PROGRAM FOR U.S. HIGHWAY 85 COALITION AND AUTHORIZE ELECTRONIC
SUBMITTAL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Application for the Energy and Mineral
Impact Assistance Program for the U.S. Highway 85 Highway Coalition from the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf
of the Department of Public Works, to the Colorado Department of Local Affairs, commencing upon
full execution, with further terms and conditions being as stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Application for the Energy and Mineral Impact Assistance Program for
the U.S. Highway 85 Highway Coalition from the County of Weld, State of Colorado, by and
through the Board of County Commissioners of Weld County, on behalf of the Department of Public
Works, to the Colorado Department of Local Affairs be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the electronic submittal of this application
be, and hereby is, authorized.

This project consists of hiring a consultant to prepare a regional comprehensive plan for the US 85 Corridor. The
communities along the corridor have supported the creation of the U.S. Highway 85 Coalition, which recognizes and
values the US 85 corridor as a regional economic development center and the backbone of northern Colorado. This
project will define a corridor boundary and recommend baseline standards for land use planning tools to implement in a
50 -year visioning process.
b. Brief Description of how this project addresses the Community's Documented or Demonstrated Need:
(Is the project a benefit to public health [e.g. improve water quality, provide for a more reliable quantity of water]; or does the project
improve the effectiveness or efficiency of services [e.g. by improving the drainage system, upgrading the financial records system, adding

This proiect directly benefits all the communities along the US 85 Corridor, including Union Pacific Railroad and the
Colorado Department of Transportation. The Regional Comprehensive Plan will expand on the efforts of the US 85
Access Control Plan and prioritize proiects that will enhance the safety of the corridor in all the communities.

D. PROJECT INFORMATION.
The statutory purpose of the Energy and Mineral Impact Assistance program is to provide financial
assistance to "political subdivisions socially or economically impacted by the development. processing or
energy conversion of minerals and mineral fuels."
1. Energy/Mineral Relationship/Social and Economic Impact.
a. Describe how the applicant is, has been, or will be impacted by the development, production, or conversion of
energy and mineral resources. Last year, Weld County issued over 1,100 oil and gas permits, ranking as
one of the most productive areas in the State. Weld County has over 21,000 oil and gas wells dispersed
throughout the county with over 15,000 of these being active wells. According to DPT, this represents
over fifty (50) percent of all active wells in Colorado. Tangible impacts created by this production are
seen by increases in roadway utilization and intensity of use. Affects to the 85 Corridor are clearly
evident and perhaps the most tangible impacts to view. All the communities along this corridor are
impacted by the oil and gas industry and transect the Wattenburg field.
b. To further document the impact in the area, name the company or companies involved, the number of
employees associated with the activities impacting the jurisdiction and other relevant, quantitative indicators
of energy/mineral impact. Between FY 2000-2007, Weld County averaged 230 oil and gas permits per
year. This trend changed in 2006 when 618 oil and gas permits were issued in Weld County. The
number of permits issued continues to increase each year. In 2008, Weld County issued 1,134 oil and
gas permits. To date, Weld county ranks as the number one home to oil and gas workers by
capturing almost 30% of all oil and gas workers reported in the State.
2. Project Significance/Demonstration of Community Need.
a. Why is the project needed at this time? This project is needed to ensure regional that functionality,
safety, accesses, economic development and aesthetic enhancements are preserved along this
corridor.
b. How does the implementation of this project address the need? The US 85 Corridor generates anywhere
from 15,000-25,000 ADT, and since transportation and land use are interrelated the goal of this project
is to create a unified, regional land use vision that maximizes the corridor. By creating a vision for
this region, municipalities within the 85 Corridor can ensure quality infrastructure and development
through a coordinated effort.
c. Does this project, as identified in this application, completely address the stated need? If not, please
describe additional work or phases and the estimated time frame. Do you anticipate requesting Energy and
Mineral Impact Assistance funds for future phases? At this time, the project request is only for a
planning document. However, the comprehensive plan could recommend future construction
projects that would enhance or maintain the integrity of the corridor, so future funding may be
necessary to ensure adequate levels of service are being maintained.
d. What other implementation options have been considered? This effort is the first step towards regional
implementation.
e. What are the consequences if the project is not awarded funds? A regional vision will not be established
and instead of multi -jurisdictional cooperative visioning, each municipality's decision making ability
will be based on a local perspective rather than a global viewpoint. Lack of consistent planning for
this corridor results in an inefficient transit corridor plagued with inadequate speeds and numerous of
access issues.
3. Local Commitment.
a. Why can't this project be funded locally? Due to the scope of work, this effort is too large for one
community to absorb financially. Elected Officials formed the US Highway 85 Coalition July 2009 to
send a strong message that the 85 Corridor is important to the long-term health and welfare of the
region. As a result, the communities have come together collectively to support funding this regional
comprehensive plan.

b. Explain the origin of your local cash match. (Note: Whenever possible, local government cash match on a
dollar for dollar match basis is encouraged.) Local cash match is from the general fund.
c. Describe any in -kind contributions by type and value. How were the in -kind services valued? (If in -kind
contributions are included in the project budget, detailed tracking will be required on project monitoring
reports). Weld County will provide the overall project management for this grant.
d. Has the applicant dedicated the financial resources in their current budget, reserve funds and/or unused debt
capacity that are being used for the local matching funds? Yes X No_ Explain if No:

Has the applicant requested financial support from the industry and to what success? Not at this time.
4. Relationship to Community Goals / Increased Livability of Community.
The next series of questions attempts to more clearly understand how your community
development/capital development project improves the livability of your community. Livability means,
increasing the value and/or benefit in the areas that are commonly linked in community development
such as housing, jobs, infrastructure benefit, transportation, education and environment.
a. Is the project identified in the applicant's budget or a jurisdictionally approved plan (e.g. capital improvement
plan, equipment replacement plan, comprehensive plan, utility plan, road maintenance and improvement plan
or other local or regional strategic management or planning document)? What is its ranking? This project is
a multi -jurisdictional comprehensive plan effort that Weld County is taking the lead on.
b. Has this project been deferred because of the lack of local funding? If so, how long? This is a new project
that has not been considered before.
C. What other community entities, organizations, or stakeholders recognize the value of this project and are
collaborating with you to achieve an increased livability of the community? What measurable outcomes will
demonstrate the increased livability because of the implementation of this project? Please describe how your
partners are contributing to achieve the improvement to the livability of the community through this project.
i. Please describe the level of commitment by each collaborator. (e.g. fee waivers, in -kind services,
fundraising, direct monetary contribution, policy changes.) Weld County is partnering with five to six
communities along this corridor. Attached are copies of each entities Resolution for Support of
creating the US Highway 85 Coalition. All of these communities are willing to contribute
financially to this effort, and finalization of those amounts will be determined in the near future.
ii. Please list the value the resources that each collaborator is bringing to the program. The specific
monetary values for each community are still being discussed during this current budget process.
5. Management Capacity / Readiness To Go.
a. Assuming this project is funded as requested, how soon will the project begin? What is the time frame for
completion? If awarded, RFP's would be solicited immediately and awarded by the end of the year.
The planning effort would take all of next year with a completion date approaching December of 2010.
b. How will you separate and track expenditures, maintain funds and reserves for the capital expenditures and
improvement as described in this project? Weld County utilizes software designed to track project
expenditures.

c. Describe the funding plan in place to address the new operating and maintenance expenses generated from
the project? N/A
d. Describe the technical and professional experience/expertise of person(s) and/or professional firms
responsible to manage this project. Weld County, including the associated communities, all have several
staff that can provide professional skills in hiring and working with a consultant to perform this task.
e. Describe how your facility will meet the energy standards specified in C.R.S. 24-30-1301 - 1305, if applicable?
How were these measures determined to be appropriate? Are the measures cost-effective? What is the
estimated time for return on investment? Not applicable to this planning effort.
f. Describe how you determined that the project can be completed within the proposed budget as outlined in this
application? Are contingencies considered within the project budget? Weld County has proven expertise in
planning projects, such as this one.

6. Measurable Outcomes.
a. Describe measurable outcomes you expect to see when implementation of this project is complete. How will
the project enhance the livability of your region, county, city, town or community (e.g. constructing a new
water plant will eliminate an unsafe drinking water system and provide safe and reliable drinking water; the
construction of a new community center will provide expanded community services, or projects involving
energy conservation, community heritage, economic development/diversification, traffic congestion)? This
project is exceptionally distinct because of the unique collaborative effort of all the communities
along the US 85 Corridor willingness to participate. This joint effort will generate a planning
document to be adopted and implemented by all parties. The intent of the regional plan is for the
communities to implement the vision so the vitality of the corridor can be preserved for future
improvements, such as multi -modal facilities, employment centers, baseline design standards,
aesthetic enhancements, and most of all safety improvements.
b. How many people will benefit from the project? (i.e., region, county, city, town, community, subdivision,
households or specific area or group; or any portion thereof) Being this is a regional effort, all the
residents from Brighton north to Ault, as well as any user of Highway 85 will benefit from this
planning effort.
c. How will the outcome of the project be measured to determine whether the anticipated benefits to this
population actually occur? The intent of this project is to have all the partners enter into an
Intergovernmental Agreement adopting the Regional Comprehensive Plan.
E. TABOR COMPLIANCE.

All Weld County ad valorem tax levies for county purposes, when applied to the total valuation for

provide for the payment of bonds and interest thereon.
