HomeMy WebLinkAbout20090122.tiffRESOLUTION RE: GRANT REQUEST FOR EXTENSION OF SUBMITTAL OF SITE SPECIFIC DEVELOPMENT PLAN AND PLANNED UNIT DEVELOPMENT FINAL PLAT, PF #1099 - SOARING SKIES VENTURES, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on April 5, 2006, by Resolution #2006-0738, the Board approved the application of Soaring Skies Ventures, LLC, P.O. Box 1245, Fort Collins, Colorado 80522-1245, requesting Change of Zone, PZ #1099, from the A (Agricultural) Zone District to the PUD (Planned Unit Development) Zone District for nine (9) residential lots, for a parcel of land located on the following described real estate, to -wit: Lot B of Recorded Exemption #3685; being part of the S1/2 of Section 5, Township 7 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, on October 20, 2006, the Department of Planning Services administratively approved the application of Soaring Skies Ventures, LLC, P.O. Box 1245, Fort Collins, Colorado 80522-1245, requesting a Site Specific Development Plan and Planned Unit Development Final Plan, PF #1099, for nine (9) residential lots with E (Estate) Zone uses, three (3) open space tracts, and oil and gas production on 54.6 acres, and WHEREAS, at a hearing on November 5, 2007, the Board approved a one-year extension of the submittal of the Planned Unit Development Final Plat for recording, as requested by the applicant's representative and required by Sections 27-8-60 and 27-8-70 of the Weld County Code, with said Final Plat to be submitted by October 20, 2008, and WHEREAS, Timothy Halopoff, Managing Member, on behalf of said applicant, has requested an additional one-year extension of the submittal of the Planned Unit Development Final Plat for recording, indicating said Final Plat will be submitted by October 20, 2009, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present, studied the request of the applicant and the recommendation of the Department of Planning Services, and, having been fully informed, finds that this request shall be approved. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the request of Soaring Skies Ventures, LLC, for an extension of the submittal of the Planned Unit Development Final Plat for recording, as required by Sections 27-8-60 and 27-8-70 of the Weld County Code, on the above referenced parcel of land be, and hereby is, 2009-0122 PL1830 Cd ; PG,Pw C4,,r& EXTEND SUBMITTAL OF PUD FINAL PLAT - SOARING SKIES VENTURES, LLC PAGE 2 granted, with said Final Plat to be submitted and recorded by October 20, 2009. The plat has not yet been recorded, pending the required Improvements Agreement and surety. The applicant is requesting an extension to the normal 1 -year deadline for recording a PUD final plat, as required by Section 27-8-60. The same Section allows for the Board of County Commissioners to extend this deadline, if the Board finds that the PUD has not been abandoned and that the applicant possesses the willingness and ability to record the plat. The Board has previously extended the deadline one time, from October 20, 2007, to October 20, 2008, per Resolution 2007-3431. The applicant indicates that they are working to receive a loan, and that it will be able to provide a Letter of Credit, finalize the Improvements Agreement, and record the Final Plat within a year. The applicant has also indicated that, with a slower real estate market, their timeline for completing the improvements is not as aggressive as it had been earlier. These are reasonable explanations and, as such, staff believes an extension is warranted. (.01 t'1t41lc) Brad Mueller Weld County Planning 918 10th Street Greeley, CO 80631 p. sr'I :•pf I RE: Sorrel Ridge Plat Extension Planned Unit Development Final Plan — PF#1099-Soaring Skies Ventures, LLC Dear Mr. Mueller, Soaring Skies Ventures, LLC (SSV, LLC) received administrative approval from Weld County for the Final Plan, PF# 1099 on October 20, 2006 and in 2007 received an extension of the approvals through October 20, 2008. Having recently met with the members of SSV, LLC and having received overwhelming agreement by the members to continue forward with the Sorrel Ridge PLJD, I am continuing to advance preparations for construction of the project. SSV, LI.,C is currently in the process of working with our bank on the construction loan that will both pay for construction of the improvements and post the Letter of Credit (LOC) to Weld County. Due to the depressed housing market and unpredictable credit environment, SSV, LLC would like to request an extension on the 1 -year deadline placed on the approved Sorrel Ridge Plat and construction documents. SSV, LLC kindly asks the Board of County Commissioners to grant a 1 -year extension on the Final Nat to October 20, 2009 to allow us time to procure ample funding to successfully post the needed LOC and finance the project improvements. As soon as we have received our loan, it is our intent to post the LOC and construct the improvements.
