RE: EXTENSION OF DEADLINE FOR SUBMITTAL OF APPLICATIONS FOR QUINQUENNIAL
FINDINGS OF REASONABLE DILIGENCE FOR BEEBE DRAW FARMS METROPOLITAN
DISTRICTS NOS. 1 AND 2
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on April 29, 2009, the Board approved Resolution #2009-1028, which required
that the Boards of Directors of Beebe Draw Farms Metropolitan Districts Nos. 1 and 2 ("Metro
Districts") submit to the Board of County Commissioners, within sixty (60) days of receiving a copy of
said Resolution, applications for quinquennial findings of reasonable diligence for Beebe Draw
Farms Metropolitan Districts Nos. 1 and 2, including certain required information, and
WHEREAS, the Metro Districts received a copy of Resolution #2009-1028 on May 7, 2009,
which therefore set the due date for said submittal of applications and information at July 6, 2009,
and
WHEREAS, the Metro Districts submitted a letter dated June 11, 2009, requesting that the
due date for submittal be extended to August 6, 2009, and the Board deemed it advisable to grant
such extension at the hearing conducted on June 22, 2009, and
WHEREAS, the Metro Districts submitted a letter dated July 31, 2009, a copy of which is
attached, requesting that the due date for submittal be extended to September 9, 2009, and the
Board deems it advisable to grant such extension.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the time for submittal of applications for quinquennial findings of reasonable
diligence for Beebe Draw Farms Metropolitan Districts Nos. 1 and 2, including certain required
information be, and hereby is, extended to and until 5:00 p.m., on September 9, 2009.

Re: Beebe Draw Metropolitan District Nos. 1 and 2, Request for Quinquennial Review
Dear Commissioners:
As you know, the Board of County Commissioners ("County") by Resolution dated April 29,
2009 required the Boards of Directors of Beebe Draw Farms Metropolitan District No. 1
("District No. 1") and Beebe Draw Farms Metropolitan District No. 2 ("District No. 2") to
submit to the County applications for quinquennial findings of reasonable diligence
("Quinquennial Application"). The original deadline to submit the written application to the
County was July 6, 2009. On June 22, 2009, the County granted a request from District No. 1
and District No. 2 to extend the deadline to submit the written application to August 6, 2009.
Since our request of June 11, 2009, the Districts have been working cooperatively with County
staff, Jeff Hare and other members of the community in an effort to fully address concerns of the
County and residents and to discuss potential solutions in the best interests of the community and
the Districts. In addition, District No. 2 representatives have met almost weekly with its
consultants who have been working diligently to prepare financial information to submit with the
Quinquennial Application. The Executive Committee created by the Districts has also held
numerous working sessions to review information and provide direction to the District Boards.
Most recently, the Board of Directors of both District No. 1 and District No. 2 held a public
meeting on July 30, 2009 to discuss the Quinquennial Application and potential solutions with
the community.

We believe the Districts and the community have made great progress over the past few weeks
and have furthered a positive relationship that we hope will result in solutions in the best interest
of all involved. In order to continue to work with the community on issues raised, we
respectfully request the deadline for responding to the Quinquennial Application be extended 45
days to September 21, 2009. We hope during that time to develop a solution to present jointly
with the District residents. If, however, we are continuing positively with discussions, it may be
necessary to request an additional extension. Thank you for your consideration of this request.

Bruce,
I liked to voice my support for an extension on the quinquennial review process for Beebe
Draw Farms Metro District. The discussions that are happening are healthy, productive, and
hopeful. I think it makes sense to keep a short leash on the extensions to hold all parties
accountable. My recommendation is that the extension be for 30 days. If all parties seem to
be making good progress on the proposed restructuring and the 30 days doesn't seem sufficient
to come to terms at a high level, then we can always request an additional extension.
