RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST RODGER AND FRANCIS STEINKE FOR VIOLATION OF THE WELD
COUNTY CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Rodger and Francis Steinke, ZCV #0800330, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 12th day of May, 2009, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Rodger Steinke, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon
such referral until July 12, 2009, to allow adequate time for the property owners to remove the
commercial business from this site to bring the subject property into compliance and for an
inspection of the property by the Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that ZCV #0800330 be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Rodger and Francis Steinke to remedy the violation of the Weld
County Code, and any other persons occupying the properties, any persons claiming an interest
in the properties, and any persons acting in active concert with the identified parties, with an
instruction for delay of action upon such referral until July 12, 2009, to allow adequate time for the
property owners to remove the commercial business to bring the subject property into compliance.

REMEDY
I presented your extension request (letter) to staff. Staff agreed to grant your request, but to ensure
compliance, they recommended this case be scheduled for the May Violation Hearings. If the property is
brought into compliance before May 8th, the above referenced hearing will be cancelled and this violation
case closed. However, if additional time is needed, you will need to attend the Violation Hearing and
request it from the Board of County Commissioners.
To correct the violation, the business operations and storage shall be removed from the property or
appropriately permitted through the Use by Special Review (USR) process.
RECOMMENDATION
The Department of Planning Services recommends this case be forwarded to the County Attorney's Office
but to delay legal action for 60 days.

Rodger Steinke, Peggy Gregory, Kim Ogle and I met to
Violation Summary Report
discuss the violation cases on Mr. Steinke's property. Mr.
Steinke started off by stating he was working on removing
the business from the property. He stated he was
relocating the business to Mead (14293 Longs Peak Ct -
Sekich Business Park). He said he is going to need some
time to do that though. The property he has purchased still
needs to have a building built and there are some sewer
issues remaining. I asked how much time he thought he
was going to need. He said reasonably 6-8 months. I told
him to put it in a letter and I would take it to staff. Kim also
requested a letter from the Town of Mead indicating that
they were working with Mr. Steinke towards permitting this
business. He said he would get both of those letters and
get them back to Peggy or I.
11/21/2008 Other I presented Mr. Steinke's letter to staff. Staff discussed his
extension request and determined that the best way to
grant his extension was to go ahead and schedule his
violation for the May Violation Hearings.

04/28/2009 Office Visit Rodger Steinke came into the Greeley Office. He indicated
that he would have the business shut down as of the 8th.
He stated they would still have to store equipment and
supplies on the property until the site in Mead was
completed. He said the only traffic would be employees
coming by to pick stuff up to work. He stated they are
installing sheet rock in the Mead building this week. I
asked how soon he expected the building to be finished.
He said very quickly. I said so within 30 days. He said oh
definately. I explained that I would be asking the Board to
refer the case to the County Attorney"s Office, but to delay
any legal action for 60 days (just to give him some cushion
time). He said that would work. I stressed that it was
important for him to attend the hearing, but that would be
my recommendation.

Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you or a

RE: Letter Dated Oct 30th, 2008 Required Inspections for Building.

Originally in 1998 Dave Sprague said I did not need a building permit for the building, then about
a year later the electrical inspector (T. Potter) informed me that I needed to take a out a permit on the metal
building in order for him to pass the electrical work done on the service that also fed the house. I then took
out a permit to have the electrical, heat and gas inspected. That permit # is BC -9901142 dated 12/29/99 and
was finalized on 1/14/00.
It was not until 2005 that we started using the building for NLine Electric and we were allowed to
continue its use as stated in the resolution dated 1-6-05 as the violation was referred back to the Department
of Planning.
We are in the process of building a new office at 14293 Longs Peak Court, Mead, CO, We are
working towards being ready to move into by May 2009 at that time NLine will no longer do business out
of the building at 12922 WCR 1.
So if you would bear with me for that amount of time I would appreciate it.

To whom it may concern:
N -Line Electric has applied for a building permit for a new 6,100 square foot building
within the Town of Mead designed to house their operations. The building permit has
been reviewed by the Town's building inspection service and is available to be picked up
at Town Hall. It is anticipated that the building will be completed and ready for
occupancy by May 15, 2009.

It has come to the attention of the Department of Building Inspection that N Line Electric is operating a
commercial business in the "agricultural exempt building" on your property. On December 1, 1999, you were
issued permit number COC-990149 and the Certificate of Compliance form you signed states:
"AGRICULTURAL EXEMPT BUILDINGS are those buildings or structures on agricultural -zoned property used
for the sole purpose of providing shelter for agricultural implements, farm products, livestock, or poultry.
SHOULD THE BUILDING STATUS CHANGE FROM AN AGRICULTURAL EXEMPT STATUS, THE
PROPERTY OWNER WILL BE RESPONSIBLE FOR THE COST ASSOCIATED WITH SECURING THE
APPROPRIATE BUILDING PERMITS AND INSPECTIONS REQUIRED FOR THE EXISTING
STRUCTURE."
The current use of the building is in violation of Section 29-3-320 of the Weld County Code. Failure to submit
the appropriate building permit and all applicable documentation within 10 days from the date of this letter will
result in a violation notice and is subject to go before the Board of County Commissioners with written notice.

PRE -APPLICATION REVIEW REQUEST
• The pre -application request is the preliminary review of a land use proposal. Pre -application reviews are required
prior to beginning the application process; however, this review is not an application.
• Pre -application reviews are held with the Weld County Departments of Public Works and the Public Health and
and Environment. The second and fourth Friday of any given month pre -applicant reviews are held in the
Southwest Service Center office at 10:30 a.m., 11:30 a.m., 1:00 p.m., 2:00 p.m. and 3:00 p.m. Pre -Application
reviews are held Thursday of any given week in the Greeley office. To be on the pre -submittal agenda, the request
and required checklist items must be received one week prior to the review date, and shall include at a minimum, a
description of the property including surrounding lands and land uses, property owners name and contact
information, a brief narrative and a map delineating the property location, in addition to the other items listed.

Good morning Bethany,
Per your request, here is a summary of the information we discussed. The Steinke property, located at 12922
County Rd 1, is currently located within unincorporated Weld County; however, this property is currently being
considered for annexation to the City of Longmont. City Council has referred the West Union annexation
application through the review process; the review is going on now. The review period for annexations is typically
about 6 to 8 months. I believe the goal is to get through the process by the end of the year.

AGAINST RODGER AND FRANCIS STEINKE FOR VIOLATION OF THE WELD COUNTY
CODE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Rodger and Francis Steinke, VI #0400318, are allegedly in violation of the
Weld County Code, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 14th day of December, 2004, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Rodger Steinke, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said violation
back to the Department of Planning Services pending the outcome of the annexation proposal to
the City of Longmont.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that VI #0400318 be, and hereby is, referred back to the Department of Planning
Services.

Dear Jacqueline:
The City of Longmont has received a Notice of' Inquiry form for the Rodger and Francis Steinke
property at 12922 WCR1. This 2 acres parcel is on the east side of WCR1 at the intersection
with 17th Avenue. The Steinke's intend to submit an application to Weld County for a Use by
Special Review permit for a home -based electrical business with 8 employees. A conversation
with Mr. Steinke revealed that he does not intend to either expand any existing buildings or
parldng areas. According to Mr. Steinke, the only improvements planned are interior
remodeling.
Weld County's Notice of Inquiry form asks whether the City of Longmont wants this site to
develop within the City. Dale Bruns has indicated that the Steinke property will be part of an
upcoming annexation ret:brral request to the Longmont City Council (also including the Adrian,
Bogott, and Willis properties).
The Steinke's intent to operate a home -based electrical business with 8 employees will not
trigger a City of Longmont request for annexation at this time. Consequently, the City
respectfully requests that Weld County process the application for a Use by Special Review
permit, and that when the City receives that particular referral, we will comment an its substance
at that time. Also, since our underetsmiling is that the Steinke property will be part of a larger
request for annexation that includes several properties on the east side of Weld County Road 1,
the City will consider the annexation of this property as part of that larger annexation request.
