RE: ALLOW WITHDRAWAL OF PETITION FOR SERVICE PLAN FOR NORTHMOOR
ACRES WATER DISTRICT.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners set a hearing
date of June 28, 1978 at 2 : 00 o' clock p.m. to hear and consider
the petition of the Northmoor Acres Homeowners Association for
a Service Plan for the Northmoor Acres Water District, and
WHEREAS, it has been requested by the Northmoor Homeowners
Association through its attorney, Kim Lawrence, that said petition
be withdrawn and any monies not used for processing the Service
Plan be refunded, and
WHEREAS, the Board of County Commissioners deems it advisible
to allow the withdrawal of the petition of the Northmoor Homeowners
Association, and refund any monies not used for processing the said
Service Plan.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the withdrawal of the
petition of the Northmoor Homeowners Association for a Service Plan
for the Northmoor Acres Water District be, and hereby is allowed,
and any monies not used for processing the said Service Plan be
refunded, and
BE IT FURTHER RESOLVED by the Board that the hearing date of
June 28, 1978, to consider the Service Plan for Northmoor Acres
Water District, be and hereby is , cancelled.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 26th day of
June, A.D. , 1978.

TO THE BOARD OF COMMISSIONERS OF THE COUNTY OF WELD, STATE OF

The Petitioners and Proponents of the proposed NORTHMOOR
ACRES WATER DISTRICT, Weld County, Colorado, by their attorney,
Kim R . Lawrence, pursuant to the provisions of the "Special
District Control Act" , Colorado Revised Statutes 1973 ,
32-1-201, et seq . , respectfully petition the Board of Commissioners
of the County of Weld , State of Colorado, for a Resolution of
Approval and certain other preliminary actions relating thereto ,
for said proposed District .
In support of said Petition ycur petitioners state :
1 . That on the Lrnie day of May, 1978 , there was
filed with the Board of Commissioners of Weld County, a Service
Plan for said proposed District , with additional copies for
consideration by the County Planning Commission .
2 . That such Service Plan fully complies with the
provisions of the "Special District Control Act" , as to all of the
information required to be therein contained.
3 . That petitioners have also accompanied said Service
Flan with a processing fee as provided by law in the amount of
$200 . 00 .
4 . That petitioners have also submitted to the
Board of Commissioners , a copy of the proposed form of Petition
to the District Court for the organization of said proposed
District .
WHEREFORE, Petitioners pray that this Honorable Board
will enter such orders as may be necessary or proper preliminary
to and in connection with a Resolution of Approval of the
Service Plan of said proposed District .

On May 17, 1978 the enclosed copy of the service Plan of the Proposed
Northmoor Acres Water District was filed in our office. The two
hundred dollar check submitted with said plan was deposited with the
County Treasurer, see attached copy of treasurers receipt #3540. We
scheduled the hearing date and authorized the publications of said notice
forthwith. The publication costs paid by the County totaled forty
dollars and ninety eight cents. Said service plan was requested to be
withdrawn and said withdrawl was approved by the Board of County
Commissioners on the 26th day of June, 1978. In order to conclude this
matter, please refund one hundred fifty nine dollars and two cents to
David J. Miller and Associates and supply us with a copy of said
refund check so we may complete our file.

NOTICE is hereby given of a hearing before the Board of
County Commissioners of Weld County, Colorado , on the
28th day of June , 1978 at the hour of 2 : 00 P.M.
in the Weld County Commissioners hearing room, first
floor, Weld County Centennial Center, 915 10th Street,
Greeley, Colorado, for the purpose of considering the
service plan of the proposed Northmoor Acres Water
District. This notice is given pursuant to the Special
District Control Act, Section 32-1-201 , et seq. , CRS
1973.
Copies of the Service Plan are on file at the Office of
the Clerk to the Board of County Commissioners located
on the 3rd floor, Weld County Centennial Center, 915 10th
Street, Greeley, Colorado and may be inspected during
regular business hours .
Within 20 days after the completion of the hearing, the
Board of County Commissioners will consider the approval
of the Service Plan.
All interested parties under the law will be afforded
an opportunity to be heard at said hearing.
