RE: APPROVAL OF RECORDED EXEMPTION NO. 314 - CLARENCE A., LUCILE
R. , EARL A. AND LUELLA J. ANDERSON.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 10th day of April , 1978 , in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the plat
known as Recorded Exemption number 314 , being the property of
Clarence A. , Lucile R. , Earl A. and Luella J. Anderson, described
as the W1 of the SW4 of Section 18 , Township 6 North, Range 65 West
of the 6th P.M. , Weld County, Colorado, being more particularly
described as follows :
The West Half of the Southwest Quarter of Section Eighteen,
Township Six North, Range Sixty-five West (W' SAT Sec.18
T6N, R65W) of the Sixth Principal Meridian, Weld County,
Colorado
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-lA (3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Clarence A. , Lucile R. , Earl A. , and
Luella J. Anderson, be and hereby is, exempt from the definition of

the terms, "subdivision" and "subdivided land" pursuant to its
authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 10th day of
April, A.D. , 1978 .

Dear Commissioners :
The attached application , plat , and related items are in reference to
a request by Clarence A. Anderson, etal for a recorded exemption . The
parcel of land on which the recorded exemption has been requested is
described as the WI- of the SW* of Section 18, T6N, R65W of the 6th p.m. ,
Weld County , Colorado. The property contains 79. 6 acres of Class I , II ,
and III irrigated soils. This property is located one mile west of
Lucerne. The request is to split the property into parcels of 1.003 acres
and 78. 6 acres . The 78. 6 acre parcel contains an existing set of improve-
ments .
As indicated in a letter dated March 16 , 1978 , Mr. Anderson proposes to
use the 1. 003 acre parcel for a retirement home. The letter further states
this parcel has never been farmed. This particular site was chosen to
avoid using productive agricultural land for a home site.
Based upon the information submitted and adopted policies in the county,
the Department of Planning Services staff recommends the request be
approved for the following reasons :
1. The proposed split conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) , the intent clause of the Agricultural Zone District
(Section 3. 3 A. of the Weld County Zoning Resolution) , and the
Weld County Comprehensive Plan in that non-productive agricultural
land is proposed to be developed for a higher use, the proposed
use would be compatible with the surrounding agricultural uses
and agriculture will continue to be the predominant land use.

2. The Town of Eaton has indicated they have no objections to
this request .
3. The request complies with the provisions of Section 9-4(A)
of the Weld County Subdivision Regulations .

Dear Commissioners:
We are enclosing our application for Recorded Exemption for a parcel of
land within the unincorporated area of Weld County, State of Colorado.
Clarence and Earl Anderson have farmed this eighty acre farm all of their
adult lives. Both were born on the place and have never left it. In 1930 a
new brick house was built to replace the original structure. Mrs. Jennie
Anderson, mother of Clarence and Earl, lived in that house until the time of
her death. Lucile and Clarence Anderson lived with her and the members of the
family still at home for the first two years of their married life. In 1941
a small frame house was built on the farm for Lucile and Clarence and their
family. Lucile and Clarence are still living there. Luella and Earl have
lived in the larger house since the time of their marriage. When Mrs.
Jennie Anderson died in 1968 Clarence and Earl bought the farm from the
estate.
Clarence is almost sixty-seven years old and plans to retire. Many farmers
buy a house in town and move there when they retire. Since Clarence has no
hobbies or outside activities to keep him occupied, he would be much happier
remaining on the home place. In fact his doctor advised him that he would live
longer and remain in better health if he could stay on the farm.
The two brothers as partners decided that the small frame house should
remain with the farm so that a tenant (the person who rents and farms the land)
would have a house in which to live. Clarence and Lucile would like to own their
own home built on a parcel of land separate from the rest of the farm. Earl
and Luella plan to remain living in the brick house even after retirement.
The acre chosen on which to build Clarence's house has never been farmed.
At one time it was an orchard. After the trees were removed, the land was used
for pasture land. It is not the desire of either party of the partnership to
build on good farm land.
