With regard to the dairy's discharge permit (COA-931039), the Ag Program wanted to make sure that Weld Co. is aware that the permit coverage was suspended on March 14, 2008. This means that the while the dairy's permit has not been terminated, the dairy does not presently have protection under the permit for a discharge, whether large or small (in essence, the dairy is in the same position as a non -permitted CAFO). While the permit is suspended, any discharge of a pollutant by the dairy to waters of the U.S. will be a violation of the Colorado Water Quality Control Act as a discharge from a point source without a permit. take care Ron Jepson Environmental Ag Program Colo.
