WHEREAS, it has been determined by the Board of County Com-
missioners, Weld County, Colorado, that a certain tract of land being
the porperty of Alfred and LaVerne Viefhaus, Route 1, Box 249D, Kersey,
Colorado, and more particularly described as follows:
Those portions of the Southeast Quarter of Section 32,
Township 5 North, Range 64 West of the 6th Principal
Meridian, County of Weld, State of Colorado, more

does not come within the purview of the definition of the terms "subdivision"
and "subdivided lands" as set forth in 1973 C.R.S. 30-28-101 (10), as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, has studied the request of the petitioner and
studied the recommendations of the Weld County Planning Commission, and
having been fully informed, now desires to exempt this particular division
of land pursuant to its authority under 1973 C.R.S. 30-28-101 (10) (d) ,
as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove described
tract of land owned by Alfred and LaVerne Viefhaus, Route 1, Box 249D,
Kersey, Colorado, be exempted from the definition of the terms "subdivision"
and "subdivided lands" as provided for in the new Weld County Subdivision
Regulations at Section 2-1, A, (3) adopted August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 23rd day of June,

Re: Recorded Exemption 214
Dear Commissioners:
The attached application, plat, and related items are in reference to
a request by Alfred and LaVerne Viefhaus, for a Recorded Exemption. The
parcel in question is described as part of the SEa of Section 32, T5N,
R64W of the 6th P.M. , Weld County, Colorado. The subject property is
located 2 miles south and z mile west of Kersey. Said property contains
63.75 acres. The request is to split off a 8.95 acre parcel from the
remainder of the parcel . The 54.8 acre parcel would have a house and
the 8.95 acre parcel would have a mobile home as the only improvement.
Based upon the information submitted, the Planning Commission staff recommends
the denial for the following reasons:
1 . The proposed split does not comply with the Weld County
Comprehensive Plan because it would promote non-agri-
cultural use of agricultural land and it would encourage
urban encroachment on rural land use.
2. The recorded exemption request is not in compliance with
the intent clause of the recorded exemption procedure
(Section 9-2 of the Weld County Subdivision Regulations).
Said clause states:
"The intent in establishing the Recorded Ex-
emption procedure is to provide, in accordance
with the Weld County Comprehensive Plan,
a means whereby non-productive agricultural
lands may be developed for higher or more pro-

ductive uses, in-so-far as such uses are com-
patible with surrounding agricultural uses in
areas where such land divisions are proposed.

Soils in this area are Class IV and VI. The granting of the
recorded exemption would allow for the conversion of productive
agricultural lands.
3. The recorded exemption request is not in conformance with the
intent clause of the Agricultural Zone District (Section 3.3 A
of the Weld County Zoning Resolution) which states:
"Intent - The intent in establishing the A-I Agricul-
tural Zone District is to allow all agricultural
and related uses in those areas in which agriculture
is and should continue to be the predominant land
use. This district is intended to discourage
encroachment of incompatible uses upon the agri-
cultural land in the district, to encourage agri-
cultural uses as the highest and best use of the
land in the district as compared with other uses
in conflict therewith, and to provide for the
orderly expansion of urban growth in conformance
with the Weld County Comprehensive Plan. "
The request would not be encouraging agricultural uses as the
highest and best uses, it would not be providing for the orderly
expansion of urban growth, and it would be breaking up a large
block of land.
If this request is approved by the Board of County Commissioners, then it
is recommended by staff that approval of the Recorded Exemption be subject
to the applicant being granted approval from the Board of Adjustments for
a variance from the requirement of 180' frontage onto a county road.
