Responsibilities as a Permittee: Upon application approval and permit issuance,this application becomes a legally binding document. You assume legal liability for all reasonable expenses which the Board or the Office may incur to reclaim the affected lands associated with your mining operation in the event your permit is revoked and financial warranty is forfeited; -6- 2. The Board may suspend or revoke this permit, or assess a civil penalty, upon a finding that the permittee violated the terms or conditions of this permit, the Act, the Mineral Rules and Regulations, or that information contained in the application or your permit misrepresent important material facts; 3. If your mining and reclamation operations affect areas beyond the boundaries of an approved permit boundary, substantial civil penalties, to you as pm-mince can result; 21 /` 4. Any modification to the approved mining and reclamation plan from those described in your approved application requires you to submit a permit modification and obtain approval from the Board or Office; 5. It is your responsibility to notify the Office of any changes in your address or phone number; 0/— 6. Upon permit issuance and prior to beginning on-site mining activity,you must post a sign at the entrance of the mine site,which shall be clearly visible from the access road, with the following information (Rule 3.1.12): a. the name of the operator; b. a statement that a reclamation permit for the operation has been issued by the Colorado Mined Land Reclamation Board; and, c. the permit number. 7. The boundaries of the permit boundary area must be marked by monuanents or other markers that are clearly visible and adequate to delineate such boundaries prior to site disturbance. 8. It is a provision of this permit that the operations will be conducted in accordance with the terms and conditions listed in your application,as well as with the provisions of the Act and the Construction Material Rules and Regulations in effect at the time the permit is issued. 1F 9. Annually,on the anniversary date of permit issuance,you must submit an annual fee as specified by Statute, and an annual report which includes a map describing the acreage affected and the acreage reclaimed to date(if • there arc changes from the previous year), any monitoring required by the Reclamation Plan to be submitted annually on the anniversary date of the permit approval. Annual fees are for the previous year a permit is held. For example,a permit with the anniversary date ofJuly 1, 1995,the annual fee is for the period ofJuly I, 1994 through June 30, 1995. Failure to submit your annual fee and report by the permit anniversary date may result in a civil penalty, revocation of your permit, and forfeiture of your financial warranty. It is your responsibility, as the permittec,to continue to pay your annual fee to the Office until the Board releases you from your total reclamation responsibility. NA 10. The coordinates of the west entrance are 40°03 ' 19 . 4074", -104°49 ' 08 . 8772" . A second entrance can be used to reach the mine from the HWY 85 and HWY 52 exit (Ft. Lupton) , go east 0 . 6 mile to Denver Street then south on South Denver St. 2 . 0 miles to WCR 8 . 5 then west on WCR 8 . 5, 0 . 26 mile to the entrance . Please refer to EXHIBITB VICINITYMAP for the property configuration and the relationships to surrounding geological features . The area to be mined lies north of this point on the east of side of HWY 85 . GENERAL LINFORMATION The primary commodities to be mined are sand, gravel, topsoil, overburden, and borrow materials . No incidental commodities will be produced at this mine . The mine will be operated as a Single Stage with the maximum allowed disturbance not to exceed 45 . 46 acres . The area will be backfilled as mining progress from south to north. The area is made up of 3 use areas at the current time. Most of the property is an irrigated agriculture field used for gen- eral crop production, the southern area has been used histori- cally as a farm yard where equipment has been stored. The final area is the road corridor along the southwest side that slopes from the field to the neighbors pond. As mining progresses north, backfilling will begin once enough area is open so the two activities do not interfere with each other. Only clean Inert Material will be imported for use as backfill . The area being permitted and much of the surrounding areas have historically been used as irrigated crop land, vacant land and a small rural residential area. Immediately south of this site is a Denver Water Board reservoir (M-2004-078) and to the southwest is an Asphalt Specialties Mine, M-2015-030 . Both mines are still active so mining is compatible with the neighborhood. This site lies east of the South Platte River, east of HWY 85 on a terrace deposit containing an alluvial gravel deposit of commercial quality. Mining will stay 2 feet above the groundwater table . CURRENTEONDITIONS Large portions of the land to be permitted is currently leased to a farmer and operated as an irrigated farm land. Farming will continue on the areas not needed for mining or reclamation throughout the life of the mine . The southern area will be used for mining support and agricul- tural needs . The concrete slab will eventually have a building erected on it that will stay when reclamation is complete . The south area contains ROW' s for CR 8 . 5 and access roads for the neighboring properties . There is a water return line along the north side of this area as shown on the map exhibits . No mining will take place south of the north ROW line . The only structures on the permit area are the single trailer house, fences and water wells owned by 81- Enterprises . As mining progresses in this area they may be removed. There are no County Roads or public facilities in the mining area. CR 8 . 5 only serves this property and the 4 residences on the southwest side of the permit area. This access will be preserved and remain after reclamation is complete. The 2 concrete lined ditches within 200 feet of the property area not commercial ditches and only serve to distribute irrigation water to the adjoining fields . A vegetation map is shown on this map also. The initial access to the site is via an existing private gravel driveway, located off Highway 85 approximately three- quarters of a mile north of CR 8 on the east side of the Highway. A second access using WCR 8 . 5 enters from the east via Denver Street (CR 27) onto CR 8 . 5 then 1/4th mine west to property. This second access may become the primary access should CDOT not approve the improvement plan for the primary access on HWY 85 . In most cases, existing farm roads will be used during mining that are within the permit area. The initial Plant Site will be located on the area north of the HWY 85 entrance road so mining can begin on the hillside . The approximate location of both access roads are shown on MAPEXHIBITECEECURRENTLONDITIONSEMAP and MAP EXHIBITZEITEMININGPLANMAP. The internal access roads will be constructed of gravel . They will be at least 30 feet wide and graded to allow for drainage ❑EMnterprisesLltLC❑ December®i ililil❑❑❑ Sasaki[Pit❑ 6 EXHIBIT[❑ MINING PLAN LONT❑ and have ditches as necessary to collect runoff. Any runoff from the road will be retained on-site and allowed to soak into the ground or evaporate . The road will be maintained as needed. Maintenance roads will be built around the mining area to provide access for the farmer. The access roads will remain when recla- mation ends as they will be used to access the property. GEOLOGICLRETTING The affected lands are located along the South Platte River in a Quaternary age, Piney Creek alluvial deposit. The eastward dipping beds of upper Cretaceous age are overlain at an angular unconformity, by the Piney Creek alluvium. The sand and gravel encountered in the Piney Creek alluvium are a result of water erosion and redeposition of rock materials from the Front Range of the Rocky Mountains . The deposition of this material occurred during a time when the river was much larger than it is now. But, judging from the scarcity of large rocks found at the loca- tion, the velocity of the river must have slowed sufficiently to have dropped boulders and most large cobble before it reached this point. This type of material is typically found from south of Denver to the Colorado state line along the South Platte River. On this site only the upper 25 to 30 feet of dry material will be mined. The thickness of the mineral deposit varies from 8 to 52+ feet and the average depth on this mine is approximately 40 feet. However, at this time the plan is to mine only the above ground- water material, approximately 30 feet deep, to avoid exposing ground water to evaporation. There is a 10 to 12 inch layer of topsoil, consisting of loam and 24 to 36 inches of a clay loam to sandy clay loam overburden on top of the gravel . This alluvium is a well-sorted gravely sand and silt, predominantly granitic and quartzite material with minor amounts of gneiss, schist and sandstone. The bedrock under the surface gravel is a grey to grey black shale that is impervious . SOILSAND DVERBURDEN The SOILSMAPlNLEXHIBITt, shows the soil types as delineated by the National Resource Conservation Service (NRCS) and was obtained from their website . The information contained in EXHIBITILJ will provide background levels for the site as reclamation begins on the entire area. The depths of the topsoil and overburden, shown in the following table were obtained from drill logs provided by the original property owner. ❑®LIEnterprisestLC❑ December 11117E7171D Sasaki Pit❑ 7 EXHIBIT❑ MINING PLANCcONT❑ There are four (4) types of soils found on the site . These soils are typically found throughout Weld County. They have no unusual qualities . The four types of natural soils on the site as determined by the Natural Resource Conservation Service and shown in the report are designated as Map Units 1, 3, 68 and 75 . Soil units 3 and 68 are very small areas on the south edge of the mine that contain an exposed gravel face that will be removed as mining progresses . See the SOILSMAPmn the NRCS report for how the soils are distributed on the permit area. The NRCS report con- tains detailed information including the soils description, and chemical, physical, and engineering qualities, which can be found in Exhibit I - Soils . The Vegetation inventory applies to only the non-farmed area in each soil type and is provided as background for when the perime- ters of the backfilled areas are revegetated. Typically, at this time, the irrigated areas are used to grow various vegetable crops such as onions or cabbage. The majority of the backfilled area will be reclaimed as crop ground. The overburden will be placed over the imported fill to provide a root bed for the crops then the topsoil will be replaced over the overburden. The soils on the permit area that will be salvaged and replaced should be capable of growing vegetation consistent with what is required by the Reclamation Plan. The average depth of topsoil on the site according to the NRCS report and site investigations is 10 to 12 inches deep. Enough topsoil will be retained to place an average of 10-12 inches on the areas to be revegetated. As each area is stripped, it will be stockpiled for use in recla- mation or replaced on areas where backfilling is complete . In addition, there is from 24 to 36 inches of overburden on most of the site . Much of this overburden will be retained and used to ❑®EELLEnterprisestLC❑ December 11117E1MM Sasaki[Fit❑ 8 EXHIBIT❑ MINING PLAN C ONT❑ cover the backfill area or to build slopes from the current surface to the floor of the mine . The topsoil and overburden stockpiles will be located around the excavation, typical piles in possible locations are shown on the MAP EXHIBIT C-1 - MINING PLAN MAP. If the soil stockpiles remain undisturbed for more than one year, a cover crop of the approved seed mix, at the rate called for in theiRECLAMATIoN PLAN, will be used to revegetate them. MINING PLAN MAP EXHIBIT C-1 - MINING PLAN MAP shows the approximate direc- tion of mining as it progresses across the site . The plan is to have the maximum disturbance set at 45 . 46 acres but to set the bonded disturbance to 15 acres ± to allow for flexibility during mining. This bonded area will include, stripped, partially mined, partially backfilled and reclaimed areas, Plant Site, and materials stockpile area. The undisturbed area will continue to be use to grow crops until needed for mining. Once backfilling is done on part of the mined area it will return to crop produc- tion during the next growing season. The plan is to mine to the setback on a near vertical face and then backfill from the exist- ing surface to the mine floor leaving a temporary 2h to lv slope on the exterior sides . This will leave a stable slope around the perimeter until the final fill is placed. No more that 600 feet of backfill sloping will need to be done as mining progresses . The grey area on the Mining Plan Map shows the maximum backfill sloping data and the cut/fill volumes for the working face that extends across the site . If mining ended prematurely only the working face area would need to be cut/fill sloped, 600 feet of backfill sloping on the mines perimeter and 10 acres would need to be resoiled. Of the 45 . 46 acres ± in the permit area, approximately 38 . 71 acres ± will be disturbed by mining. We have 3 options for final reclamation the first 2 involve backfilling the mined area to within 10 to 12 feet of the existing surface leaving 2H: 1V slopes around the field. The 3 Reclamation options are discussed in the reclamation Plan text. It is not know at this time how much inert fill material will be available so the operator is planning to backfill the side slope area to 2 : 1 slopes ahead off floor backfilling to eliminate the need to import fill for bonding purposes should the Division have to complete reclamation. There will be adequate overburden on the mine to backfill 600 feet of the exterior slope on either side of the working faces as show on ❑®®EEnterprisesLLC❑ December III FlUrifl Sasaki[Pit❑ 9 EXHIBIT❑ MINING PLAN iMONT- the Mining Plan Map, so importing material would not be needed to complete disturbed slope areas . The "direction of mining" arrows on MAP EXHIBIT C-1 - MINING PLAN MAP show the applicant ' s best guess on how mining will progress through the mine area at this time . Natural ground conditions and unforeseen circumstances may necessitate changes to the mining direction throughout the life of the mine . The RECLAMATIONLCOSTESTIMATE'_EXHIBITIL is based on an estimated disturbance area when the mine has been open for a few years . The acreage disturbed may increase or decrease as mining pro- gresses . If it increases, a Technical Revision will be filed to adjust the bond amount to cover the changed cost estimate . Initial mine development will begin on the southwest side embankment just east of the entrance on HWY 85 . The plan is to use portable processing equipment located next to the working face and limit the plant site/stockpile areas to a minimum and produce only what can be used over a month or more . Most of the material will be used inter-company with a few outside sales so large stockpiles of material are not needed. The topsoil and overburden will be stripped and stockpiled around the mining area. Some of this material will be used to construct a sight berm along the HWY 85 corridor to limit visi- bility from the highway into the active mining and processing areas . Any material not used for the sight berm construction will be stockpiled on the north and east sides to have for build slopes . The berms will vary in height depending on the area to be screened, with 3 : 1 slopes on each side. As mining progresses and backfilling begins some of the overburden and topsoil may be placed on the backfilled area to avoid having to handle it twice . Operations will begin by stripping an approximate 5 acres . This will allow mining to start into the gravel slope along the southwest side of the sand and gravel deposit. A portable pro- cessing plant will be setup where mining begins and the material will be stockpiled in the immediate area for use as needed. The plant may run sporadically depending on the companies need for material . Periodically as mining progresses the stripped area will be extended so there is approximately two (2) acres ready for min- ing, and 2 acres of stockpiled material and 6 acres being back- filled for a total of 10 acres . All topsoil will be kept sepa- rate from the overburden when stockpiling. Overburden and top- soil will be stored around the mining area for use in reclama- tion. These stockpiles will be placed strategically in progres- sion with mining, and in some cases the topsoil and overburden ❑®®EEnterprisesILC❑ December III FETT V❑❑ Sasaki[Pit❑ 10 EXHIBITDO MINING PLAN iMONT❑ will be placed on areas where backfill sloping is needed so it only has to be handled once . As shown on Map Exhibit C-1, the working face and side slopes will be mined near vertical to maximize removal of material from the mine . At its widest point, the working face will be approxi- mately 950 feet long. If mining ends prematurely, this working face slope will be reclaimed using a cut/fill sloping method instead of backfilling, at 6 . 25 cy/lft to complete the 2H: 1V slopes . As mining reaches the mine setbacks around the perimeter the vertical faces on each side of the working face will be limited to 300 ft or less . These areas will be backfilled from the top of the slope to the mine floor, leaving a 2 : 1 slope . The mining setbacks will be 25 feet wide from the property line on the west and north side . On the east it will be 25 feet from the road or 048 ft from the property line and on the south it till be 25 feet from the north side of the United Water' s - water line ROW and 25 feet from the property line along the pond area. The setbacks will be used as a place for access roads to the mine exterior. The setback areas will be reclaimed if disturbed, but most roads will remain for farming access as part of the reclama- tion plan. The material will be mined using loaders and track hoes (exca- vators) to remove material from the face . The material will then be delivered directly to the portable plant for processing. No blasting will take place at this mine . Reclamation will run concurrent with mining to control the amount of disturbed area in the mine at any-one-time . This pit will be operated year-around by the 8 Enterprises, weather permitting. There may be periods when the demands for material are slow and no mining will take place, creating an intermittent operation situation. The amount of disturbance to be bonded will cover 15 acres or less at any-one-time . Of this 15 acres, the Plant Site will cover less than 5 acres, and will contain processing plant/stockpile area, active mining area and equipment storage area. The remaining 5 acres will be pre-mining stripped area, reclamation material stockpiles, partially reclaimed area and reclaimed area waiting release and 5 will be the southern support area and roads . This amount of disturbance may change as the mine develops but prior to exceeding the initial 15 acres, a Technical Revision will be filed to increase the bond and allow for more disturbance . Areas not included in the bonded area will remain in agricultural production and the responsibility for weed ❑®®CIEnterprisesLLC❑ December 11117T❑V❑❑ Sasaki[Pit❑ 11 EXHIBIT[❑ MINING PLAN❑coNT- control and agricultural area maintenance is retained by the farmer. Reclamation will begin once we have enough working area for operations and the section to be reclaimed will not have to be disturbed again. Review of MAP EXHIBIT C-1 - MINING PLAN MAP shows how we expect the site to look as mining and reclamation progress across the mine Note, the floor of the excavation is generally flat and the slopes into the excavated area would be reclaimed 2H to 1V as the area is above water levels and it will provide for more field to be farmed. Please refer to the MININGI-IMETABLE for the estimated acreage of each area associated with the mining part of this operation. Mining equipment may include but is not limited to, front-end loaders, scrapers, excavators, dozers, off-road haul trucks, dump trucks and a water truck. Processing equipment may include but is not limited to conveyors, crushers and screen plants . A portable concrete batch and/or portable asphalt batch plant, scale and scale house may be installed and operated at the mine during its life . As much as possible, the surface drainage will be maintained in the same direction as it now exists . The proposed sloping plan for the excavated area should eliminate any concerns of erosion occurring from the site . Most of the water used onsite will be for dust control on haul roads or with sand and gravel processing. Please refer to EXHIBIT GETWATERCfor the discussion of how water will be used at the site, the estimated yearly needs and the source of said water. The 2 drain pipes that cross under Highway 85 will be main- tained and will continue to allow return flows to reach the river. All interior pit slopes will be maintained with a pit-ward attitude so that historic drainage patterns can be maintained. This same slope management plan will prevent any offsite slides or other disruptions . Isolation berms or ditches will be constructed around the mine as needed to prevent storm- water from contacting the disturbed areas . All stormwater con- tacting the disturbed area will be retained onsite and allowed to evaporate or soak into the underlying gravel . No storm water will be retained on the mine for more than 72 hours . No U. S . Army Corps of Engineers, 404 permit is necessary, as mining will not impact waters of the U. The area will be mined to supply sand and gravel for the company projects with limited outside sales . It will be a dry mine with no mining in the water table . The plan is to use the land as crop land during mining and the backfilled area once that is complete using, clean imported inert material and on site over- burden and topsoil, leaving a shallow depression with 2H: 1V slope around the exterior. The following 3 Reclamation options may happen as the mine develops OPTIONS Option 1 - is the primary plan to backfill the mined area to within 10-12 feet of the existing surface and reclaim for agricultural uses . Option 2 - would only occur if there is not enough material to backfill the entire mined area. This could leave parts or all of the area unfilled, and leave 2 : 1 slope around the mined area from the current surface to the mined floor. This option would reduce the cost to reclaim the area if mining ended prematurely so the Division would not have to purchase material to complete backfilling. Option 3 - In the future, an opportunity may become avail- able to build structures on this site that would be used for commercial or residential purposes . This would entail installing the building foundations in the mined area before backfilling. Engineered slabs and foundations would be placed on the floor when mining reached its maximum depth and walls would be erected, so up to 3 levels would be below grade . Backfilling would then take place around the founda- tions as currently planned. This would have the advantage over normal construction since they would not have to dis- pose of the dirt removed when the foundations are dug. The amount of backfill material needed would be less than Option 1 because the foundations take up area that would have been filled. The site would then be resoiled and seeded temporally until construction begins on the above ground structures . This would ❑®®EEnterprisesLU LC❑ December 111 FETTTEI Sasaki[pit❑ 14 EXHIBITE❑ RECLAMATION[PLAN LONT❑ only be done if the proper land use with the local government is obtained first. The operator does not believe this is a signifi- cant change to the reclamation plan as only the end use would change . The backfilling, resoiling and revegetation plans would not change and the seed mix for the slope would be used around the foundations . If this Option becomes viable, a Technical Revision would be filed showing the location of the foundations and any other information needed by the Division. The reclamation methods and plans described below will apply during reclamation on any one of the options but may require minor variations depending on the conditions found on the site . Reclamation will run concurrent with mining so it will commence as soon as enough area is available to reclaim and not be redisturbed. The setbacks and side slopes from the excavation lines will be resoiled and revegetated using the methods de- scribed in the following plan. The level floor area will be planted with crops during the growing season after resoiling is complete . On-site generated inert material will be placed in backfill areas or will be recycled/sold. The applicant proposes bonding to cover a limited disturbed area throughout the life of the mine (15 acres) , that includes a sufficient stripped and mining area, a area being actively back- filled and area reclaimed but waiting for release that will either be seeded with grass or awaiting planting of a crop. If the applicant determines that the amount of disturbance at the mine may soon exceed the bonded amount, the applicant shall submit a bond revision to the Division. As noted in theMININGPLAN, we are proposing three options for reclaiming the site . The methods used to develop the disturbed area in each option have minor differences . The differences being in how much area is backfilled and depends on how much inert fill material can be obtained. Currently, the proposed mine site is primarily irrigated agricultural land. The current uses include, irrigated crop areas; non-irrigated field perimeter, roads and farm yard/general storage area. The agricultural uses will continue in areas where mining operations have not yet begun. There is very little native vegetation present on the site because of the intensive agricultural practices that have taken place on the land for many years . Only isolated areas around the farmed area has vegetation that may be considered native. The typical vegetation descrip- tions in EXHIBITS I & J will not match the actual current vegeta- ❑®®EEnterprisesLLC❑ December III FlUrifl Sasaki[Pit❑ 15 EXHIBIT[E❑ RECLAMATION PLAN LONT❑ tion since the practice for the agricultural activities are that crops are rotated from year to year. GENERAL[DISCUSSION There are sufficient amounts of topsoil on the site so the mined areas can be resoiled to an average depth of 10-12 inches . Sufficient topsoil will be saved for use in reclamation. The available topsoil to be salvaged from the stripping process will preclude having to haul additional soils onto the site for revegetation. The existing soils on the property have been capable of producing healthy crops and grasses and are expected to work for use on mined areas that will be revegetated. The vegetation information was obtained from site visits and data provided in the vegetation information obtained from the NRCS soil survey web page . A copy Of that report is in EXHIBIT I and J and describes the current soils and vegetation on the proper- ties . As outlined in the EXHIBITL _MININGPLAN, approximately 38 . 7 acres ± of the permitted area will be disturbed as a result of mining activities . The plan calls for initially bonding to have 15 . 00 acres ± disturbed at any-one-time . As mining progresses across the property some parts of the property will remain undisturbed while other areas will be either, stripped, mined, partially reclaimed or totally reclaimed. TheMAPEXHIBITZMEMININGPLANEMAP shows how the pit will look when approximately 75% is mined and partially reclaimed. The MAPLEXHIBITPLtECLAMATION PLAN MAP shows how the area will look when reclamation is complete . The area will be returned to at least its present vegetative condition or planted with a crop when reclamation is complete . Careful analysis of the growth medium and salvageable soil will permit the operator to carry out a soil additive program and to monitor the prescribed seeding plan to determine if the plan requires revision. Under normal weather conditions, an adequate moisture reserve will be present for establishment of the pro- posed seed mixture . Irrigation is planned for the crop areas on the backfilled area, but will not be used for the exterior slopes . No revegetation will take place on undisturbed areas, access roads or farm facilities . The reclamation timetables show the types and amount of land use in each use area when reclamation is complete. Approximately 14% of the area in the permit will not be disturbed by mining, either because it is farm facilities, or setbacks that are too small to mine and will be kept in their natural state. ❑®CEILEnterprisesELC❑ Decembers H I❑f1T❑V❑❑ Sasaki Pit 16 EXHIBIT[E❑ RECLAMATION[PLAN LONT❑ RECLAMATIONLPLAN As reclamation begins one of the 3 options noted above will be picked. If Option 3 is chosen, a Technical Revision will be filed with the Division showing the location of the foundations and update the backfilling plan. Option 2 is a variation of Option 1 in that it would give the option to limit backfilling if adequate material is not available to complete Option 1 . The proposed future use of this site is to return it to it' s existing use of general agriculture or later to develop it for commercial purposes (Option 3) . Mining will create a depression in the terrace deposit that leaves flat floor 2 feet above the ground water table . When reclaimed a shallow amphitheater that day lighting out the south- west side, with a flat bench running north-south approximately 10 to 12 feet below the existing surface will be left. The side slopes from the existing surface to the top of the fill will be graded 2H: 1V and then revegetated with grass seed. Clean Inert Material will be imported and placed in the excavated area as mining progresses, then an average of 12 inches of overburden to leave a root zone below the 10 to 12 inches of soil that will be the final cover. This would happen in all three options making the reclamation plan very simple in that the reclaimed area will then be returned to agricultural production by planting a crop at the start of the next growing season. Review of theERECLAMATION PLANEMAP in this application packet depicts how we believe the site will look if Option 1 is picked. Since the working face will be mined near vertical it will be necessary to cut/fill it to complete reclamation if not mined to the outer limits . But as mining reached the outer limits the plan leave no more than 300 feet of near vertical face each side of the mining face from the mine floor to the existing surface for working area. Backfilling will take place on any slope area outside the 300 feet even though the lower parts of the slope will be covered as backfilling progresses . By creating the temporary slopes as mining progresses, we are reducing the amount of work necessary to reclaim the site if mining stopped prema- turely. A maximum of 950 feet of the working face will be left nearly vertical and will need to be cut/fill sloped if mining ended early. The excess overburden being stockpiled will in sure that adequate material is onsite to complete the sloping plan. This sloping plan will also insure, that if mining ceases before the backfilling could be completed, only a minor amount of work would have to be done to finish reclamation on the disturbed area. It also means that the topsoil, only has to be handled once and reclamation will run concurrent with mining. There are sufficient amounts of topsoil on the site so the mined area can be resoiled to an average depth between 10 and 12 inches . All topsoil encountered will be saved from the stripping process and the operator will not haul additional soils onto the site for revegetation. Once an area is backfilled, capped and resoiled it will be returned to crop production. The final slopes will be seeded with grass . The non cultivated area vegetation information was obtained from site visits and data provided in the vegetation information obtained from the NRCS soil survey web page . A copy if that report is in EXHIBIT' S I and J and describes the current cover in the terms of yearly production and will serve as back- ground information as reclamation progresses on the slopes and surface area surrounding the mined area. As outlined in the MINING PLAN, up to 38 . 7 acres ± of the permitted area will be disturbed as a result of mining. Since there are no stages in the permit, reclamation will run concur- rent with mining. The plan calls for having no more than 15 . 0 acres ± disturbed at any-one-time. As mining progresses across the property some parts of the property will remain undisturbed while other areas will be either stripped, mined, partially reclaimed or totally reclaimed. The RECLAMATION PLAN MAP - EXHIBIT F shows how the area will look when reclamation is com- plete when the area has been backfilled. The non-crop areas will be returned to at least it' s present vegetative condition when reclamation is complete . Careful analysis of the growth medium and salvaged soil will permit the operator to carry out a soil additive program and to monitor the prescribed seeding plan and to determine if the plan requires revision. Under normal weather conditions, an adequate moisture reserve will be present for establishment of the pro- posed seed mixture . Irrigation is planned for the crop area but the side slopes and existing surface area will not be irrigated because we will be attempting to create a diverse dryland site that is non-water dependent. No revegetation will take place on access corridor, roads or the farm yard as they will remain graveled and for use as farming resumes . ❑®®CEnterprisesLLC❑ December II171771 Sasaki[Pit❑ 18 EXHIBITE❑ RECLAMATION[PLAN LONT❑ REVEGETATIONLPROGRAM The revegetation program to be implemented is a fairly simple plan since the idea is to continue to use the property to produce crops such as onions or cabbage . The seed is drilled at the appropriate time of year for the species being planted. The type of crop to be planted in any given year is reserved by the farms manager. Since the intended use of the reclaimed land is crop land, any slopes created will be commensurate with this final land use . The use of soil additives or fertilizers will also be determined by the farmer and will be applied if they determine they are needed for successful crop propagation. The area and slopes around the field will be revegetated with the seed mixture discussed in the following text. On those areas "Revegetation will be carried out in such a way so as to estab- lish a diverse, effective and long-lasting vegetative cover that is capable of self-regeneration without continued dependence on irrigation, soil amendments or fertilizers. " The slope area seeding will be drilled wherever possible, when drilling is not possible, the seed will be doubled and broadcast. The revegetation plan provides for the greatest probability of success in plant establishment and vegetative development by considering environmental factors such as seasonal patterns of precipitation, temperatures and wind. Other considerations, such as soil texture, fertility, slope stability and the direction in which slopes face, have been considered. The road and farm yard areas on the south side will remain to provide support for crop harvesting and for the supervision and inspection of the reclamation plan. This area will remain graded and graveled. The remaining roads will provide access to the property when reclamation is complete. SEEDBED LPREPARATION When mining on an area is complete, reclamation will begin. The stockpiled soils will be spread, smoothed of large clods, worked until moderately fine . The crop area be tilled and pre- pared for planting. On the areas where grass seed is broadcast, the surface will be left fairly rough to trap the seed and keep it from being affected by wind. This technique is used on other facilities in the state that are similar to this site . It works very well as reclamation has been successful . If fall planting is convenient, the seeding will be done before the first freeze (about the time Winterwheat is planted) . If spring planting is called for, it will be done in March or April weather permitting after the last frost. Both periods assure there will be adequate residual ground moisture available for the newly planted seeds . GRASSES The following seed mix was developed by the NRCS office in Brighton many years ago for mines in Weld County. It has proven to be very reliable and quick growing. This mix will place approximately 41 . 2 seeds per pound per sq-ft as prescribed by the NRCS planting guidelines . If the seed is broadcast, the amount will be doubled and spread on a rough surface . The seeded areas will then be dragged or raked thoroughly to set the seed. Under normal conditions, the operator will strive for a 30 to 40 per- cent cover rate on the grass revegetated areas when reclamation is complete . No trees will be planted. WEED(CONTROL Because this is a crop production site the seeded areas are monitored closely during growing season and the weeds managed to maximize crop production. The active mining areas will be reviewed each spring to deter- mine if noxious weeds are invading the area. Weed control will be initiated if the problem becomes serious or if an excessive weed cover is present. In no way should this be taken to mean that an attempt will be made to eradicate all the weeds from the site . Some weeds are beneficial to the wildlife species in the area, they provide important protection from the elements during winter and nesting sites during the spring. Total eradication of weeds from the site is not necessarily desirable, so we will be using controls on the noxious weeds and letting the rest grow in select areas for limited times as long as they do not hamper crop production or grass establishment. It may be necessary to con- trol weeds by mowing after the first year, the feasibility of chemical weed control methods will be used if this does not work. Control of noxious weeds is important to the state so USDA Exten- sion Service recommendations will be followed to control them if they are found on the mine . IRRIGATION❑ Irrigation is used for the crop areas, the water coming from water owned by the 81- Enterprises . No irrigation is planned for the grass revegetated area in the pit. It makes the grassy vegetation dependent on water and does not promote a vegetation cover that is diverse and capable of self regeneration. All grading will be done in a manner to control erosion and to protect areas outside the affected lands from slides or other damage . All backfilling and grading will be completed as soon as feasible after mining is completed in any given area. All refuse will be hauled away or disposed of in a manner that will control unsightliness and protect the drainage system from pollution. There are no acid-forming or toxic materials involved in this operation. If petroleum products are stored at the site, it will be done as prescribed by applicable laws . Any storage tanks will be surrounded by a berm or be in self contained facilities ade- quate to retain any fluid spilled should a tank rupture. In addition, there is adequate absorbent materials on site to con- tain any spills that would occur outside the containment struc- ture . There are no drill or auger holes on the land. Maximum slopes will be within the limits set forth in the Rules and Regulations of the Board and will be capable of being traversed by machinery. The operator does not expect prevailing hydrologic conditions to be disturbed. 81- Enterprises will comply with applicable Colorado water laws and regulations (as the operator understands them) "governing injury to existing water rights to minimize any disturbance which might occur to the prevailing hydrologic bal- ance of the affected land and surrounding area and to the quality and quantity of water in surface and ground-water systems both during and after the mining operation and during reclamation. " Any water used in the operation of the processing plants and for dust control will come from water sources described in WATERED EXHIBITLG. No dredging will take place at this facility, there will be no temporary siltation structures involved in this operation and no mining will be done in a river or waters of the United States or the State of Colorado. A U. S . Army Corps of Engineers Permit is not required for this operation because there are no wetlands on the site that will be disturbed. In general we have found there is little long term disturbance to native wildlife species around gravel mining operations . The big game species tend to use mining sites and newly vegetated areas after operations have stopped for the day. The smaller species tend to move to undisturbed areas . In practice this is done by limiting the amount of disturbance, restricting truck and equipment speeds to 15 mph or less and doing concurrent reclama- tion. Mine employees are trained to deal with wildlife found on the mine during operating hours to avoiding harming them. No threatened or endangered species have been observed on the site . Wildlife information is presented in EXHIBITLi. Topsoil in the area (average 10-12 inches) is of good quality, so when it is removed to reach the mineral deposit, it will be segregated and stockpiled. If the topsoil and overburden piles remain undisturbed for more than a year, a vegetative cover using the proposed seed mix at the rate listed or other means will be employed to prevent erosion from wind and water and keep them free of contaminants so that they remain useful for sustaining vegetation when reclamation begins . The stockpiles will be located in areas where disturbances by ongoing mining operations will be at a minimum, i .e . , along setbacks on the pit perimeter or mine floor. The topsoil will be handled as little as possible until it is replaced onto disturbed areas . The operator will take measures necessary to insure the stability of the replaced topsoil on graded slopes and spreading it as evenly as possible . Fertilizer and other soil amendments may be used at the farm managers discretion during crop planting. GROUND WATER WELLS We do not expect this mining operation to have any or minimal impacts on the prevailing hydrologic balance, since we do not plan to impact the ground water table . TABLE® is a list of 15 wells obtained from the Office of the State Engineer' s files, that are within 200 feet of the permit area. The wells high- lighted in blue are monitoring wells associate with the Denver Water Board reservoir south of this permit area. The operator owns 2 wells an irrigation well and a domestic well . The remain- ing 6 wells are domestic/stock wells, one (1) is a deep well (highlighted green) and three (3) are shallow wells drawing water from the surface aquifer. SignificantWildlife Resources Much of the land to be permitted is used as an active farm with the main area used for crop production. The west side borders a major divided highway. On the north section and east is agricul- ture fields . On the south a rural residential development and water storage reservoir border the affected lands . The human activities on the southern end are not very conducive to wildlife use and the northern end is cultivated farm land used to grow garden crops and has little or no cover that supports wildlife except along the very narrow corridor between fields . The spe- cies of wildlife found in the area around the property are those typically found on actively farmed areas such as small song birds, occasionally pheasants, as well as mammals such as skunks, mice, rabbits, deer, fox, and coyotes . The larger game animals such as deer, fox, and coyotes are commonly seen in cultivated field areas after harvest. There are no water features on the site . The smaller mammals and wildlife are usually found around the perimeters of the active crop-lands and buildings wherever protective vegetation exists . There are no large trees on the site that would support raptor nests nor were any observed on the permit area. CPW lists one active Bald Eagle nest on their web site that is more than one-half mile west-northwest of the mine, on the west side of the South Platte River. Since the nest is not within one-half mile of the permit area a mining setback is not needed. Seasonal[ Ise Many of the mammals that may potentially be encountered on the mine are expected to be year-round residents, or will come and go depending on their mobility. The deer, fox and coyote are not movement-restricted and tend to travel through many properties as part of their natural daily routine covering several square miles . There is no habitat for water fowl . Raptors and other birds that may use the property seasonally depending on the crop grown. The site contains no habitat suitable for the Preble 's meadow jumping mouse. Areas near the seasonal irri- gation ditches within the site have steep sides and do not have vegetative cover that is characteristic of Preble' s habitat. Bald Eagles have been removed from the Threatened and Endangered list however they still fall under the Migratory Bird act. As noted above, there is an active nest west of the South Platte River more than one-half mile west-northwest of the permit area and mining will not take place close to this area. ProjectEffects ib Wildlife Existing wildlife in the area is not expected to be signifi- cantly impacted by mining at this site . The property lies in the Mule Deer Winter Range along the east side of the South Platte River. Temporary and permanent losses of winter range or food and habitat are not expected to be significant as the area of disturbance will be limited to less than 300 of the permit area at any given time. Haul road speed limits will be limited to 15 MPH or less within the mine . There may be some displacement of smaller birds and mammals during active mining operations in a phase, but once reclamation is complete wildlife uses should re- turn to pre-mining activity levels . ❑®®enterprises LC El December -- Sasaki Pit El 31 EXHIBIT I' SOILS❑ SOILS INFORMATION The following information was obtained from site observa- tions and the basic soils and vegetation information found thru the USDA' s National Soils information page and the Soil Survey of Weld County. The soils information was downloaded from the USDA site and is made part of this application. Soil units are shown on the USDA map, reproduced on the next page . The photo map shows the surrounding vegetation features and soil types . The entire area of the mine site lies east of Highway 85 on a terrace deposit that is currently mostly used as agricultural cropland. The south area has been used as a staging area for the farming activities, so has little or no vegetation except scattered grass areas but predominately weeds . There are 4 soils types found on the mine site of which only 2 will be disturbed by mining. Under laying the 12 inches of topsoil is a layer of overburden varying from 2 . 5 to 3 feet deep and a layer of gravelly sand that is 28 to 50+ feet thick. The plan is to mine the upper 30 feet of gravel staying a minimum of 2 feet above the ground water table and backfill the mined area with 10-15 feet of inert fill, than place the 12 inches of over- burden on the fill and resoil it with an average of 10-12 inches of topsoil . Not all of the 15 acres will be disturbed as some areas may be backfilled and resoiled and ready for planting when the season arrives . The num- bers presented for each item are based on what is estimated to be disturbed at the time when mining is well underway and backfilling has begun. It will not be necessary to import fill material to complete reclamation on the side slopes as discussed in the Mining Plan. Due to the nature of this operation, a represent the period during mining on the area is when the mining face extends across the property, the first 600 feet of side sloping is needed and backfilling has started. Approximately 5 acres is mined, there are 3 acres stripped in front of the working face . The vertical face extends across the property from east to west and 2 . 9 acres is partially backfilled ready to be resoiled and seeded. At that time the sloping needed on the mining face would be 950 feet of final cut/fill grading at 6 . 25 cu-yds/lft and 600 feet of back- filling sloping on the sides at 23 . 5 yd/lft. Approximately 4, 680 cyds of overburden would need to be placed on the filled area and 14, 100 yds of soil spread on 10 . 9 acres . Within this 10 . 9 acres, 1 . 5 acres of side slopes would need grass seeding and the remain- ing 9 . 4 acres would be seeded with crops . The 4 . 1 acre gravel area on the south end of the mine would only need grading.
