Would you please reconsider your request for a final drainage report and historical flow patterns. We feel that these conditions would be more appropriate at the Site Plan Review. We do not know what business will be going on the site. Don Dunker had indicated in the pre -application meeting that these would be asked for at the Site Plan Review. Am I missing something? Our comments and requirements are as follows: COMMENTS: WCR 20 is designated on the Weld County Road Classification Plan (FHU) as a local gravel road, which requires a 60 -foot right-of-way at full build out. There is presently a 60 -foot right-of-way. The road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Code, Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line. Highway 85 is under the jurisdiction and maintenance of CDOT. REQUIREMENTS: he applicant shall indicate specifically on the plat the type of right-of-way/easement and indicate whether it is dedicated, private, or deeded to provide adequate access to the parcel. Utilize the existing access. A final drainage report stamped, signed, and dated by a professional engineer licensed in the State of Colorado is required and shall conform to Weld County code. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. The right-of-way or easement shall be a graded and drained road to provide an all-weather access. Director Re: CZ -1151 — Change of Zone from A to PUD with C-3, C-4, I-1,1-2 and 1-3 Zone Districts Dear Ms. Hatch: The referrals do not appear to qualify as a "subdivisions" as defined in Section 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 memorandum to county planning directors, this office will only perform a cursory review of the referral information and provide comments. The comments do not address the adequacy of the water supply plan for the projects or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or the physical availability of water. According to the referral information, proposed lot A will be served by a proposed well to be constructed under well permit no. 67623-F and lot B will be served by a well constructed under well permit no. 214858. Well permit no. 214858 was issued on December 17, 1998 pursuant to CRS 37-92- 602(3)(b)(I) and the policy of the State Engineer dated 4/9/85. The permitted use of the well is drinking and sanitary purposes for a commercial business. Water from the well cannot be used for lawn or landscape irrigation or for any other purposes outside the business building structure. The well can be used to serve proposed lot B as long as the well is operated in accordance with the terms and conditions of the well permit. Since the referral information did not clearly specify the proposed uses of the site our office is unable to comment on whether those uses are consistent with the permitted uses of the well. Well permit no. 67623-F was issued on October 17, 2008 pursuant to CRS 37-90-137(4). The permitted use of the well is industrial and commercial purposes. The maximum pumping rate allowed by the well permit is 200 GPM and the allowed annual withdrawal is 1.2 acre-feet. Once the well is constructed, it can be used to serve proposed lot A as long as the well is operated in accordance with the terms and conditions of the well permit. Since the referral information did not clearly specify the proposed uses of the site our office is unable to comment on whether those uses are consistent with the permitted uses of the well. Department of Public Health and Environment CASE NO.: CZ -1151 NAME: Kristi Walker The Weld County Department of Public Health and Environment has reviewed this proposal. The application is to change the zoning from Agricultural (A) to PUD (Planned Unit Development) on a 12.3 acre site. Lot B contains an existing Tote -A -Shed business and is served by a commercial well (214858) and an Individual Sewage Disposal System (SP -9900337). Lot A is currently vacant; however a commercial/industrial well permit has been issued for the parcel (67623-F). An individual sewage disposal system will be installed when a business is located on the property. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: 1. Water service shall be obtained from an appropriately permitted well. 2. A Weld County Septic Permit is required for any septic system and shall be installed according to the Weld County Individual Sewage Disposal Regulations. Please note, the lot owners shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sewer line. In accordance with the Weld County Code, if a sewer line exists within 400 feet of the property and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. 3. A stormwater discharge permit may be required for a development/redevelopment /construction site where a contiguous or non-contiguous land disturbance is greater than or equal to one acre in area. Contact the Water Quality Control Division of the Colorado Department of Public Health and the Environment at www.cdphe.state.co.us/wq/PermitsUnit for more information. 4. During development of the site, all land disturbances shall be conducted so that nuisance conditions are not created. If dust emissions create nuisance conditions, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 5. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 6. This application is proposing wells as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. commercial use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. We strongly encourage the applicant to test their drinking water prior to consumption and periodically test it over time. 1 Hello
