Buck, Chair Commissioner Scott K. James, Pro-Tem Commissioner Jason S. Maxey Commissioner Lynette Peppler Commissioner Kevin D. Ross Also present: Acting Clerk to the Board, Houstan Aragon County Attorney, Bruce Barker Minutes: Commissioner Ross moved to approve the below listed Minutes of the Board of County Commissioners meeting, as printed. Commissioner Peppler seconded the motion and it carried unanimously. 1. Minutes from November 26, 2025 Amendments to Agenda: There were no amendments to the Agenda. Consent Agenda: There being no request for public testimony concerning the following items, as listed under 'Consent Agenda — Miscellaneous', Commissioner Maxey moved to approve the Consent Agenda, as printed. Commissioner James seconded the motion and it carried unanimously. 1. Partial Vacation, VAC25-0025, of Two-Lot Recorded Exemption, RE-3452, for Removal of Lot B — 5L Holdings, LLC 2. Recognition of Services, Workforce Development Board — Zach Huston: Chair Buck read the certificate for the record and the Board extended their appreciation for Mr. Huston's volunteer efforts on behalf the citizens of Weld County. 2. Recognition of Services, Human Services Advisory Commission — Gillian Smith: Chair Buck read the certificate for the record and the Board extended their appreciation for Ms. Smith's volunteer efforts on behalf the citizens of Weld County. 3. Milton M. Miller Award, Colorado Environmental Health Association — Gabri Vergara: Chair Buck read the certificate recognizing Ms. Vergara for her upstanding 30-year career. Dan Joseph, Department of Public Health and Environment, stated he thinks of her as the "Swiss Army Knife" for the department, and shared she was nominated because she exemplifies genuine reliability. Cassie Theisen, Department of Public Health and Environment, stated Ms. Vergara is the best leader she has had the privilege to work for and further read numerous quotes and testimonies submitted by her staff that indicate she is a servant leader, professional, optimistic, humble, supportive, mentor who brings out the best in others, irreplaceable, and admired. Ms. Vergara expressed her heart-felt appreciation and admiration for her colleagues for their outstanding efforts that have allowed her to excel with the opportunity to make a lasting difference for tne community. In turn, each of the Commissioners extended their congratulations and honored her remarkable excellence throughout her tenure. (Clerk's Note: The group gathered for a photo opportunity.) 4. University Bulldogs Day, Class 3A Softball State Championship — December 10, 2025: Commissioner James read the proclamation for the record. Sydney Geatz'er, team Captain, expressed her pride in her team for working together, persevering to the end and winning. Chris Hutton, Coach of the Year, commented on the team's stellar season, thanked the Board for their recognition, and attributed their excellence this season to the focus on physical health by being mindful of their diet and stretching more, and their mental health by processing and overcoming the difficult challenges together. She applauded the team for their accomplishments, outstanding skills, and leadership. Each of the teammates introduced themselves for the record. The Board extended their congratulations to the team for their accomplishments, acknowledged the parents and families for their dedication and sacrifices for the success of their child in the sport they love, and commented on how the bar is set high for next year. General Warrants: Commissioner Maxey moved to approve the General Warrants, as printed. Commissioner James seconded the motion and it carried unanimously. New Business — General: 1. Consider Contract for 2026 Victim Assistance and Law Enforcement (VALE) Grant for Victim Witness Assistance Unit, and Authorize Chair, 19th Judicial DistrictAttorney's Office, and Controller to Sign: Michael Rourke, 19th Judicial District Attorney, alongside Robb Miller, Assistant District Attorney, and Ermelinda Archibeque, Victims Assistance Program Manager, stated the County has been awarded funding, in the amount of $160,000.00, or 30% less than years prior, which he addressed was an anticipated shortfall of approximately $105,000.00, which was reflected in the budget process for 2026. In response to Commissioner James, Mr. Rourke confirmed the funding provides nine (9) positions, in part, and he further explained the reduction of 30% in funding from last year is directly resulting from judges waiving fees to offenders determined to be unable to pay certain aspects of their fines. Mr. Rourke indicated the Chief Justice of the Colorado Supreme Court recognized the shortfalls and has put additional boundaries in place as of April 2025, so the hope is moving forward it will help rectify the gap in funding to support victims. Commissioner Maxey moved to approve said contract and authorize the Chair and the 19th Judicial District Attorney's Office to sign. The motion was seconded by Commissioner Ross and it carried unanimously. 2. Consider Contract ID #10146 Intergovernmental Grant Agreement Award Letter for Victims of Crime Act (VOCA) Program for Bilingual Advocate Unit and Authorize Chair and Sheriff's Office to Sign: Sergeant Daniel Chapman, alongside Thanh Matthews, Sherriff's Office, stated the County was awarded grant funds, in the amount of $57,282.00, to be used for approximately 53% of salary expenses for one (1) bilingual advocate. Commissioner James moved to approve said agreement and authorize the Chair and the Sheriff's Office to sign. The motion was seconded by Commissioner Peppler and it carried unanimously. 3. Consider Contract ID #10147 for 2026 Victim Assistance and Law Enforcement (VALE) Grant for Law Enforcement Victim Services Unit, and Authorize Chair, Sheriff's Office, and Controller to Sign: Sergeant Chapman stated the County was awarded funds, in the amount of$32,500.00, to be used for approximately 29% salary expenses for one (1) victim assistant. Commissioner Maxey moved to approve said contract and authorize the Chair and the Sheriff's Office to sign. Consider Mini-Grant Application for Casey Family Programs Funding to Support Foster Youth in Transition and Authorize Department of Human Services to Submit Electronically — Colorado Human Services Directors Association (CHSDA): Jamie Ulrich, Director of the Department of Human Services, requested to submit said application for grant funds, in the amount of $19,950.00, and explained if awarded, funding would be used to support foster youth in transition with no county match. Commissioner Maxey moved to approve said application and authorize the Department of Human Services to submit electronically. The motion was seconded by Commissioner James and it carried unanimously. 5. Consider Contract ID #10120 Professional Service Agreement for Compass / OnBase Software and Authorize Chair to Sign — Northwoods Consulting Partners, Inc.: Ms. Ulrich stated the agreement allows for the department to utilize said software that supports several vital functions for the department, such as contract management and scheduling child welfare appointments. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Peppler and it carried unanimously. 6. Consider Contract ID #10136 Subscription Growth Acknowledgement Pursuant to Master Services Agreement for Enterprise Resource Planning (ERP) Software Implementation and Integration Service, and Authorize Chair to Sign — Workday, Inc.: Jill Scott, Director of the Department of Human Resources, stated the growth acknowledgement reflects accurate workers using the Workday software from January 1, 2026, through January 16, 2027, in the amount of $142,799.00. Commissioner Ross moved to approve said acknowledgement and authorize the Chair to sign. The motion was seconded by Commissioner James and it carried unanimously. 7. Consider Contract ID #10143 Memorandum of Understanding for Implementation of Campaign to Support National Diabetes Prevention Program and Authorize Chair to Sign — Poudre Valley Health Care, Inc., dba Poudre Valley Hospital, obo UCHealth Diabetes and Medical Nutrition Therapy Clinic: Jason Chessher, Director of the Department of Public Health and Environment, stated the memorandum of understanding (MOU) allows for continued partnership with UCHealth to support the 'Heart of Weld' diabetes program through June 30, 2026. Commissioner Maxey moved to approve said MOU and authorize the Chair to sign. The motion was seconded by Commissioner Peppler and it carried unanimously. 8. Consider Temporary Closure of County Road 13 Between County Road 56 and U.S. Highway 34: Amy Mutchie, Department of Public Works, presented the request of said closure on behalf of the Little Thompson Water District and Turner Excavation, which is to begin on December 15, 2025, and go through December 19, 2025, for the installation of water service for IDS Homes. She stated 2025-3362 BC0016 Page 5 Wednesday, December 10, 2025 www.weld.gov the watermain exists under the southbound leg of County Road 13 and the detour route is paved. Commissioner Ross moved to approve said temporary closure. The motion was seconded by Commissioner James and it carried unanimously. 9. Consider External Users Agreement for Event Terms and Conditions for 2026 State of the County, and Authorize Chair to Sign —Aims Community College: Bruce Barker, County Attorney, stated the agreement allows for use of the Aims Community College facility for the State of the County Event on October 8, 2026, for the amount of $3,210.00, of which, $500.00 is refunded upon cleaning after said event. Commissioner James moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Peppler and it carried unanimously. 10. Consider Appointment to Board of Adjustment: Commissioner Ross moved to approve said appointment. The motion was seconded by Commissioner Maxey and it carried unanimously. 11. Consider Appointment to Juvenile Community Review Board: Commissioner Maxey moved to approve said appointment. The motion was seconded by Commissioner Ross and it carried unanimously. 12. Consider Appointment to Noxious Weed Management Advisory Board: Commissioner Ross moved to approve said appointment. The motion was seconded by Commissioner James and it carried unanimously. 13. Consider Appointments and Reappointments to Workforce Development Board: Commissioner Maxey moved to approve said appointments and reappointments. The motion was seconded by Commissioner Peppler and it carried unanimously. 14. Consider Reappointments to Weld County Building Code Board of Appeals: Commissioner Ross moved to approve said reappointments. The motion was seconded by Commissioner Maxey and it carried unanimously. 15. Consider Dissolution of Weld Faith Partnership Council: Commissioner James moved to approve said Resolution. The motion was seconded by Commissioner Ross. Commissioner Peppler extended her appreciation to those whom have served on the Council on behalf of the citizens of Weld County. She explained the dissolution is the result of a reduction in grant funding, and encouraged continuation of their ministry networks without the County's oversight. Consider 2026 Amount to be Paid for Intergovernmental Agreement Between City of Greeley and Weld County for Island Grove Park Management Services: Linda Duncan, Budget Analyst, stated the agreement with the City of Greeley, is in the amount of $979,754.00, for 2026 operating expenses for the management of the County's facilities located at Island Grove Park. Commissioner Ross moved to approve the Resolution. The motion was seconded by Commissiorer James and it carried unanimously. 17. Consider Memorandum of Agreement Between Weld County, Colorado, and A Woman's Place as Recipient of Weld County General Fund Monies, and Authorize Chair to Sign: Ms. Duncan stated the agreement provides $10,000.00 in general fund monies for 2026 operational expenses to support individuals and families affected by domestic violence across Weld County. Commissioner Ross moved to approve said memorandum of agreement and authorize the Chair to sign. The motion was seconded by Commissioner Maxey and it carried unanimously. 18. Consider Memorandum of Agreement Between Weld County, Colorado, and Envision as Recipient of Weld County General Fund Monies, and Authorize Chair to Sign: Ms. Duncan stated the agreement provides $38,458.00 of general fund monies for 2026 operational expenses to provide early intervention services to developmentally disabled children in Weld County. Commissioner Maxey moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Ross, and upon a roll call vote of four (4) to one (1) the motion carried with Commissioner Peppler abstained. 19. Consider Memorandum of Agreement Between Weld County, Colorado, and Great Western Trail Authority as Recipient of Weld County General Fund Monies, and Authorize Chair to Sign: Ms. Duncan stated the agreement provides $20,000.00 of general fund monies for 2026 operational funding for maintenance of the Great Western Trail in unincorporated Weld County. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. The mction was seconded by Commissioner Maxey and it carried unanimously. 20. Consider Memorandum of Agreement for Mental Health Services Between Weld County, Colorado, and North Range Behavioral Health as Recipient of Weld County General Fund Monies, and Authorize Chair to Sign: Ms. Duncan stated the agreement provides $206,000.00 of general fund monies for 2026 operational funding to support mental health services. Commissioner Maxey moved to approve said agreement and authorize the Chair to sign. Consider Memorandum of Agreement for Suicide Education and Prevention Services Between Weld County, Colorado, and North Range Behavioral Health as Recipient of Weld County General Fund Monies, and Authorize Chair to Sign: Ms. Duncan stated the agreement provides $20,000.00 of general fund monies for 2026 operational funding to support suicide education and prevention services. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Maxey and it carried unanimously. 22. Consider Agreement Between Weld County, Colorado, and United Way of Weld County (211 Information and Referral) as Recipient of Weld County General Fund Monies, and Authorize Chair to Sign: Ms. Duncan stated the agreement provides $50,000.00 of general fund monies for 2026 operational funding for the 211 Information and Referral Services Program. Commissioner Maxey moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Ross and the motion carried unanimously. 23. Consider Memorandum of Agreement Between Weld County, Colorado, and United Way of Weld County (Reading Great by 8) as Recipient of Weld County General Fund Monies, and Authorize Chair to Sign: Ms. Duncan stated the agreement provides $10,000.00 of general fund monies for 2026 operational expenses for the Reading Great by Eight program. Commissioner Maxey moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Ross, the motion carried unanimously. 24. Consider Memorandum of Agreement Between Weld County, Colorado, and United Way of Weld County (Weld's Way Home) as Recipient of Weld County General Fund Monies, and Authorize Chair to Sign: Ms. Duncan stated the agreement provides $10,000.00 of general fund monies for 2026 operational funding for Weld's Way Home program. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Maxey, the motion carried unanimously. 25. Consider Memorandum of Agreement Between Weld County, Colorado, and Upstate Colorado Economic Development as Recipient of Weld County Economic Development Trust Fund Monies, and Authorize Chair to Sign: Ms. Duncan stated the agreement provides $200,000.00 of economic development trust fund monies for 2026 operational funding to support existing and potential industries in Weld County. Commissioner Ross moved to approve said agreement and authorize the Chair to sign. Consider Memorandum of Agreement Between Weld County, Colorado, and Weld County Senior Citizen Coordinators as Recipient of Weld County General Fund Monies, and Authorize Chair to Sign: Ms. Duncan stated the agreement provides $40,000.00 of general fund monies for 2026 operational funding to support senior programs. Commissioner Maxey moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Peppler and it carried unanimously. New Business — Ordinances: 1. Final Reading of Code Ordinance #2025-13, In the Matter of Repealing and Reenacting, with Amendments, Chapter 5 Revenue and Finance of the Weld County Code (Annual Fees): Commissioner Ross moved to read Code Ordinance #2025-13 by title only. Seconded by Commissioner James, the motion carried unanimously. Mr. Barker read the title for the record. Jennifer Oftelie, Budget Manager, reviewed a minor clerical revision on Page 14 for three (3) of the tier multipliers for fees, and staff recommends approval. There being no public testimony concerning the matter, Commissioner Maxey moved to approve Code Ordinance #2025-13 on Final Reading, as amended. Commissioner James seconded the motion and it carried unanimously. (Clerk's Note: Chair Buck called a five (5)-minute recess and the meeting reconvened at 10:02 a.m.) New Business — Planning: 1. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Meliha Sabanovic: Adria Schiel, Assistant County Attorney, reviewed the property location, various code violations, and the daily penalties, in the amount of$25.00, that were determined by the Weld County Court. While Nicole Brick, Code Compliance Officer for the Department of Planning Services, displayed photographs recently taken, Ms. Schiel stated the property has been non-compliant with the Weld County Code since 2019, and staff recommends certification of penalties in the amount of $10,875.00. Babahudia Mahic, representative of the property owner, requested additional time to screen the property; however, staff indicated screening would not be an acceptable solution and the property needs to be cleared of the junk and occupied trailers, since there is not a principle use on the parcel. After hearing testimony, Commissioner James moved to approve said certification. The motion was seconded by Commissioner Ross and it carried unanimously. 2. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment—Aryan Kiani: Ms. Schiel reviewed the property location, various code violations, and the daily penalties, in the amount of $25.00, that were determined by the Weld County Court. While Ms. Brick displayed photographs recently taken, Ms. Schiel stated the property has 2025-3362 BC0016 Page 9 Wednesday, December 10, 2025 www.weld.gov been non-compliant with the Weld County Code since 2019, and staff recommends certification of penalties in the amount of $10,750.00. There being no property owner present, Commissioner James moved to approve said certification. The motion was seconded by Commissioner Maxey and it carried unanimously. 3. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Dave Sanger, Sr.: Ms. Schiel reviewed the property location, various code violations, and the daily penalties, in the amount of $10.00, that were determined by the Weld County Court. While Ms. Brick displayed photographs recently taken, Ms. Schiel stated the property has been non-compliant with the Weld County Code since 2021, and staff recommends certification of penalties in the amount of $4,300.00. There being no property owner present, Commissioner James moved to approve said certification. The motion was seconded by Commissioner Maxey and it carried unanimously. 4. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Jerry Dill and Lynne Kelly: Ms. Schiel indicated staff has received information that Jerry Dill has passed away and staff requested a six (6)-month continuance to verify the status of the estate. Commissioner James moved to continue said certification to June 10, 2026, at 9:00 a.m. The motion was seconded by Commissioner Maxey and it carried unanimously. 5. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Francisco Hernandez Valdovinos and Deyanira Torres: Ms. Schiel reviewed the property location, and indicated the Weld County Court assessed daily penalties, in the amount of $50.00, for unpermitted additions made to a modular structure. Ms. Brick stated she was contacted by the property owner yesterday stating they are having trouble finding an engineer to sign off on their recent addition. The property owners were not present; however, in response to Commissioner Maxey, Ms. Brick clarified if they are able to submit engineered plans for the addition Mr. Valdovinos would be compliant. Commissioner Ross moved to continue the matter to June 10, 2025, at 9:00 a.m., to allow the property owner further time to work on getting the property into compliance. Seconded by Commissioner James, the motion carried unanimously. 6. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment—Omar Perez: Ms. Schiel reviewed the property location, various code violations, and the daily penalties, in the amount of $50.00, that were determined by the Weld County Court. While Ms. Brick displayed photographs recently taken, Ms. Schiel stated the property has been non-compliant with the Weld County Code since February 10, 2025, and staff recommends certification of penalties in the amount of $13,750.00. The motion was seconded by Commissioner Maxey and it carried unanimously. 7. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Amber Cherry: Ms. Schiel recommended not to certify the penalties and dismiss the case since the property owner, Amber Cherry, paid for her updated permits and the property is compliant with the Weld County Code. Commissioner James moved to dismiss the matter and declared the accrued penalties no longer due or owing. Seconded by Commissioner Ross, the motion carried unanimously. 8. Consider Certification to Weld County Treasurer for County Compliance Violation Penalties as Special Assessment — Alejandro Rincon and Perla Rodriguez: Ms. Schiel reviewed the property location and stated the Weld County Court assessed daily penalties, in the amount of $50.00, for multiple commercial vehicles in an agricultural subdivision. While Ms. Brick displayed photographs recently taken, Ms. Schiel stated the property has been non-compliant with the Weld County Code since September 8, 2025, and staff recommends certification of penalties in the amount of $3,250.00. There being no property owner present, Commissioner James moved to approve said certification. The motion was seconded by Commissioner Ross and it carried unanimously. Public Comment: 1. Patrick Redman, City of Fort Collins resident, offered his comments to the Board. 2. Charles Anderson, Town of Platteville resident, offered his comments and provided a letter (Marked as Exhibit A) to the Board, with response from Commissioner Maxey. Let the Minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board. I hired a lawyer who hired an appraiser and got a different appraisal. I am not sure if I am gaining anything, my lawyer says that Xcel is going to get my appraisal thrown out. I don't understand how the law is for big business. Lawyers get paid for every minute. I am sure this could have been settled but no one tried, they gave me a contract I could not sign, but no one seems to care. After you own a piece of property for 40 years, they could be fair, but Xcel would rather spend more money on lawyers than help the people who buy their electric power. I have lost sleep over this for approx. 2 years and now they tell me my time is worth nothing. It's about over. All I know is time is precious and I wasted a lot of it. They have their power line built, but the fight continues. I'm sure there will be nothing left when it is all said and done so warn others as to what can happen, the law is not on your side.
