Buck, Chair Commissioner Scott K. James, Pro-Tern Commissioner Jason S. Maxey Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Jess Reid Deputy County.Attorney, Karin McDougal Department of Planning Services Representative, Molly Wright Development Review Representative, Aaron Maurice The following business was transacted: I hereby certify that pursuant to a Notice dated November 13, 2025, and duly published November 15, 2025, in the Greeley Tribune, a public hearing was conducted to consider the request of Damariz Medrano Ramirez, for Use by Special Review Permit, USR25-0017, for an Oil and Gas Support and Service facility (laydown yard and commercial vehicle parking), outside of subdivisions and historic townsites in the A (Agricultural) Zone District. Karin McDougal, Deputy County Attorney, made this a matter of record. Molly Wright, Department of Planning Services,, presented a brief summary of the proposal, which includes three (3) buildings, comprising of one (1) office, two (2) shops, and on-site diesel tanks. She provided the number of employees that will be onsite, over two (2) shifts, reviewed the water and sewer provisions, discussed the surrounding zoning, uses and USRs, mentioned notice was sent to six (6) surrounding property owners (SPOs), and noted that one (1) phone call, with general questions, was received. She reviewed the Screening Plan and trash removal, entered the favorable recommendation of the Planning Commission into the record, as written, and displayed images of the site and surrounding views. She indicated the applicant submitted proposed changes to the Development Standards (DS) (Exhibit D), relayed she would address them when the Board reviewed the Resolution, and in response to Commissioner James, cc,. Pt-(4r/MN/bA/Rc,,J/KR) 2025-3423 /2W/26 PL2985 Hearing Certification (USR25-0017) — Damariz Medrano Ramirez Page 2 confirmed the proposed changes did not alter the operation or what was noticed. Responding to Commissioner Maxey, Ms. Wright re-displayed the SPO image and property,ro confirmed there is a home to the west of the subject p p y, but she was not sure if it was occupied. Aaron Maurice, Department of Planning Services, Development Review, stated the proposed access will be on County Road (CR) 36 and indicated there is no traffic information for this portion of CR 36. He discussed the Traffic Narrative, outlining the types and numbers of vehicles the applicant expects, per day, and mentioned a Road Maintenance Agreement is requested and a Final Drainage Report will be required. Hannah Dutrow, AGPROfessionals, represented the applicant, and in response to Chair Buck, indicated she had not had contact with any of the Commissioners regarding this case. She displayed a PowerPoint Presentation (Exhibit E) and provided a handout (Exhibit F) to the Commissioners. She described the general location of the site, which is 91 acres, noted the existing on-site residence and buildings will remain, but will not be used by the business, and reviewed the proposed site plan. She outlined the on-site and off-site operations, and referenced Exhibit F, regarding the number of employees, hours of operation, and the number/type of vehicles. Ms. Dutrow requested a modification to the DS #10 (Landscape and Screening Plan), as the site is well setback from surrounding uses and the residence to the west had been conveyed to Noble Energy and is not occupied. She also requested a modification to DS #23 (maximum permissible noise level), based on the use of the property, opposed to the zoning. In response to Commissioner Maxey, regarding access, Ms. Dutrow stated the landowner wants to fence off the USR boundary area and give it its own access for safety. Mr. Maurice stated the proposed access meets spacing criteria and it is standard practice not to utilize a ditch access for USRs. Ms. Dutrow relayed the shops will be used primarily for storage and office work for on-site employees. There was discussion regarding screening and Ms. Dutrow explained the property is 20 feet lower in topography than surrounding properties and the operation will really only be visible from CR 36, and there would not be benefit to screening all along CR 49. No public testimony was offered concerning this matter. The Board agreed to the applicant's requested language to DS #3 (hours of operation) being 24 hours a day, seven (7) days a week, and engaged in lengthy discussion regarding DS #5 (number/types of vehicles onsite), in which Dawn Anderson, Weld County Department of Planning Services, Development Review, stated the required Road Maintenance Agreement would take into consideration the applicant's proportional share for any maintenance activities, and suggested the County may need to consider adding triggered improvements to the RMA for the number of vehicles turning. The Board tabled the discussion and moved on to DS #7 (derelict vehicles), where different/additional language was proposed, but ultimately, they agreed to keep it as originally written, without 2025-3423 PL2985 Hearing Certification (USR25-0017) — Damariz Medrano Ramirez Page 3 I'I the word "commercial." Regarding DS #10, at the applicant's request, the Board agreed to eliminate the requirement for landscaping and only require screening on the south side, as indicated on the site plan. After discussion regarding the applicant's proposed changes to DS #23 (maximum permissible noise level) and given the fact that no Noise Study was done, the Board decided to keep the noise standard at the Residential Zone level. The Board and staff re-visited DS #5, and Maxwell Nader, Department of Planning Services, stated the application materials reference 50 semi-trucks, not commercial vehicles, and read the application request language regarding the laydown yard, which states, "the proposed business is for temporary storage of vehicles, equipment and materials, used primarily in the oil and gas industry." Mr. Nader relayed, the way DS#5 is currently written, "There is allowed to be up to 50 semi-trucks onsite, in the designated parking location, as stated in the application materials." is appropriate. The Board agreed with the language for DS #5, and after additional discussion regarding screening, noise, and vehicle repair • the Board agreed to all of the aforementioned changes. In response to Chair Buck, Ms. Dutrow indicated she had, on behalf of the applicant, reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. No public testimony was offered regarding changes made to the Conditions of Approval and Development Standards. Commissioner James moved to approve the request of Damariz Medrano Ramirez for Use by Special Review Permit, USR25-0017, for an Oil and Gas Support and Service facility (laydown yard and commercial vehicle parking), outside of subdivisions and historic townsites in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Maxey, and it carried unanimously.
