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre -Application reviews are held Thursday of any given week in the Greeley office. This location works very well for our needs. Our property is used as a yard to park equipment when it is not out on a work site. It is also used to park equipment on evenings and weekends. 1. The tanks that were in the yard a lot of them have been moved, I think we only have a couple left to get out of the yard. Sometimes the north end of our yard is used for storage of pipe and stairway and landings, and different oil field supplies that is needed for day to day work the north end of the property is also used for parking our rigs and large trucks. 2. The storage that we added as far as the cargo containers, they are storage for each section of our company one has rig parts, roustabout parts, truck parts, and the mechanic has one for storage of filters and things he need to work on equipment. One has office supplies in it and advertising supplies. The shed that is next to the office on the South side has accounting boxes stored inside. The one shed that use to sit to the North we had to take down due to the fire code, so all that is there now is the cement slab, the long building north of the cement slab is a storage building for our anchors for our Auger truck. All the other buildings are original buildings. 3. The trailer is used for an office to do bookwork and the dealings of the company. Five women and one man work full-time in the office, we have four supervisors that are only in the office about an hour a day if even that they mainly work out in the field. The owner is also in and out of the office daily. We have 6 cars for the office staff, and roughly 20 to 25 employee cars in the yard at any given time, 1 Auger Truck 13 to 14 One Ton Trucks. Some equipment in the yard is stacked equipment. (Equipment not in use.) A lot of our employees work off site. 4. Our landscaping changed dramatically when they dug the gravel pit south of our office, at that time all our big Cotton Woods North of the office started to die and at this time we have one left and it is not looking good either. We do have Russian Olives planted on the south side of the office that is along road 6 and a few on the East side up by the Highway 85. We do have a nice lawn in the summer and rose bushes planted out front and side of the office.
