The Weld County Public Works Department has reviewed this proposal. This project falls primarily under the
purview of the Use by Special Review Standards, Weld County Code, Chapter 23, Article II, Division 4, Section
23. Staff comments made during this phase of your USR process may be all-inclusive, as other concerns or
issues may arise during the remaining application process. Our comments and requirements are as follows:
COMMENTS:
Weld County Strategic Roadway: (December 2002) WCR 74 is classified by the County is a Strategic
Roadway, which requires a 140 -foot right-of-way at full build out. There is presently a60 -foot right-of-way. This
road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-
90), the required setback is measured from the future right-of-way line. (WCRs 7, 9, 5, 11, 13, 22, 24, 27, 37,
49, and 74).
eld County Road 49 and 47 Arterial Corridor Study: WCR 49 and 47 are classified by the County as
ajor arterials and require 140 -foot of right-of-way. These roads are maintained by Weld County. Pursuant to
e definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required setback is measured
from the future right-of-way line.
Average daily traffic count (ADT): Out most current traffic counts were taken in 2006, WCR 47 between
WCR 72 and WCR 74. The account reflects between 150 and 160 vehicles taken in a 72 -hour period. WCR
74 between 47 and WCR 49, the count reflects approximately 1300 vehicles taken in a 72 -hour period.
REQUIREMENTS:
Setback: Pursuant to the definition of SETBACK in the Weld County Zoning Ordinance (23-1-90), the required
setback is measured from the future right-of-way line. The applicant is proposing new structures adjacent to
WCR 47 such as a new milking parlor, scale house, scale, and corral improvements.
Right -of -Way: The applicant shall show on the plat drawing future right-of-way for both WCR 74 and WCR
47. The setbacks to future improvements should be based on future right-of-way line of both roadways.
Access: There is an existing road system east of the concrete ditch this is being utilized for feed alley access
at many locations. The applicant shall work with the Weld County Public Works Department to minimize
access points that are not crucial to the operation.
Parking: There shall be parking or staging of semi -tractor trailers on Weld County roads. Utilize on -site
parking.

mployee Parking: Utilize existing parking locations adjacent to existing and future milking parlor and scale
use area.

Off -Street Parking Spaces: The off-street parking spaces including access drive shall be surfaced with
iiavel, asphalt, concrete or the equivalent and shall be graded to prevent drainage problems. Each space
all be equipped with wheel guards or curb stops where needed to prevent vehicles from extending beyond
boundaries the space and from coming into contact with other vehicles, walls, fences, or plantings.

Dust Suppressant: The additional semi -tractor trailer traffic, employees, and direct access from WCR 47
trigger the existing and proposed traffic count to exceed the 200 vehicles per day threshold to require dust
suppressant. The applicant shall has enter into a Road Maintenance and Improvements Agreement with the
Weld County Public Works Department for applying a dust suppressant chemical on WCR 47 adjacent to the
USR. The BOCC approved this Agreement 08/20/07.
Appendix 8-D in the Weld County Code defines the approved dust suppressant chemical to be used. The
application shall be applied no less than twice a year or more often as determined by the Weld County Public
Works Motor Grader Supervisor.
Storm Water Drainage: The applicant has provided a Management Plan for Nuisance Control. I am referring
this to the Department of Health and Environment as it deals with animal units.
Final drainage construction and erosion controls plans (conforming to the final drainage report) stamped,
signed, and dated by a professional engineer license in the State of Colorado shall be submitted with each
plan (phase). These plans (storm water management plans) shall be based upon urban drainage methodology.

The Weld County Department of Public Health and Environment has reviewed this application.
We recommend approval of the proposed expanded production area, expanded composting area
and new open lot wastewater impoundment for the dairy with the following recommendations:
Existing development standards for 2"' AmUSR-1282 to he kept in place except for the below
recommended changes/additions:
Remove specific references to sections of Regulation 81 in prior to recording the plat conditions I
& J, which were shown in parenthesis.
The following should he added as a Development Standard:
Prior to use, provide certification by a Colorado Registered Professional Engineer that the
proposed wastewater impoundment meets the liner seepage rate, separation from seasonal high
groundwater, and water well setback requirements for new open lot wastewater impoundments,
found in Colorado Water Quality Control Commission Regulation Number 81.
The composting operation shall comply with Section 14 of the Regulations Pertaining to Solid
Waste Disposal Sites and Facilities (6 CCR 1007-2).
Replace Development Standard #13 from 2nd AmUSR-1282 with the following:
Land application of manure and wastewater shall he made at agronomic rates using practices and
procedures, which are protective of ground and surface waters. Land applications shall he in
accordance with the facilities Manure and Wastewater Management Plan, Facility Management
Plan, or Nutrient Management Plan. There shall he no discharge from land application areas
except for agricultural stormwater.
Remove Development Standard #30
Applicant must amend the Management Plan for Nuisance Control to include a specific
commitment to water and/or treat the internal haul roads for dust control. Applicant should
commit to additional and ongoing efforts to minimize stormwater run-on from adjacent property.

1 A building permit application must be completed and two complete sets of plans including
engineered foundation plans bearing the wet stamp of a Colorado registered architect or
engineer must be submitted for review. A geotechnical engineering report preformed by a
registered State of Colorado engineer shall be required.
2 A plan review shall be approved and a permit must be issued prior to the start of construction.
3 Setback and offset distances shall be determined by the 2006 International Building Code
(Offset and setback distances are measured from the farthest projection from the structure).
4 Buildings located within a 100 year flood plain require a Flood Hazard Development Plan.
5 A letter is required from the Fire District to ascertain if a FPD permit is required.

Mr. Gathman
In reference to above referral the fire district feels that we have inadequate water supply
compared to fire load at this business location. As of now we have one (1) over head fill on the
property that ran out after approx. 10,000 gallons of water on the last incident at Johnson's Dairy.
Because of the amount of fuel stored and utilized on the property the fire district is asking for
atleast one (1) fire hydrant be placed. The capabilities shall be atleast 500 gallons per minute.
Location if only one is placed , shall be between the 2 parlors and on County Rd 47. If Mr.
Johnson so chooses to place 2 hydrants, in front of each parlor would be ideal.

capable of supplying required fire flow for fire protection shall be provided to all premises upon
which facilities, buildings or portions of buildings are hereafter constructed or moved into or within
the jurisdiction. When any portion of the facility of buildings or portions of buildings are hereafter
constructed or moved into or within the jurisdiction. When any portion of the facility or buiding
protected is in execess of 150 feet from a water supply on a public street, as measured by an
approved route around the exterior of the facility or building, on -site fire hydrants and mains

On May 28, 2009 we received a letter from your office regarding the captioned Amended Use by
Special Review #1282 permit with Weld County on the Johnson Dairy property. The expansion of
the Johnson Dairy Farm as depicted in the plat provided by your firm, does not cause Petro -Canada
Resources (USA) Inc. ("PCR") any immediate concerns with the proposed expansion as long as:
a) PCR's ability to service our existing wells and tank batteries as shown on the attached
Exhibit "A" is not disrupted and;
b) PCR's future drill site location in the center of the SW/4 of section 1-6N-R65W and all
associated facilities, as shown on Ex. A is protected.
Please review our above concerns and let me know prior to your hearing on July 7, 2009 if the
above stated accommodations can be met.

Hi -
At your request, Chris Gathman with Weld Planning gave me a call and we talked about the
Johnson Dairy USR/permit, etc. Thanks for having him call.
With regard to the dairy's discharge permit (COA-931039), the Ag Program wanted to make
sure that Weld Co. is aware that the permit coverage was suspended on March 14, 2008.
This means that the while the dairy's permit has not been terminated, the dairy does not
presently have protection under the permit for a discharge, whether large or small (in
essence, the dairy is in the same position as a non -permitted CAFO). While the permit is
suspended, any discharge of a pollutant by the dairy to waters of the U.S. will be a
violation of the Colorado Water Quality Control Act as a discharge from a point source
without a permit.
