RESOLUTION
WHEREAS, a public hearing was held on June 9, 1975, in the
chambers of the Board of County Commissioners, Weld County, Colorado,
for the purpose of hearing the petition of Goodell Brothers, Inc. , Box 427,
Eaton, Colorado, requesting a change of zone from "A-I" Agricultural
District to "C" Commercial District, Planned Unit Development, and
WHEREAS, the petitioner was represented, and
WHEREAS, there was no opposition to the change of zone, and

WHEREAS, the Board of County Commissioners heard all the
testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioners and studied the recommendations of the Weld
County Planning Commission as submitted, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the petition of Goodell Brothers, Inc. , Box 427,
Eaton, Colorado, for change of zone from "A-I" Agricultural District to
"C" Commercial District, Planned Unit Development, said area being
more particularly described as follows:
That portion of the Southeast Quarter of Section
25, Township 7 North, Range 66 West of the 6th
Principal Meridian, County of Weld, State of
Colorado, more particularly described as follows:
Considering the South line of said Southeast
Quarter as bearing West with all other bearings
contained herein relative thereto.
Beginning at the Southeast corner of said South-
east Quarter; thence along the South line of said
Southeast Quarter West 630. 00 feet; thence parallel
with the East line of said Southeast Quarter North
0°39'01" East 350. 00 feet; thence parallel with said
South line East 630. 00 feet to said East line; thence
along said East line South 0039'01" West 350. 00
feet more or less to the Point of Beginning.
The above described parcel contains a gross
acreage of 5. 06 Acres more or less and a net
acreage (exclusive of road right of ways along east
and south ) of 4. 41 acres, more or less, and
is hereby granted under the conditions following:
1. That any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. All applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the zoning resolutions
of Weld County, Colorado.
3. That said change of zone herein granted is conditional only for
a period of twelve months from date hereof, on condition that developer

proceed with due diligence to begin developement of the area rezoned and
submit plans for such development for the approval of the Weld County
Planning Commission and subsequent recording of said plans in the office
of the County Clerk and Recorder of Weld County, Colorado; and that
major construction shall commence thereof within said twelve month
period; otherwise, the County may take action to rezone the property to
its present classification.

I have reviewed the proposed rezoning application of
Goodell Brothers Inc. , for zone change from agricultural
to commercial and the following are my recommendations .
1 . That only one access to County Road 76 be approved.
2 . That the access be located at least 200 ft . west 4..-77„
of the SE corner of the SE a oT Section 25 , with
the exact location to be determined by field in-
spection .
3 . That proper drainage structure be placed underneath
the proposed access if necessary . The size of the
culvert to be determined by field inspection .
® That any damage sustained to the County Road 76 due
to movement of heavy equipment onto or out of this site
be corrected by Goodell Brother Inc.
That any change to the existing terrain of this ground,
such as grading or paving of parking lots be reviewed
and approved by the County Engineering Department .
6 The existing drainage from the site should not be changed
or altered .
