MINUTES
WELD COUNTY COUNCIL
March 31, 1976
The Weld County Council met in special session in full
conformity with the Weld County Home Rule Charter at
401 N. 15th Avenue, Greeley, Colorado, on Wednesday,
March 31st at the hour of 2 o'clock.
ROLL CALL: The meeting began with an invocation by John T. Martin,
President, and on roll call the following members were presents
President, John T. Martin
Vice President, Nancy Clark
Councilman Floyd Oliver
Councilman Lacy Wilkinson
Councilman Bob E. White
Also present: Bonnie Hickman, secretary and four members of
the press. Norman Carlson, County Commissioner also attended.
MINUTES: Approval of the minutes for March 17th were postponed until
the next regular meeting of April 7th.
REPORTS
CORRESPONDENCE: Mr. John Martin read a letter from District Attorney
Bob Miller pertaining to the possible advancement of the Home
Rule Law Suit. Mr. Miller suggesteu that the Council should
still utilize the Court date previously set, April 13 at
3:30 p.m., and at that time file a motion to dismiss all or
most of the allegations in the Plaintiff's complaint based
upon the passage of the recent Home Rule legislation. Mr.
Miller thought that this case would be resolved no later than
May or June. It will be necessary for the Council to meet
with Mr. Miller to go over the various grounds of the Motion
to Dismiss and will notify the Council of that date.
FINANCE COMMITTEE REPORT: Lacy Wilkinson presented a report on the
authority and operations of the Purchasing Agent of Weld
County. The two part report dealt with procedures that were
currently being adhered to by county officials in matters of
purchasing and bidding and nine guidelines were offered as to
specific improvements needed. Each item on the preliminary
report was evaluated.

Throughout the evaluation several topics were discussed. The
ten day waiting period for accepting of bids was one issue of
concern. Mr. Norman Carlson presented the Council members
with a copy of Mr. Lee Shehee's letter stating his disapproval
of the waiting period. Mr. Carlson explained the purpose of
the ten day waiting period.
A short discussion ensued on the issue of the County purchasing
motor vehicles in November of 1975, but actual payment being
done from the 1976 budget. Bob White also voiced his concern on
who should be involved in choices of equipment in purchasing.
He felt that those people who know and work with the equipment
should be considered in the bidding procedures.
Discussion followed on the procedure for purchasing items of
$100 or less. Several thought that all purchase orders should
be approved previous to any purchase. Other thought that the
current procedure was sufficient and provided for "emergency"
purchases.
Bob White expressed appreciation on behalf of the Council for
the excellent work Mr. Wilkinson did in preparing the report
for review. The revised copy will be presented at the April
7th meeting for final approval. Bob White made a motion that
the Council invite the Commissioners to meet with them at the
next regular meeting to review the final report the first
Wednesday in April. Nancy Clark seconded. Addendum to the
motion - also invite the head of the Finance Department. The
Council also decided to meet one half hour early before the
next regular meeting for finalization and approval of the report
before presenting it to the Commissioners.
Nancy Clark stated that she would like to see a protocol of
procedures drawn up for County employees regarding department
purchasing of items under $100.
MISCELLANEIOUS REPORTS: John Martin presented a report he prepared on
the Council's past participation in the event of hiring of a
County Attorney. It was requested that each Council member
personally review the report and be prepared to comment on it
next Wednesday. Nancy Clark also presented a report on the
Geographical Areas in regard to setting up districts and requested
the same procedure be done.
SALARY SETTING: Floyd Oliver suggested the Council find out if it has
the authority to set the District Attorney's salary. The
secretary was instructed to write to Mr. Miller and ask his
legal opinion as to the Council's authority in this matter.

In setting of salaries, Bob White reminded the Council that
they can only determine salaries and not fringe benefits.
Fringe benefits for County employees amounts to 16-17% plus
extra allowances for mileage. The secretary was instructed
to gather information on the salaries of all elected officials,
including any fringe benefits and any policy of vacation and
leave time.
There being no further business, Lacy Wilkinson made a motion, seconded
by Nancy Clark, to adjourn the meeting. Meeting adjourned by the president.
