RESOLUTION
RE: APPROVE CANCELLATION AND RELEASE OF COLLATERAL FOR SHILOH ESTATES,
AMENDED PLANNED UNIT DEVELOPMENT FINAL PLAN, AMPF #354 - JAMES AND
CHERI SCOTT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated May 10, 2006, the Board approved the application of
James and Cheri Scott, 35325 Cornerstone Way, Windsor, Colorado 80550, to subdivide Lot 7,
Shiloh Estates, into 4 (four) lots, for a parcel of land located on the following described real estate,
to wit:
Part of Section 4, Township 6 North, Range 67 West
of the 6th P.M., Weld County, Colorado, and
WHEREAS, on November 6, 2006, the Board of County Commissioners of Weld County,
Colorado, approved an Improvements Agreement According to Policy Regarding Collateral for
Improvements (Private Road Maintenance), between the County of Weld, State of Colorado, by
and through the Board of County Commissioners of Weld County, and James and Cheri Scott with
terms and conditions being as stated in said agreement, and accepted check #1734, from Shiloh,
Inc., in the amount of $119,629.00, and
WHEREAS, the Board, through Resolution #2007-0734, dated March 21, 2007, released
cash collateral, in the amount of $26,195.30, to the applicant as improvements were completed,
retaining $93,433.70, and
WHEREAS, the Board, through Resolution #2007-1482, dated May 23, 2007, released cash
collateral, in the amount of $27,523.00, to the applicant as improvements were completed, retaining
$65,910.70, and
WHEREAS, the Board, through Resolution #2007-3078, dated October 1, 2007, released
cash collateral, in the amount of $52,094.80, to the applicant as improvements were completed,
retaining $13,815.90, and
WHEREAS, staff from the Weld County Departments of Planning Services and Public
Works have conducted a visual inspection and recommend release of said collateral, in the amount
of $13,815.90.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the collateral being held, in the amount of $13,815.90 be, and hereby is,
canceled and released.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
directed to return said collateral to the appropriate issuing party.

The Department of Planning Services has received a request for release of collateral for Shiloh
Estates PUD, 1 s` Amendment (File No. AmPF-354) in the amount of $13,815.90. This represents all
remaining collateral held, as warranty, in conjunction with this application. Planning Services and
Public Works support this release and recommend approval.

Dear Mr. Muller,
This letter is to request the remaining release of collateral for the development of
Shiloh Estates PUD Re -Subdivision of Lot 7. This project was completed more than one
year ago. As per our improvements agreement with the County we are requesting the
remaining $13,815.90 to be released. The form of our collateral was a cash deposit with
the county.

is now up. The amount that would be released is $13,815.90.
Please verify whether or not the improvements have met warranty standards, and whether
Public Works supports release of all remaining collateral associated with the project.
