RE: ACTION OF BOARD CONCERNING USE BY SPECIAL REVIEW PERMIT #1694 FOR A
HOME BUSINESS (STORAGE OF CONSTRUCTION MATERIALS -STEEL DOORS AND
FRAMES) IN THE A (AGRICULTURAL) ZONE DISTRICT - KEITH THOENE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 24th day of
June, 2009, at the hour of 10:00 a.m., in the Chambers of the Board, for the purpose of hearing the
application of Keith Thoene, 1365 West Mulberry Lane, Highlands Ranch, Colorado 80129, for a
Site Specific Development Plan and Use by Special Review Permit #1694 for a Home Business
(storage of construction materials - steel doors and frames) in the A (Agricultural) Zone District, on
the following described real estate, being more particularly described as follows:
Lot B of Recorded Exemption #3050; being part of
the E1/2 NE1/4 of Section 25, Township 1 North,
Range 65 West of the 6th P.M., Weld County,
Colorado
WHEREAS, at said hearing, the Board deemed it advisable to continue said matter to
July 29, 2009, and then again to October 28, 2009, to allow adequate time for review of the matter
by the Planning Commission, and
WHEREAS, at said hearing on October 28, 2009, Planning staff advised the Board that the
applicant is working to obtain a Certificate of Occupancy for the residence on the property, and the
matter was again continued by the Planning Commission, therefore, he requested that the matter be
referred back to the Department of Planning Services, and
WHEREAS, the Board heard all of the testimony and statements of those present and
reviewed the request of staff, and, having been fully informed, finds that it is appropriate for the
matter to be referred back to staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the abovementioned matter be, and hereby is, referred back to the
Department of Planning Services.

SUBJECT: Staff Request for Case to be referred back to Planning
The applicant Mr. Thoene has applied for a Site Specific Development Plan and a Special Review
Permit for a Home Business (storage of construction materials — steel doors and frames) in the (A)
Agricultural Zone District.
As of the date of this Planning Commissioner hearing, Mr. Thoene has not received a Certificate of
Occupancy for his residence currently under construction. Given this situation, the Department of
Planning Services is requesting, on his behalf, that this case be referred back to Planning.
