The proposal has been reviewed by Development Review on behalf of the Weld County Department of
Public Works and the Department of Planning and Zoning. Staff comments made during this phase of the
application process may not be all-inclusive, as other issues may arise during the remaining application
process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: Use by Special Review for an Oil and Gas Support and Service facility (laydown yard
and commercial vehicle parking), outside of subdivisions and historic townsites in the A (Agricultural)Zone
District
This project is north of and adjacent to County Road 36 and is east of County Road 49.
Parcel number 121506000023.
Access is onto County Road 36.
ACCESS
Development Review has reviewed the application materials related to access and determined the
following:
There is an existing residential, agricultural, and oil &gas access location approximately 2,775 feet east of
CR 49.
The applicant is proposing an additional access location onto CR 36 approximately 1,850 feet east of CR
49.We strongly encourage the applicant to discuss the proposed access location with Development Review
prior to laying out the site to ensure the approved access location meets the minimum access spacing
requirements listed in Table 1, of Weld County Code, Section 8-14-30, provided below.

The proposed access shall be constructed to comply with the geometric specifications listed in Table 8-3,
below.

Per Section 8-14-30, an Access Permit is required for access to Weld County maintained roadways. Refer
to Section 8.5, of the Weld County Engineering and Construction Criteria manual, for more information
regarding access.
ROADS AND RIGHTS-OF-WAY
County Road 36 is a gravel road and is designated on the Weld County Functional Classification Map(Code
Ordinance 2024-01) as a local road, which requires 60 feet of right-of-way. The applicant shall delineate
and label on the USR map the existing right-of-way (along with its creating document) and the physical
location of the road. If the right-of-way cannot be verified it shall be dedicated. Pursuant to the definition of
setback in the Weld County Code, Section 23-1-90, the required setback is measured from the future right-
of-way line. Be aware that physical roadways may not be centered in the right-of-way. This road is
maintained by Weld County.
Per Chapter 8, Article 13, Section 8-13-30, a Weld County Right-of-Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and or encroaching upon, any
County rights-of-way or easement. Right-of-Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
There is no traffic information available for this portion of CR 36.
The traffic information submitted with the application materials indicates that site traffic is expected to
consist of semi-trucks and passenger vehicles, with an average of 36 roundtrips per day. Parking and
equipment storage will occur 24 hours per day, 7 days per week. The highest traffic volumes are expected
to occur from 4:00 a.m. to 6:00 a.m. and 4:00 p.m. to 5:00 p.m.
It is assumed that 65% of traffic exiting the site will travel west on CR 36 to CR 49 and 35% will travel east
on CR 36 to CR 53.
TRACKING CONTROL
Tracking control is required to prevent tracking from the site onto public roadways. For access to gravel
roads,tracking control devices must be either double cattle guards with 100 feet of road base, or road base
on all driving surfaces.
DRAINAGE REQUIREMENTS
This area is within an Non-urbanizing Drainage Area. Non-urbanizing Drainage Areas typically require
detention of stormwater runoff from the 1-hour, 100-year storm event falling on the developed site and
release of the detained water at the historic runoff rate of the 1-hour, 10-year storm event falling on the
undeveloped site having a 2% impervious value.
The applicant has submitted a preliminary drainage report. An accepted final drainage report and detention
pond design completed by a Colorado Licensed Professional Engineer is required prior to recording the
USR map. The drainage report must include a Certificate of Compliance stamped and signed by a P.E.
licensed in Colorado.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than one (1)acre of land. Grading Permit
applications are accepted after the planning process is complete (map recorded). An Early Release
Request Form may be entertained only after the applicant, Public Works and Planning Department have
reviewed the referral and surrounding property owner comments. The Early Release Request may or may
not be granted depending on referral comments and surrounding property owner concerns. Contact
Development Review for more information.
A Colorado Stormwater Discharge Permit is required when disturbing more than one (1) acre of land.

ROAD MAINTENANCE AGREEMENT
Development Review is requesting a Road Maintenance Agreement including, but not limited to, dust
control and damage repair to specified haul routes.

CONDITIONS OF APPROVAL
A. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional
Engineer registered in the State of Colorado is required. (Development Review)
B. The plan shall be amended to delineate the following:
1. County Road 36 is a gravel road and is designated on the Weld County Functional Classification
Map as a local road which requires 60 feet of right-of-way at full buildout. The applicant shall
delineate and label on the USR map the existing right-of-way (along with its creating document)
and the physical location of the road. All setbacks shall be measured from the edge of right-of-
way. This road is maintained by Weld County. (Development Review)
2. Show and label the project site's access location on County Road 36. (Development Review)
3. Show and label the approved tracking control on the site plan. (Development Review)
4. Show and label the entrance gate, if applicable. (Development Review)
5. Show and label the accepted drainage features. Stormwater ponds should be labeled as
"Stormwater Detention, No-Build or Storage Area" and shall include the calculated water quality
and detention volumes. (Development Review)
A. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

B. The applicant shall be in receipt of an approved access permit prior to construction activities.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Development Review)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages
and/or off-site tracking. (Development Review)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. Any work that may occupy and or encroach upon any County rights-of-way or easement shall acquire
an approved Right-of-Way Use Permit prior to commencement. (Development Review)
5. The Property Owner shall comply with all requirements provided in the executed Road Maintenance

6. Weld County is not responsible for the maintenance of onsite drainage related features. (Development

The Staff of the Weld County Oil and Gas Energy Department (OGED) appreciates the opportunity to
comment on the captioned planning case. Staff has completed review of the proposal and have included
additional comments below:
1. There are no active 1041 WOGLA Permit on the associated parcels. There are several oil and
gas well sites on and in the area surrounding the parcel.
2. The parcel includes no active oil and gas wells.
3. The site plan envelopes one (1) plugged and abandoned (PA) well listed in Table 1 below.
Additional information regarding the plugged and abandoned well is available from the
Energy & Carbon Management Commission (ECMC). OGED recommends that the Applicant
review this information and contact the responsible operator regarding well infrastructure
that may have been abandoned in place prior to conducting operations in proximity to the
wells. Appropriate setbacks should be implemented into site plans.

4. The subject lands may include additional oil and gas related infrastructure, such as off-
location flowlines or pipelines which are a use by right and not regulated by Weld County.
OGED requests that the applicant reviews flowline data available from the ECMC map viewer
and utilize Colorado 811 prior to any excavation activities.
These comments and recommendations are based upon the review of the application materials submitted
by the applicant and other relevant information available on the E-Permit site.

This review for a "Use by Special Review" for an Oil &Gas Support Services Business. This
business will be located on an 86.82-acre property with existing residential and agricultural
buildings. The existing buildings are not associated with the proposed development. The
proposed development includes two (2) 9,120 ft2(60'x 152') commercial buildings, and an
additional commercial building to be utilized as an office. The remaining area will be used for
equipment storage and commercial vehicle parking.
These comments are provided in accordance with the 2018 International Fire Code (IFC) and any
other applicable standards and are based on the plans provided.
FIRE DISTRICT REFERRAL REQUIREMENTS & COMMENTS
1. All work shall be completed in accordance with the approved plans, the 2018 IFC,the Weld
County Building Department, and the Platte Valley Fire Protection District.
2. Construction:
a. All construction/demolition shall comply with IFC Chapter 33.
i. There must be an approved driving surface constructed prior to and
maintained throughout construction IFC 503 &Appendix D.
ii. Excess combustible waste accumulation must be kept to a minimum and no
waste shall be permitted to be stored in the exits of buildings.
iii. Site cleanliness must be closely monitored at all times.
iv. Fire extinguishers must be kept in all areas of the building during
construction.
b. Any construction near current or old oil and gas facilities, wells, pipelines, etc. Shall
meet the requirements of the Evans Fire Protection District,Weld County and the
ECMC (Colorado Energy and Carbon Management Commission). Proper
documentation is required that all pipelines have been accounted for and that the
developer is aware of these.
3. Site Access (IFC 503):
a. Premises Identification shall comply with IFC 505.
b. An approved site safety plan including fire department vehicle access routes during
construction shall be provided in accordance with IFC Chapter 33.
c. All roads within the site and at the entrance shall be able to accommodate the
weight of our heaviest fire apparatus and meet the requirements of IFC 503 &
Appendix D throughout regular operations at the site. This driving surface shall
always be maintained.
d. The Fire Apparatus Access Road (facility entrance) shall meet the requirements of
IFC 503 &Appendix D.
e. Approved Fire Lane marking shall be provided where necessary to discourage
obstructions by the parking of private vehicles.

4. Water Supply&Fire Protection (IFC 507):
a. Fire Flow Calculations and requirements shall be determined by IFC Appendix B.

GENERAL PLAN REVIEW COMMENTS

4. Deferred submittals that will need to be submitted directly to the Fire District include:

5. The applicant shall coordinate all required inspections with the Fire District

inspection is performed and all requirements have been met.
This list is intended to provide the owner with as much information as possible,but it may be
amended too during subsequent reviews or as other information becomes available. The designer
is responsible for the technical accuracy of their work. Nothing in this plan review is intended to
approve any aspect of this plan that does not comply with all applicable codes and standards.Any
changes that are made to the plans will require approval from the Fire District. Please reach out to

We have received your August 25, 2025 submittal concerning the above referenced
proposal for a Use by Special Review for an Oil and Gas Support and Service facility
(laydown yard and commercial vehicle parking), outside of subdivisions and historic
townsites in the A (Agricultural) Zone District on the land owned by Damirez Medrano
Ramirez, described as a portion of the SW 1/a of Sec.6, Twp. 3 N, Rng. 64 W, 6th P.M.,
Weld County.
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and
March 11, 2011 memorandums to county planning directors, this office will only
perform a cursory review of the referral information and provide informal comments.
The comments do not address the adequacy of the water supply plan for this project
or the ability of the water supply plan to satisfy any County regulations or
requirements. In addition, the comments provided herein cannot be used to
guarantee a viable water supply plan or infrastructure, the issuance of a well permit,
or physical availability of water.

A review of our records shows well permit no. 223683 is located on the subject
property. Permit no. 223683 was issued February 18, 2000, pursuant to section 37-92-
602(3)(b)(II)(A), C.R.S. as the only well on a tract of 40 acres, described as a portion
of the SW1/4, Section 6, Township 3 North, Range 64 West, 6th P.M., Weld County.
The well is permitted for the in-house uses in three single family dwellings, irrigation
of not more than one acre of lawn and garden, and the watering of poultry and
domestic animals. Upon approval of this Use by Special Review, water from this well
may not be used for any commercial purposes associated with the planned business
operations.
The applicant plans to apply for a new commercial exempt well to supply water for
the storage operations. The ability for the Applicant to obtain well permit(s) and the
allowed use(s) will be determined at the time permit application(s) are submitted to
and reviewed by the State Engineer's Office.
