Monday, December 15, 2025
The Board of County Commissioners of Weld County, Colorado, met in regular session
in full conformity with the laws of the State of Colorado at the regular place of meeting in
the Weld County Administration Building, Greeley, Colorado, December 15, 2025, at the
hour of 9:00 a.m.
Roll Call: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Perry L. Buck, Chair
Commissioner Scott K. James, Pro-Tem
Commissioner Jason S. Maxey
Commissioner Lynette Peppler
Commissioner Kevin D. Ross
Also present:
Acting Clerk to the Board, Houstan Aragon

Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board
of County Commissioners meeting, as printed. Commissioner Peppler seconded the
motion and it carried unanimously.
1. Minutes from December 1, 2025
Amendments to Agenda: There were no amendments to the Agenda.
Consent Agenda: There being no request for public testimony concerning the following
item, as listed under `Consent Agenda — Miscellaneous', Commissioner Maxey moved to
approve the Consent Agenda, as printed. Commissioner James seconded the motion and
it carried unanimously.
1. Partial Vacation, VAC25-0025, of Four-Lot Recorded Exemption, RECX17-0126,
for Removal of Lot D — Jason and Joelle Brent

Presentations and Proclamations:
1. 2025 Employee Service Awards — 10, 20, and 30-Year Employees: Chair Buck
introduced the presentation for the record and the various Elected Officials and
Department Heads spent approximately the next hour honoring numerous
employees and presenting them with pins for 10, 20, and 30 years of service. The
Commissioners, in turn, thanked the employees for their years of dedication to the
citizens of Weld County.
(Clerk's Note: Chair Buck recessed for five (5) minutes, and the meeting
reconvened at 10:12 a.m.)
Warrants:
1. General Warrants: Commissioner Maxey moved to approve the General
Warrants, as printed. Commissioner Ross seconded the motion and it carried
unanimously.
Bids:
1. Approve Bid #B2500138, Public Works Soils Lab Relocation and
Renovation — Facilities Department: Toby Taylor, Purchasing Department,
stated staff recommends selecting the lowest bidder who met specifications, Swift
Builders, LLC, for a total amount of $369,137.00. Commissioner James moved to
approve said bid. The motion was seconded by Commissioner Peppier and it
carried unanimously.
New Business — General:
1. Consider Contract ID #10162 Task Order Contract Modification for Local
Public Health Agency (LPHA) Chronic Disease Pilot Program and Authorize
Chair to Sign: Jason Chessher, Director of the Department of Public Health and
Environment, stated the County was awarded grant funds, in the amount of
$100,000.00, to employ community outreach health workers as the backbone of
the mobile unit. Commissioner Maxey moved to approve said contract modification
and authorize the Chair to sign. The motion was seconded by Commissioner Ross
and it carried unanimously.
2. Consider Contract ID#10163 Amendment#2 to Task Order Contract for Local
Planning and Support for Core Public Health Services and Authorize Chair
to Sign: Mr. Chessher stated the amendment reduces grant funds by$125,806.00,
which he indicated was anticipated and offset with operational expenses in 2026,
for a new funding total of$755,610.00. Commissioner Ross moved to approve said
amendment and authorize the Chair to sign. The motion was seconded by
Commissioner James and it carried unanimously.

New Business — Planning:
1. Consider Request to Extend Time to Record Map for Use by Special Review
Permit, USR25-0001 — Wells Ranch, LLLP, c/o Colorado Sand Company II,
LLC: Maxwell Nader, Department of Planning Services, requested on behalf of the
applicant, Wells Ranch, LLLP, c/o Colorado Sand Company II, LLC, to extend
recording of the map for a second time for Use by Special Review Permit, USR25-
0001, resulting from the applicant needing additional time to complete the last few
Conditions of Approval, which are in their final reviews with staff. Mr. Nader further
indicated staff recommends approval. Commissioner James moved to approve
said request. The motion was seconded by Commissioner Peppier and it carried
unanimously.
2. Consider Certification to Weld County Treasurer for County Compliance
Violation Penalties as Special Assessment — Sandra Eskildsen: Adria Schiel,
Assistant County Attorney, requested a two (2)-month continuance to allow the
property owner time to recover from a recent medical issue and resume work
towards bringing the property into compliance. Commissioner Maxey moved to
continue said certification to February 11, 2026, at 9:00 a.m. The motion was
seconded by Commissioner James and it carried unanimously.
3. Consider Certification to Weld County Treasurer for County Compliance
Violation Penalties as Special Assessment — John Krenzelok: Ms. Schiel
reviewed the property location and stated the Weld County Court has assessed
daily penalties, in the amount of $50.00, for multiple violations since 2021. She
further stated the property is still in violation, therefore, staff recommends
certification in the amount of $22,000.00. Nicole Brick, Code Compliance Officer
for the Department of Planning Services, displayed photographs she recently took
reflecting the status of said property and stated the last communication with the
property owner was in March 2025, with no progress on bringing the property into
compliance. There being no property owner present, Commissioner James moved
to approve said certification. The motion was seconded by Commissioner Ross
and it carried unanimously.
4. Consider Certification to Weld County Treasurer for County Compliance
Violation Penalties as Special Assessment — Baudel Tortoledo Hernadez:
Ms. Schiel reviewed the property location and stated the Weld County Court has
assessed daily penalties, in the amount of $25.00, for an unpermitted structure
that does not meet setback requirements since 2021. While Ms. Brick displayed
photographs she recently took reflecting the status of said property, Ms. Schiel
indicated staff has attempted to reach the property owner multiple times with no
success; therefore, staff recommends certification in the amount of$10,850.00. In
response to Commissioner Maxey, Ms. Brick indicated the property owner had
previously submitted a request to the Board of Adjustment but the case was not
approved. Commissioner Maxey moved to approve said certification. The motion
was seconded by Commissioner Ross and it carried unanimously.

5. Consider Certification to Weld County Treasurer for County Compliance
Violation Penalties as Special Assessment — Juan and Silvia Gallardo:
Ms. Schiel reviewed the property location and stated the Weld County Court has
assessed daily penalties, in the amount of $25.00, for multiple violations since
2021. She further stated the property is still in violation, therefore, staff
recommends certification in the amount of $10,975.00. Ms. Brick displayed
photographs she recently took reflecting the status of said property and confirmed
she has not had successful communication with the property owners. There being
no property owner present, Commissioner James moved to approve said
certification. The motion was seconded by Commissioner Maxey and it carried
unanimously.
6. Consider Certification to Weld County Treasurer for County Compliance
Violation Penalties as Special Assessment — Mauro and Louisa Rodriguez:
Ms. Schiel reviewed the property location and stated the Weld County Court has
assessed daily penalties, in the amount of $20.00, for multiple violations since
2022. She further stated the property is still in violation, therefore, staff
recommends certification in the amount of $8,220.00. Ms. Brick displayed
photographs she recently took reflecting the status of said property and confirmed
she has not had successful communication with the property owners. There being
no property owner present, Commissioner Maxey moved to approve said
certification. The motion was seconded by Commissioner James and it carried
unanimously.
7. Consider Certification to Weld County Treasurer for County Compliance
Violation Penalties as Special Assessment — Andres Benjamin Hernandez,
Jr.: Ms. Schiel reviewed the property location and stated the Weld County Court
has assessed daily penalties, in the amount of$40.00, for multiple violations since
2021. She further stated the property is still in violation, therefore, staff
recommends certification in the amount of $17,400.00. Cynthia Villanueva, Code
Compliance Officer for the Department of Planning Services, displayed
photographs she recently took reflecting the status of said property and stated she
has not had successful communication with the property owner. After extensive
dialog among Commissioners Maxey and Ross, Ms. Schiel and Ms. Villanueva
clarified the property boundary lines in relation to ownership, which will be revised
for any later requests for certification on the property should the owner not bring it
into compliance. Andres Benjamin Hernandez, property owner was present,
shared he has suffered with medical issues for the past seven (7) years preventing
him from being capable of cleaning up his property, and indicated he is looking for
assistance through Veterans Affairs. After hearing testimony by staff and the
property owner, the Board extended their sympathies to Mr. Hernandez, but
acknowledged the property has been in violation for a long time and he needs
show significant efforts in cleaning up the property. Commissioner Ross moved to
approve said certification. The motion was seconded by Commissioner James and
it carried unanimously.

8. Consider Certification to Weld County Treasurer for County Compliance
Violation Penalties as Special Assessment — Jose Mendoza: Ms. Schiel
reviewed the property location and stated the Weld County Court has assessed
daily penalties, in the amount of $25.00, for a non-commercial junkyard without a
principal use since 2021. She further stated the property is still in violation,
therefore, staff recommends certification in the amount of $11,025.00.
Ms. Villanueva displayed photographs she recently took reflecting the status of the
property and confirmed there has been no effort to bring the property into
compliance. Commissioner Ross moved to approve said certification. The motion
was seconded by Commissioner James and it carried unanimously.
9. Consider Certification to Weld County Treasurer for County Compliance
Violation Penalties as Special Assessment — Ivy Valdez: Ms. Schiel reviewed
the property location and stated the Weld County Court has assessed daily
penalties, in the amount of$25.00, for parking of commercial vehicles since 2022.
She further stated the property is still in violation, therefore, staff recommends
certification in the amount of $11,050.00. Ms. Villanueva displayed photographs
she recently took reflecting the status of the property and stated staff's efforts to
contact the property owner to discuss Code changes and permitting options have
been unsuccessful. There being no property owner present, Commissioner Maxey
moved to approve said certification. The motion was seconded by Commissioner
Ross and it carried unanimously.
10. Consider Certification to Weld County Treasurer for County Compliance
Violation Penalties as Special Assessment — Daniela Flores: Ms. Schiel
reviewed the property location and stated the Weld County Court has assessed
daily penalties, in the amount of $25.00, for multiple violations since 2022. She
further stated the property is still in violation, therefore, staff recommends
certification in the amount of $11,050.00. Ms. Villanueva displayed photographs
she recently took reflecting the current status of the property. Daniela Flores,
property owner, provided testimony regarding the matter, stated she provided staff
with updated photos showing some progress, and requested a continuance to
allow for more time to bring the property into compliance. In response to
Commissioner James, Ms. Villanueva indicated it appears to be cleaned up a bit,
but she will need to confirm with an in-person visit to the property. Discussion
among Commissioners James, Maxey, and Ross acknowledged the attempt to
rectify the situation but expressed their expectation to Ms. Flores that her property
be cleaned up within the next month. Commissioner James moved to continue said
certification to January 12, 2026, at 9:00 a.m. The motion was seconded by
Commissioner Peppier and it carried unanimously.

Public Comment: No public comment was offered.
Let the Minutes reflect that the above and foregoing actions were attested to and
respectfully submitted by the Clerk to the Board. There being no further business, this
meeting was adjourned at 11 :01 a.m.
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Minutes, on motion duly made and seconded, by the following vote on the
29th day of December, A.D., 2025:
